ORDINANCE NO. 419.
The City of New Beach, by
and through its City Council, does
ordain as follows:
SECTION 1. It is hereby de-
clared unlawful for any person,
co-partnership, firm or corpora-
tion, to conduct or permit to be
conducted any game of chance or
skill in the City of Newport
Beach, wherein there shall be
used chips, tokens or tickets evi-
dencing or representing things of
value, between the hours of two
o'clock A. M. and seven o'clock
A. M. of any day after this or-
dinance shall go into full force and
effect.
SECTION 2. It is hereby de-
clared unlawful for any person,
firm, co- partnership or corpor-
ation to conduct or allow to be
conducted in the City of Newport
Beach, any public or semi- public
dance, between the hours of two
o'clock A. M. and seven o'clock
A. M. of any day after this ordin-
ance shall go into full force and
effect.
` SECTION 3. Any violation of
.'this ordinance shall constitute a
misdemeanor, and shall be punish-
able by a fine not to exceed
$100.00, or by imprisonment in the
'City 'Jail of Newport Beach or
the County Jail of Orange Coun-
ty, for a period of time not to ex-
ceed ten, days, or by both such
tine and imprisonment.
SECTION 4. This ordinance is
hereby declared an urgency meas-
ure, necessary for the immediate
.preservation of the public peace,
health and safety, and shall there-
fore take effect immediately upon
its first publication. The facts con-
stituting such urgency are as fol-
lows: There are no closing hours in
the City of Newport Beach, for
those conducting games of skill or
chance, and no ordinance prop-
erly regulating the closing of
public or semi - public dances at
reasonable hours, in said city;
that by reason of these f.ccts it is
difficult for the city of Newport
Beach to properly police said
city, as the places of amusement
in this ordinance mentioned draw
large crowds of people. That in ad-
' :i'jon to these facts, there is mu-
sic as well as a great deal of
noise, which accompanies t h e
amusements mentioned, and by
reason of that fact, many citizens
of the city of Newport Beach are
disturbed in their rest and quiet
during the early morning hours.
In order to afford proper relief to
the residents of the City of New-
port Beach, it is necessary that
this ordinance take effect immed-
iately upon its first publication.
SECTION 5. The City Clerk
shall certify to the separate vote
on the urgency of this ordinance
and its passage by the vote of five
members of the city council of the
City of Newport Beach, and cause
the same to be published once in
Newport News, a newspaper print-
ed and circulated in the City of
Newport Beach, and upon such
publication this ordinance shall
become immediately operative and
take full effect.
I hereby certify that the ques-
tion of the urgency of the fore-
going ordinance was passed and
the foregoing ordinance was
adopted by a vote of five (5) mem-
bers of the City Council of the
City of Newport Beach at its
meeting of July 17th, 1933.
