ORDINANCE NO. 599 <br />ORDINANCE ADDING SEC- <br />TIONS 7114x, 7114b AND 7114c <br />AMENDING SECTIONS 7220 <br />AND 7219 OF THE MUNICI- <br />PAL CODE AND CREATING <br />A CHARGE FOR USE OF <br />SEWERS AND PROVIDING <br />FOR THE TURNING OFF OF <br />WATER SERVICE IN DE- <br />FAULT OF PAYMENT <br />THEREOF. <br />SECTION 1: Section 7114a, Sec- <br />tion 7114b and Section 7114c are <br />hereby added to the Municipal <br />Code of the City of Newport <br />Beach as follows, to -wit: <br />"Section 7114a: A monthly <br />charge of $0.40 shall be made <br />for the use of each sewer <br />connection, said charge to be <br />made against the occupant of <br />each dwelling house and of <br />each business structure." <br />"Section 7114b: Said charge <br />for said use of said sewer <br />connection shall be payable <br />and be billed, as provided for <br />in Sections 7218 and 7219 of <br />the Code, to water consumers <br />in like manner as charges for <br />the use of water. Said charge <br />for said sewer connection use <br />by occupants of dwelling <br />houses or business structures <br />who are not consumers of <br />water, subject to charge by <br />the City of Newport Beach, <br />shall be billed bi- monthly." <br />"Section 7114c: Nothing <br />herein contained shall be con- <br />strued to impose a sewer use <br />charge where, in fact, sewer <br />connection facilities are not <br />actually in use; and satisfac- <br />tory proof of such non -use <br />shall exonerate the charge <br />imposed by the preceding <br />Sections 7114a and 7114b." <br />SECTION 2: Sections 7219 and <br />7220 of the Municipal Code are <br />hereby amended to read as fol- <br />lows, to -wit: <br />"Section 7219: Unpaid <br />Charges. The superintendent <br />of the municipal water system <br />shall, on or before the first <br />day of the month next suc- <br />ceeding the bi- monthly billing <br />period, mail to each con- <br />sumer whose premises are <br />connected with the municipal <br />water system, a true and ac- <br />curate statement of the un- <br />paid charges due the City of <br />Newport Beach for water fur- <br />nished to such premises and <br />for the charges for the use <br />of the sewer connection as <br />provided for in Section 7114a. <br />of this Code, setting forth that <br />unless said charges are paid <br />on or before the 10th day of <br />said month, the same shall <br />thereupon become delinquent <br />and that unless such delinqu- <br />ency charges are paid prior to <br />the 25th day of said month, <br />the water will be turned off <br />from said premises without <br />further notice and will not be <br />turned on again until said <br />charge, together with a turn - <br />on charges, as specified in <br />Section 7217, have been paid." <br />"Section 7220: Turn - off <br />Date. At the close of busi- <br />ness on the 25th day of each <br />month, the person in charge <br />of the books of the municipal <br />water system, shall furnish to <br />the superintendent of the <br />water system a list setting <br />forth the premises, the name <br />of the owner and tenant upon <br />which the charges, referred to <br />in Section 7219, remain un- <br />paid, together with t he <br />amount thereof and it is here- <br />by made the imperative duty <br />of said superintendent on the <br />next business day to turn the <br />water off from said premises <br />and not to turn the same on <br />again until all of said charges <br />and the turn -on charge, as <br />specified in Section 7217, shall <br />have been paid." <br />SECTION 3. This ordinance <br />shall be published at least once <br />in the Newport - Balboa Press, a <br />newspaper of general circulation <br />printed and published in the City <br />of Newport Beach and shall be in <br />force and effect thirty (30) days <br />after the final passage thereof. <br />The above and foregoing ordi- <br />nance was introduced at a regu- <br />lar meeting of the City Council of <br />the City of Newport Beach held <br />on the 13th day of June, 1949, <br />and was finally passed and adopt- <br />ed on the 27th day of June, 1949, <br />by the following vote, to -wit: <br />AYES, Councilmen: Greeley, <br />Robertson, Isbell, Drake. <br />NOES, Councilmen: None. <br />ABSENT, Councilmen: Blue. <br />DICK DRAKE, <br />Mayor. <br />Attest: <br />C.
