ORDINANCE NO. 486
AN ORDINANCE OF THE CITY
OF NEWPORT BEACH RE-
LATING TO REDEMPTION
OF PROPERTY SOLD FOR
NON - PAYMENT OF TAXES
AND DECLARING THE TTR-
GENCY HEREOF, TO TAKE
EFFECT IMMEDIATELY.
The City cf Newport Beach, by
and through its City Council. does
ordain as follows:
Section 1. This section is here-
by added to the tax ordinance of
the City of Newport Beach, being
tax ordinance No. 428, and to be
in full force and effect until
September 1st, 1939, after which
time the redemption clauses of
said ordinance Nu. 428, of the City
of Newport Beach shall be in full
force and effect. Said sections to
be added to the said tax ordinance
No. 428, and to be known as Sec-
tion 28 -c -1, shall read as follows:
As to persons who may redeem
under this section, this section
supersedes all sections relating
tc redemption under this ordinance
until September 1st, 1939.
"Taxes" as used in this section,
includes all taxes and assessments
and annual installments of assess-
ments charged on the tax rolls.
In all cases where property has
been sold to the City of Newport
Beach on or before July 6, 1938,
for delinquent taxes and the right
of redemption has not been ter-
minated, any person entitled to
redeem the property, except as
otherwise previded in this section,
may, at any time before Septem-
ber 1. 1939, redeem the property
by paying the amount of unpaid
taxes as defined in this ordinance,
without penalties for delinquency,
costs, redemption penalties or in-
terest.
Except as provided in this sec-
tion such redemption shall be
made in the usual manner.
A person, who, on January 1,
1939, was not the owner or person
otherwise entitled to redeem any
property may not redeem such
property under this section.
All applications to redeem under
this section shall be accompanied
by an affidavit of the person
seeking to redeem, stating:
(a) That the applicant was the
owner or person otherwise entitled
tc redeem the property on Jan-
uary 1, 1939;
(b) That the applicant has not
transferred, conveyed or other-
wise disposed of the property sub-
sequent to January 1, 1939.
Section 2. If any section, sub-
section, sentence, clause, or phrase
of this ordinance is for any reason
held to be unconstitutional, Such
decision shall not effect the valid-
ity of the remaining portions of
this ordinance. The City Council
of the City of Newport Beach
hereby declares that it would have
passed this ordinance irrespective
of the fact that any one or more
sections, subsections, sentences,
clauses or phrases be declared un-
constitutional.
Section 3. This act is hereby
declared to bean urgency measure
necessary for the immediate
preservation of the public peace,
health and safety within the mean-
ing of Section 1, Article 4 of the
Constitution and shall, therefore,
go into immediate effect. The
facts constituting the necessity
are as follows: Due to the Wide-
spread Depression, many taxpay-
ers have been unable to pay their
taxes or to redeem their property
from sale to the City for delin-
quency. By permitting redemption
without penalties, many taxpayers
will be enabled to redeem their
property, restore the same to tax
rolls and thereby add needed rev-
enue for the operation and main-
tenance of Local City Government.
Section 5. The City Clerk shall
certify to the separate vote on the
urgency of this ordinance and its
passage by the vote of five mem-
bers of the City Council of the
City of Newport Beach, and cause
the same to be published once in
NEWPORT BALBOA NEWS
TIMES, a semi - weekly newspaper
printed and circulated in the City
of Newport Beach, and upon such
publication this ordinance shall
become immediately operative and
take full effect.
I hereby certify that the ques-
tion of the urgency of the fore-
going ordinance was passed and
the foregoing ordinance was
adopted by a vote of five mem-
bers of the City Council of the
City of Newport Beach, at its
meeting held on the 26th day of
June, 1939.
