ORDINANCE AMENDING SEC-
TION 9109d OF THE MUNICI-
PAL CODE AND ADDING A
NEW SECTION NUMBERED
9113d TO THE MUNICIPAL
CODE AND PROVIDING FOR
THE ISSUANCE OF A USE
PERMIT FOR T H E C O N-
STRUCTION OF BUH.DINGS
IN C -1 ZONE IN EXCESS OF
THE PRESCRIBED LIMITS,
The City Council of the City of
Newport Beach does hereby or-
dain as follows:
SECTION 1: Section 9108d of
the Municipal Code is hereby
amended to read as follows, to
wit:
"Two stories and not to ex-
ceed thirty -five (35) .feet, ex-
cept as provided in Sections
9111, 9112 and 9113d.
SECTION 2: There is hereby
added to the Municipal Code, Sec -
tion 9113d, reading as follows:
"Section 9113d. The City
Council, after receipt of a
report and the recommenda-
tion of the Planning Commis-
sion in each case shall have
the power to permit the erec-
tion of buildings in Zone C -1
in excess of two stories and
in excess of thirty -five feet
in height, upon application,
.
hearing and findings, in like
manner as provided in the
foregoing Sections 9113,
9113a, 9113b and upon pay-
ment of the charges as pre-
scribed in Section 9113c."
SECTION 3: This ordinance
shall be published at least once in
the Newport-Balboa Press, a
newspaper of general circulation
printed and published in the City
of Newport Beach and shall be in
force and effect thirty days after
the final passage thereof.
The foregoing ordinance was in-
troduced at a regular meeting of
the City Council of the City of
Newport Beach held on the 9th
day of January, 1950, and pur-
suant to the provisions of Sec-
tion 9121b a public hearing there- .
on was set for the 23rd day of
January, 1950, being a regular
meeting of the City Council of the
-City of Newport Beach, and said
hearing was duly held thereon
and thereafter and on said 23rd
day of January, 1950 said ordi-
nance was duly adopted by the
following vote, to -wit:
AYES, COUNCILMEN Greeley,
Robertson, Isbell, Blue,
Drake.
NOES, COUNCILMEN None
ABSENT, COUNCILMEN None.
