• <br />• <br />• <br />ORDINANCE NO. 499 <br />The City of Newport Beach, by <br />and through its City Council, <br />does ordain as follows: <br />Section 1. <br />Every hotel, lodging house, <br />apartment house, bungalow court , <br />motel or rooming house wherein <br />rooms are rented to the general <br />public, shall keep and maintain <br />a permanent b o u n d register in <br />the office thereof wherein each <br />lodger, roomer, person or- occupant <br />occupying any room, shall be re- <br />quired to set forth his or their <br />names and permanent places of <br />address before being permitted to <br />occupy any such room. <br />Section 2. <br />The register herein required <br />shall be permanently bound so <br />that no sheet may be taken there- <br />from and shall be of the minimum <br />size of at least twelve inches by <br />twelve inches and shall be kept <br />in the office of said person rent- <br />ing rooms aforesaid, where the <br />same may be inspected by any <br />police officer of the City of New- <br />port Beach. <br />Section 3. <br />Any person, firm or corpora- <br />tion, whether as principal, agent, <br />employee, or otherwise, violating <br />any provisions of this ordinance <br />shall be guilty of a misdemeanor <br />and, upon conviction thereof, shall <br />be punishable by a fine of not <br />more than seventy -five dollars <br />($75), or by imprisonment in the <br />City Jail of the City of Newport <br />Beach or the County Jail of the <br />County of Orange, in the State of <br />California, for a term not ex- <br />ceeding thirty (30) days, or by <br />both such fine and imprisonment. <br />Such person, firm or corporation <br />shall be deemed guilty of a separ- <br />ate offense for each and every day <br />during any portion of which any <br />violation of this ordinance is com- <br />mitted, continued o r permitted <br />by such person, firm or corpora- <br />Von and shall be punishable as <br />herein provided. <br />Section 4. <br />This ordinance is hereby declar- <br />ed to be an urgency measure, <br />necessary for the immediate pre - <br />seivation of t o public p e a c e, <br />health and safety, within the <br />meaning of Section 1, of Article <br />IV of the Coustitutlon, and there- <br />fore shall go into effect imme- <br />diately upon its first publication. <br />The facts constituting the neces- <br />sity are as follows: <br />That during the Easter vacation <br />there are large crowds of high <br />school and college students and <br />other young people who spend <br />their said Easter vacations at <br />Newport Beach; that large crowds <br />congregate at lodging h o u s e s, <br />hotels, rooming houses and other <br />places where lodgers are accom- <br />modated and it becomes impos- <br />sible to properly regulate these <br />vacationists as they are not at <br />the present time required to regis- <br />ter, under any ordinance of the <br />city of Newport Beach; that <br />proper regulation of these vaca- <br />tionists is required in order that <br />the peace and morals of the com- <br />munity may be safe- guarded; that <br />in the ordinary course of events <br />the City Council will not have <br />time to pass an ordinance without <br />an urgency clause attached there- <br />to, before the coming Easter vaca- <br />tion. <br />Section 5. <br />The City Clerk of the City of <br />Newport Beach shall certify to <br />the separate vote on the urgency <br />of this ordinance and its passage <br />by the vote of five members of <br />the City Council of the City of <br />Newport Beach, and cause the <br />same to be published once in <br />NEWPORT B A L B O A NEWS <br />TIMES, a newspaper printed and <br />published in the City of Newport <br />Beach, and upon such publication <br />this ordinance shall become im- <br />mediately operative and take full <br />effect. <br />I hereby certify that the above <br />and foregoing ordinance was in- <br />troduced at a regular meeting of <br />the City Council of the City of <br />Newport Beach held on the 3rd <br />day of February, 1941, and the <br />urgency of the foregoing ordi- <br />nance was passed and the fore- <br />going ordinance was finally adopt- <br />ed by a vote of five members of <br />the City Council of the City of <br />Newport Beach at an adjourned <br />regular meeting thereof held on <br />the 17th day of February, 1941. <br />by the following vote, to -wit: <br />AYES, COUNCILMEN: Reed, <br />Claire, Allen, Brown, Gordon. <br />NOES, COUNCILMEN: None. <br />ABSENT, COUNCILMEN: <br />None. <br />ATTEST: <br />FRANK L.
