ORDINANCE APPROVING THE ANNEATION OF CERTAIN UNINHABITED TERRITORY LYING EASTERLY OF AND CONTIGUOUS TO THE CITY • OF NE'rVPORT BEACH BETWEEN THE COAST HIGHWAY AND NEWPORT BAY. The City Council of Newport Beach, California, does ordain as follows: Section 1. That the annexation to the City of Newport Beach, California, of that certain uninhabited territory contig- uous to the said City and hereinafter particularly described, be and the same is hereby approved, and the same is hereby ordained to be annexed and made a part of the City of Newport Beach, Calif- ornia, subject to the terms and conditions hereinafter set forth in Section 2. That said territory is particularly described as follows: That certain territory lying Easterly of and contiguous to the boundaries of the City of • Newport Beach, and Southerly of and contiguous to U. S. Higuway 101 Alternate, and Northerly of Newport Fay, and consisting of the areas shown on map of Tract No. 1102 recordec, in Book 35, at page 36, Miscellaneous Maps, Records of Orange County, California, and on map of Tract No. 1140, recorded in Book 36, at page 38, Miscellaneous *leaps, Records of Orange County, California. Section 2. That the boundaries of the City of Newport Beach, California, be, and the same are hereby altered to include the above described territory, which said territory is hereby* ordained to be annexed to and incorporated in the said City of Newport Beach, California, subject to the following terms and conditions, to -wit: 1. That the streets within said territory shown on the maps hereinabove referred to shall not be dedicated to public use by reason of the annexation of said territory herein approved and • ordained. -1- r i 2. That the owner of land within said territory shall have the right at any time and from time to time hereafter to connect its water distributing system now laid and to be laid in • said territory with the water main of the said City along the Coast Highway, and thereafter the said City shall supply water to said territory. 3. That within a reasonable time hereafter the said City shall install the necessary sewer connections with the sewer lines now and to be constructed within said territory, and thereafter the said City shall dispose of said sewage through its sewer system. 4. That no property within said territory shall ever be taxed to pay any portion of any bonded or other indebtedness or liability of said City heretofore contracted or now existing. Section 3. That the proceedings and annexation herein ordained are had and taken under and pursuant to the provisions of an Act of the Legislature of the State of California, desig- nated and referred to as the "Annexation of Uninhabited Territory • Act of 1939 ". Section 4, The City Clerk shall cause this Ordinance to be published within fifteen (15) days after its passage, at least once in the Newport-Balboa-New-a a rmes, a newspaper of general circulation published and circulated in the City of Newport Beach, and shall transmit to the Secretary of State of California a certified copy of this Ordinance giving; the date of its passage as provide3 by the Act aforesaid. The foregoing Ordinance was introduced at a regular meet- ing of the Council of the City of Aiewport Beach held on October 7, 1946, and was finally adopted at a regular meeting of said Council held on the 21st day of October, 1946. _ 0-_ •Mayor of the City of Ne port Beach I -';ST: v,.
