HomeMy WebLinkAbout488 - Special Election - 12-05-1939• • ORDENANCE NO. 488 AN ORDINANCE OF THE CITY OF NEWPORT BEACH, CALI - FORNIA, ORDERING, CALL- ING AND PROVIDING FOR, AND GIVING NOTICE OF, A SPECIAL ELECTION TO BE HELD IN THE CITY OF NEW- PORT BEACH, ON TUESDAY, THE 5TH DAY OF DECEM- BER, 1939, FOR THE PUR- POSE OF SUBMITTING TO THE QUALIFIED VOTERS OF SAID CITY A PROPOSITION TO INCUR BONDED INDEBT- EDNESS BY SAID CITY FOR CERTAIN MUNICIPAL IM- PROVEMENTS. WHEREAS, the City Council of the City of Newport Beach, Cali- fornia, did on the 23rd day of October, 1939, by a vote of more than two - thirds of the members of said Council, adopt a Resolu- tion No. 1664, entitled, "A Reso- lution of the City Council of the City of Newport Beach, determin- ing and declaring that the public interest and necessity demand the acquisition and construction of a municipal improvement, to -wit: The acquisition, construction and reconstruction of two public piers, including the reconstruction and extension of the existing piers into the waters of the Pacific Ocean, including buildings and structures necessary or conven- ient for said project," which said resolution was duly signed and ap- proved by the Mayor of said City and attested and certified by the City Clerk of said City. NOW, THEREFORE, the City Council of the City of Newport Beach does ordain as follows: Section 1. That a special elec- tion be held and the same is here - bv called to be held in the city of Newport Beach on Tuesday, the 5th day of December, 1939, for the purpose of submitting to the qualified voters of said city the proposition of incurring indebted- ness and issuing bonds of said city therefor, in the amount herein- after set forth, and for the objects and purposes set forth in said reso- lution and hereinafter stated. Section 2. That the objects and purposes for which said indebted- ness is proposed to be incurred and 'bonds issued therefor are as follows: The acquistion and construction by the City of Newport Beach of a certain municipal improvement, to -wit: The acquisition, construc- tion and reconstruction of two public piers, including the recon- struction and extension of the ex- isting piers, into the waters of the Pacific Ocean, including build- ings and structures necessary or convenient for said project. Section 3. That the estimated cost of the proposed municipal improvement described in Section 2 hereof is the sum of One Hun- dred Thirty Thousand Dollars ($130,000.00); that the amount of the principal of the indebtedness to be incurred therefore is the sum of One Hundred Thirty Thousand Dollars ($130,000.00), and that the maximum rate of in- terest to be paid on said indebted- ness shall be five percent (5%) per annum, payable semi - annually. That if the proposition for the incurring of said indebtedness so submitted, receives the requisite number of votes, to -wit, two - thirds of the votes of the qualified voters voting on said proposition, bonds of said city in not exceeding the principal amount stated in such proposition shall be issued and sold for the objects and purposes set forth herein. Section 4. That the polls for caid election shall be opened at six o'clock A. M.. of, the day of said election, and shall remain open continuously from said time until seven o'clock P. M., of the same day, when said polls shall be clos- ed; provided, however, that if at said hour of closing there are any voters in any polling place or in line at the door thereof who are qualified to vote and have not been able to do so since appear- ing, the polls thereat shall be kept open a sufficient time to enable them to vote, but no one who shall arrive at any polling place after seven o'clock P. M., of said day shall be entitled to vote although the polls may be open when he ar- rives. That on the ballots to be used at said special election, in addition to the other matters required by law, there shall be printed sub- stantially the following: Mark cross (x) on ballot ONLY WITH RUBBER STAMP; never with pen or pencil. INSTRUCTIONS TO VOTERS To vote on any measure, stamp a cross (x) in the voting square after the word "Yes" or after the word "No." All marks, except the cross (x) are forbidden. All dis- tinguishing marks or erasures are forbidden and make the ballot void. If you wrongly stamp, tear, or de- face this ballot, return it to the inspector of election and obtain another. PROPOSITION NO. 1 Shall the City of New- port Beach incur a bonded indebtedness in the principal sum of $130,000.00 for the acquisition and con- struction of a munici- pal improvement, to- wit: The acquisition, construction and re- construction of two public piers, including the reconstruction and extension of the exist- ing piers, into the wat- ers of the Pacific Ocean, including build- ings and structures necessary or conven- ient for said project? NO A cross (x) stamped in the vot- ing square after the word "Yes" shall be counted in favor of the adoption of the question or prop - o-ition. A cross (::) stamped in the voting square after the word "No" shall be counted against the adop- tion of the question or proposition. Section 5. That for the purpose of holding said election there shall be and are hereby established seven (7) voting precincts, being the voting precincts as established by the Board of Supervisors of the County of Orange, for the holding of County and State elec- tions; that the polling places for the respective voting precincts shall be the places hereinafter designated, and that the persons hereinafter named, being compe- tent and qualified electors and residents of said city and of their respective election precincts, are hereby appointed officers of elec- tion for their respective election precincts, and they shall hold said election and make return thereof in the manner provided by law. That Election Precinct No. 1 shall consist of the regular Elec- tion Precinct No. 1 as now estab- lished in the City of Newport Beach by the Board of Supervisors of the County of Orange, for the holding of State and County elec- tions. That the polling place and the election officers to act at said election precinct shall be as fol- lows: Polling Place: Roehe's Garage, rear of 127 30th Street, Newport Beach, California. Hess That Election Precinct No. 2 shall consist of the regular Elec- tion Precinct No. 2 as now estab- lished in the city of Newport Beach by the Board of Supervisors of the County of Orange, for the holding of State and County elec- tions. That the polling place and the election officers to act at said election precinct shall be as fol- lows: Polling Place: City Hall, New- port Beach, California. That the polling place and the election officers to act at said election precinct shall be as fol- lows: Polling Place: Legion Hut, 10th Street and Bay Front, Newport Beach, California. That the polling place and the election officers to act at said election precinct shall be as fol- lows: Polling Place: East Newport Garage, Corner Bay and Island Avenues. Summers That Election Precinct No. 5 shall consist of the regular Elec- tion Precinct No. 5 as now estab- lished in the city of Newport Beach by the Board of Supervisors of the county of Orange, for the holding of State and County elec- tions. That the polling place and the election officers to act at said election precinct shall be as fol- lows: Polling Ploce: Fire Hall, 702 Bay Avenue, Balboa, California. Officers: Inspector: Harold C. That the polling place and the election officers to act at said election precinct shall be as fol. lows: Polling Place: Sloan's Real Es- ' tate Office, 503 State Highway, Corona del Mar. That in all particu- lars not recited in this ordinance, said election shall be held and con- ducted as provided by law for • holding municipal elections in said city. Section 7. That the City Coun- cil of said city shall meet at its usual place of meeting in the City Hall of said city on Monday; the 11th day of December, 1939, at 7:30 o'clock P. M. of said day, and proceed to canvass the election re- turns and declare the result of said election. Section 8. That the City Clerk shall certify to the passage and adoption of this ordinance by a vote of more than two - thirds of all the members of the City Coun- cil of the city of Newport Beach, and to its approval by the Mayor, and shall cause this ordinance to be published once a week for two (2) successive weeks, in the New- port Balboa News - Times, a news- paper of general circulation print- ed and published less than six (6) days a week in said city, and such publication of this ordinance shall constitute the notice of said elec- tion and no other notice of said election than the publication aforesaid shall be necessary.
