HomeMy WebLinkAbout477 - City Improvements• • • E • ORDINANCE NO. 477 AN ORDINANCE OF THE CITY OF NEWPORT BEACH, ADOPTING CERTAIN IM- IMPROVEMENTS AS A CITY PLAN, SUBJECT TO THE APPROVAL OF THE ELEC- TORS. WHEREAS, the City Planning Commission of the City of Newport Beach has submitted to the City Council of the City of Newport Beach a number of municipal im- provements in one group as con- stituting a City Plan, and has recommended to said City Council that said City Council adopt said Plan as constituting a City Plan and that said Plan be submitted for approval to the qualified elec- tors of the City of Newport Beach at a special election to be held in said city for said purpose; and WHEREAS, it affirmatively appears that the Planning Com- mission of the City of Newport Beach has held at least two (2) public hearings on said proposed City Plan, notice of the time and place of said hearings having been given by at least two (2) publica- tions in NEWPORT - BALBOA NEWS- TIMES, a semiweekly newspaper printed, published and generally circulated in said city; and WHEREAS, following said hear- ings by said Planning Commis- sion as aforesaid, said Planning Commission has adopted the fol- lowing group of municipal im- provements as constituting a City Plan under Section 14 of Act 5178, and amendments thereof, Deering's General Laws of the State of California, Statutes 1901, page 27, as amended; the municipal im- provements, in one group, in this resolution mentioned, and as con- stituting a City Plan, being as follows: (a) The acquisition and con- struction of a public improve- ment, to wit: The acquisition and construction of a group of buildings, including equip- ment of same, on one parcel of land, including therein a city hall, police station and jail, and construction of streets, walks and other work Incidental thereto, and the acquisition of rights of way and lands necessary or conven- ient for the use of said build- ings. All of said buildings to be used for public pur- poses. Said project to cost approximtely $90,000.00. (b) The acquisition and con- struction of a public improve- ment, to wit: Additions to municipal water system, in- cluding therein fire protection, mains and hydrants, water works, areation tanks, pump- ing plants, and the acquisition of buildings and lands neces- sary or convenient to said project. Said project to cost approximtely $141,819.00. (c) The acquisition and con- struction of a public improve- ment, to wit: Additions to municipal sewer system, in- cluding therein construction and reconstruction of sanitary sewers, underground pumping stations, including therein the acquisition of lands and rights of way, and other work inci- dental thereto. Said project to cost approximately $127,- 273.00. (d) The acquisition and con- struction of a public improve- ment, to wit: The construction and reconstruction of a public Wharf at Newport Beach, in- cluding therein the acquisition of lands and rights of way, and other works incidental thereto. Said project to cost approximately $25,000.00. (e) The acquisition and construction of a public im- provement, to wit: The acqui- sition of lands to be used for public park purposes, automo- bile parking areas, the im- proving and beautifying of same, including the erection and construction of rest rooms and other public buildings, to be used for public purposes. The lands so to be acquired are located on the Ocean Front between Adams and "B" Streets in Balboa, City of Newport Beach. Said proj- ect to cost approximately $55,000.00. (f) The acquisition and con- struction of a public improve- ment, to wit: The acquisition of a public street along the Ocean Front between Adams and "B" Streets, and the pav- ing, curbing and protection thereof from the water& of the Pacific Ocean, including there- in the acquisition of lands and rights of way, and other work incidental thereto. Said proj- ect to cost approximately $601000.00. (g) The acquisition and construction of a public im- provement, to wit: The con- struction of a building for public uses in Corona del Mar, including therein a build- ing to be used for recreation- al purposes, and public meet- ings, and playground&, show- ers, lockers and equipment, including the acquisition of lands and rights of way, and other works incidental there- to. Said project to cost approximately $34,000.00. and WHEREAS, the City Council of the City of Newport Beach did, upon receipt of a certified copy of said City Plan as adopted by said Planning Commission as aforesaid on Monday, the 19th day of Sep- tember, 1938, hold a public meet- ing on said Plan, notice of the time and place of said public meet- ing having been published at least once in NEWPORT - BAL13OA NEWS TIMES, a semiweekly newspaper printed, published and generally circulated in the City of Newport Beach, which said publication was given and pub- lished at least ten (10) days before the day of said hearing, to wit, on the 6th day of September, 1938; and WHEREAS, no change in or addition to said Plan, or any part thereof, as adopted by the Plan- ning Commission has been made by said City Council; and WHEREAS, it is the opinion and judgment of said City Council that said City Plan will conserve and promote the public health, safety and general welfare of said City of Newport Beach: NOW, THEREFORE, the City Council of the City of Newport Beach, California, does ordain as follows: SECTION 1. That the City Plan herein mentioned will conserve and promote the public health, safety and general welfare of the City of Newport Beach and the inhabitants thereof. SECTION 2. That said City Plan, and the whole thereof, as adopted by said Planning Commission and as submitted to this City Council shall be and the same is hereby adopted subject to the approval thereof by a majority vote of the qualified electors of the city voting thereon. SECTION 3. That said City Plan be submitted to the quali- fied electors of the City of New- port Beach for approval at a special election, and that the Plan be submitted for approval at the election at which a bond issue to include in one bond issue for one gross amount bonds for all of said improvements constituting said City Plan is submitted.
