HomeMy WebLinkAbout562 - Beach CurfewORDINANCE NO. 562 T}ie City of Newport,Beach, by and through its City Council, dd @5" ordain as follows: SECTION 1: -No person or per- sons shall be allowed or permitted' on the public beaches in the City of Newport Beach Between the hours of mid-night 'and six o'clock A. M. of the following day. SECTION 2:_This Ordinance is urgently required for the immed- iate preservation of public health, peace and safety. The following is a �perific statement showing the urgency of this Ordinance: That there are many public beach- es in the City of Newport Beach in residential areas; t h at large crowds of pleasure seekers u s e these beaches until late and un- usual hours in the morning and thus annoy and create a nuisance as to the residences in the immed- iate vicinity of said beaches. That on many of said beaches there are not sanitary facilities and it is im- possible to properly police said beaches at late and unusual hours of the night, and said beaches thereby become very unsanitary and dangerous to the health and safety of the many thousands who use such beaches in the summer- time. That this Ordinance is urg- ently required in order that the situation herein complained of may be remedied at as early a time as possible, as the public health, peace and safety are in. volved. This Ordinance is now irn- mediately required. SECTION 3: The City Clerk shall certify to the separate vote on the urgency of this Ordinance and its passage and adoption by a vote of five members of the City Council of the City of New- port Beach, and its approval by the Mayor of the City of Newport Beach, and cause the same to be published once in the NEWPORT BALBOA NEWS - TIMES, a news- paper of general circulation print- ed, published and circulated in the City of Newport Beach, and upon such publication this Ordinance shall become immediately opera - tivo and take full effect. SECTION 4: Any violation of this Ordinance shall constitute a misdemeanor and shall be punish- able by a f i n e not to exceed $200.00, or by imprisonment in the City or County Jail for a per- iod of thirty days. or by both such fine and imprisonment. The above and foregoing Ordi- nance No. 562 was passed at a regular meeting of the City Coun- cil of the City of Newport Beach held on the 28th day of July, 1947, by the following vote, AXES, Councilmen: Allen, Sil er, Isbell, Robertson, Reed.
