PARK GROUNDS AND THE USE OF TRAILER CARS, TRAILER H O U S E S OR AUTOMOBILE TRAILERS USED FOR LIV- ING PURPOSES IN THE CITY OF NEWPORT BEACH, PRO. V I D I N G A PENALTY FOR THE VIOLATION HEREOF The City Council of the City of Newport Beach, does ordain as follows: SECTION 1: Definitions. Whenever used in this o r d i. nance, unless a different meaning appears from the context: (A) AUTOMOBILE TRAILER, An "Automobile Trailer," "Trailer Coach," or "Trailer" means any vehicle or structure so designed and constructed in such manner as will permit occupancy thereof as living or sleeping quarters for one or more persons, and so designed that it is or may be mounted on wheels and may be used as a conveyance on highways or city streets, propelled or drawn by its own or other motive power, excepting a device u s e d exclu- sively u p o n stationary rails or tracks under the jurisdiction and control of the Railroad Commis- sion of the State of California. (B) TRAILER PARK, A "Trailer Park" means any park, trailer park, trailer court, court, camp, site, lot, parcel, or tract of land designed, maintained or intended for the purpose of sup- plying a location or accommoda- tions for any automobile trailer and upon which any automobile trailer or automobile trailers are parked and shall include all buildings used or intended for use as a part of the equipment thereof, whether a charge is made for the use of the trailer park and its facilities or not. "Trailer Park" shall n o t include automobile or trailer sales lots on which unoc- c u p i e d automobile trailers are parked for the purpose of inspec- tion and sale. (C) UNIT. A unit means an area of ground in a trailer park of not less than eight hundred seventy five (875) square feet of unoccupied space in such trailer park and designated as the loca- tion for only one automobile and one trailer. Each unit shall be construed as housing three per- sons, for the purpose of computing the various facilities required in this ordinance. (D) PERSON. The word "per. son" shall be construed to include persons, partnership, firm, com- pany, corporation, tenant, owner, lessee or licensee, their agents, heirs or assigns. (E) DIRECTOR OF PUBLIC HEALTH. For the purpose of this ordinance, the term "Director of Public Health" when applied is to include the Director of P u b l i c Health, Health Officer or Sanitary Officer of the City of Newport Beach, or any regularly appointed inspector or employee of the De- partment of Public Health, or Public Health Commission of the County of Orange, State of California. SECTION 2: Resolution of Property Use and Permit. It shall be unlawful for a n y person, fir in or corporation to establish, maintain, operate, own, control, lease or conduct within the limits of the City of Newport Beach any trailer park on any location or plot of ground for the use of transients or guests by the day, week, month, or season, whether charge is or is not made. without first applying for an d receiving from the City Council a resolution of property use io use the premises for such purpose, a certificate of approval from the Building Department, and a b- cense from the City Clerk to operate such premises. SECTION 3: Resolution of Property use from Building De- partment In order to obtain a Resolution of Property Use from the Building Department the applicant shall file a written petition with the City Planning Commission, in which he shall state the number of automobile trailer spaces to be provided for and such other facts relied upon, including a plan of proposed development. The Planning Commission shall report to the City Council accord- ing to the procedure prescribed in the Zoning Ordinance of said city, relating to variances and conditional permits. A copy of the resolution of the final action shall be forwarded to the Building Department. SECTION 4: Regulations of Building Department Every applicant for a license to conduct a trailer park shall, after having first obtained a Resolution of Property Use as provided in S e c t i o n 2 of this ordinance, file with the Building Department a written application, in triplicate upon air official form approved by the Building Depart. m e n t. for a certificate of ap- proval. Said application shall include the name, address, des- cription, of t h e property, t h e character of the establishment conducted or proposed to be con- ducted, a plot plan and plans and specifications for t h e buildings t h e r e o n, or to be constricted thereon, and any other informa- tion that the Building Department by regulation shall require. Said plot plan must be an ac. curately drawn map of the pro- posed park, drawn to a set scale and including a legal description of the trailer park. SECTION 5: Inspection and Investigation Upon receipt of the plot plan and the plans and specifications and information required under Section 4 of this ordinance, it shall be the duty of the Building De- partment to examine such plot plan and plans and specifications and to inspect and investigate the establishment or proposed estab- lishment for which a certificate of approval is applied for, and to furnish copies of the same to the Fire Department. SECTION 6: Examination by Fire Department It shall be the duty of the Fire Department to check the plans and specifications a n d endorse thereon their approval or disap- proval. S E C T 10 N 7: Certificate of Approval If it shall appear to the satis- faction of the Building Depart- ment that the facts as stated in the application are true and correct; that the plot plan and plans and specifications for the trailer park established or to be established comply with the pro- visions of this ordinance, with all other applicable ordinances, rules and regulations of the City of Newport Beach, enforceable by the Fire Department, the Building Department, the Department of Public Health and with the pro- visions of the Health and Safety Code of the State of California, and that the same have received the written approval of said Fire Department, the Building Depart- ment shall issue fo the applicant a certificate of approval. SECTION 8 The applicant for a license to operate a trailer park shall, after receiving the certificate of ap- proval required by Section 7 of this ordinance, present the same to the City Clerk, together witn the prescribed license fee, there- upon the City Clerk shall issut, a license to operate such trailer park. SECTION 9: Unit Requirements The minimum size of the unit or site reserved for the accom- modation of any automobile and tra]er shall be as s e t forth in Section 1, (C) hereof, and cacti unit shall have a minimum front- age of twenty -five (25) feet on the roadway, and shall be clearly defined by proper markers at cacti corner. The site shall be reasonably level, free from rocks and weeds. and well drained. Each unit shall abut or face a driveway or clear unoccupied space of not less than twenty (20) feet in width. There shall be space of at least six (13: feet between automobile trailers or between an automobile trailer and any building or other strue- ture, and they shall not be placed less than ten (10) feet from the property line of the adjoining property. SECTION 10: Caretaker and Supervisor All trailer parks shall be pro- vided at all times with a resident caretaker, whose duty shall be to enforce all sanitary rules and regulations and see that no part of the ordinance is violated. Fly -tight metal de- positories with tight fitting covers for such materials shall be placed in a conspicuous location. Each and every unit shall be within a distance of not over one hundred and fifty (150) feet from such depository. Said depositories shall not be permitted to become foul - smelling, unsightly, or breeding places for flies. SECTION 11: Rules and Regu- lations It shall be the duty of the owner, his agent or manager: (a) To keep a register of all p e r s o n s accommodated on the t r a i l e r park, said register to include the names of all persons, their home address, dates of ar- rival and departure, the license numbers, including name of state issuing same, and t h e year of issuance, of all trailers and towing or other automobiles, and their make, model and year classifica- tion and to prescribe rules and regulations for the management of the trailer park, and to have such records available for inspec- tion by the City Planning Depart- ment, Department of Public Health, or the Police or Sheriff's Department. Further, it shall be the duty of the owner, his agent, or manager to provide for t h e collection and disposal of garbage an d other waste materials. It shall be unlawful to burn or to bury, or to use an incinerator, or to dispose of any garbage or refuse in any manner contrary to the ordinances of the City of Newport Beach, regulating t h e collection and disposal of garbage and other waste material. All open fires are prohibited. If it should appear to the Director of Public Health that t h e r e is a violation of this section, a written notice shall be served to discon- tinue such practice in five ( 5 ) days. Failure to comply with this order shall be deemed sufficient grounds for suspension of t h e permit and an order shall be -is- sued to all guests to v a c a t e immediately. (b) To require that dogs, cats, or other pet animals shall be kept on leash or confined in an en- closure. (c) To provide for the regular cleaning, painting, repairing and disinfecting of all buildings. (d) To have placed all toilets, basins, showers and washrooms in properly constructed buildings located not more than two hun- dred feet (200) from each trailer unit. Such buildings shall be well lighted at all times, day or night, have well ventilated screened openings, and be constructed of such moisture -proof material as shall permit rapid and satisfactory cleaning, scouring and washing. The floors of such buildings shall be of concrete, t i l e or similar material, elevated not less than six (6) inches above grade and each room other than a private or individual toilet, shall be pro- vided with a floor drain connected to the sewerage system. (e) To cause to be disinfected daily by a material approved by the Director of Public Health all floors in showers and toilet rooms. Wooden or cloth mats, grids, boards, are prohibited. (f) To p r o v i d e a' sufficient number of approved flush type cast iron enameled slop s i n k s furnished with hot and cold water each connected with the sewerage system and to be used for the dis- posal of domestic waste waters only. (g) To provide for each unit a sink connection to the waste outlet of the trailer, such connec- tion to conform to the plumbing ordinance. No bathtub or other washing facilities shall be per. mitted to be used in any trailer unless the same are connected with the sewerage system of the city. No structure of a permanent nature s h a l l be allowed to be added on to a trailer. No wood, paper, can b o x or equipment shall be permitted to be placed or stored under a n y trailer. Such space shall be open and unobstructed at all times. SECTION 12: Water Supply A water supply shall be pro- vided in ample quality to meet all requirements, and be furnished through an approved pipe distri- b u t i o n system leading directly from the city water mains. Two water supply faucets shall be located at each trailer unit, except that this requirement shall be deemed to be fulfilled if there be three faucets located at and avail- able to two adjacent units. SECTION 13: Sanitation All trailer parks shall be pro- vided with a sewerage system. Water- flushed water closets shall be provided and maintained in clean, sanitary condition. Separate toilets shall be provided for men and women, located in separate compartments, the entrances to which shall be not less than ten (10) feet apart. One water closet for men shall be provided for each t e n (10) units and one (1) water.closet for women shall be provided for each such ten (10) units. Approved urinals or approved equivalent may be substituted for the required water closets f n r men, not exceeding 25%, of said requirement, o n e s h e l l or lip urinal, or twenty -four (24) inches of urinal trough to be computed as one water closet. The location of all toilets and showers shall be plainly indicated by signs. One shower for men shall be provided for each five (5) units, and one shower for women shall be provided for each five (5) uni'F. SECTION 14: Removal of Wheels or Tires It shall be unlawful to remove wheels or tires from automobile trailers except temporarily for the purpose of making repairs. rt shall be unlawful to jack a trailer to a height which keeps the tires from touching the ground. SECTION 15: Quarantine Whenever it shall appear to the Director of Public Health t h a t there are reasonable grounds to believe that contagious or infec- tious disease exists, or has re- cently existed within the premises of the trailer park grounds for which a permit has been issued, he shall take such measures as may be necessary to prevent the spread of the disease; and if it shall appear that an epidemic ex- ists, the Director of Public Health shall immediately suspend the permit until such cases have been removed to an area designated as an area of quarantine and no person shall be permitted to enter or leave said park and ground without the written consent of the Director of Public Health. Said premises so quarantined shall not be released therefrom until ap proved methods of sterilization and disinfection have been carried out under the supervision of the Director of Public Health. SECTION 16: Fire Prevention (a) There shall be maintained at all times in usable condition and in readily accessible locations; in every trailer park one twenty - pound container filled with an approved dry powder fire extin- guisher, in the ratio of one such container to every ten (10) units. (b) If the boundaries of any trailer park are more distant than five hundred (500) feet from the nearest city fire hydrant, there shall be maintained in every such trailer park, a sufficient number of two (2) inch wet riser stand pipes with one and one -half (hiz) inch hose butts and valves suf- ficient to reach every part of such park. (c) It shall he unlawful to fill any liquefied petroleum gas con- tainer in any trailer park within the city limits of Newport Beach or within a distance of two him - dred (200) feet of any such park. Every connection heretofore o. hereafter installed between a liquefied petroleum gas container and its appliances shall be of copper or iron pipe, or metal tubing. No liquefied petroleum gas con - taincr, or pressure regulator, shall be permitted inside any automo- bile trailer, or portion thereof. No liquefied petroleum gas con- tainer or pressure regulator, shall be located inside or underneath any automobile trailer, or within five (5) feet of any exterior door, on any automobile trailer. All liquefied petroleum gas con- tainers shall be so fastened to suitable mountings as to prevent any movement or tipping or dam- age to service piping. SECTION 17: Purpose It shall be the purpose of this ordinance to regulate the use of parking of automobile trailers in trailer parks or any other unit or plot of ground, whether operated as a public or private camp ground or upon the area of an established service station en- gaged in the business of selling gasoline or other automobile ae- cessorics or automobile equipment to the public. It shall be unlawful for a n y person to camp, place, stand, park or locate any occupied automobile trailer in the City of Newport Beach, except within a licensed trailer park. SECTION 18: Violations an d Penalties Any owner, builder, mechanic or any other persons who shall violate any of the provisions of this ordinance, or fail to comply with any order or regulation made thereunder, or shall operate or maintain a trailer park, or build, construct or make alterations in violation of any part of this ordi- nance, shall be deemed guilty of a misdemeaner, and upon convic- tion thereof shall be punishable by a fine of not more than three hundred dollars ($300.00) or by imprisonment in jail for not more than six (6) months, or by both such fine and imprisonment. A. Nothing in this ordinance shall be deemed to conflict in such a way as to mitigate the State Housing Laws or any of the re- quirements and ordinances of the Department of Public Health, or the requirements of the building ordinances of the City of Newport Beach, California. B. If any section, sub- section, sentence, clause or phrase of this ordinance be, for any reason, held invalid or unconstitutional, such decision shall not affect the validity of the remaining portions of the ordinance. SECTION 19: Effective Date This ordinance shall take effect and be in force on the 30th day from and after its passage. The foregoing ordinance was introduced at a regular meeting of the City Council of the City of Newport Beach held on the 14th day of March, 1949, was amended on the 23rd day of May, 1949, and was finally passed and adopted on the 13th day of June, 1949, at a regular meeting of the City Council by the following vote, to wit: AYES, COUNCILMEN Greeley, Robertson, Blue, Drake.
