WHEREAS. there has been presented to the City Council of the City of New- port Beach a final report fro;a the Plan- ning Commission of the City of Newport Beach. said report consisting of a pro- posed new zoning ordinance for adoption by this City Council. said final report having hitherto been filed with the City Clerk of the City of Newport Beach: and. WHEREAS, said Planning Commis- sion of the City of Newport Beach has held all public hearings as required by law and this City Council has hitherto held public hearing as required by law: and. WHEREAS, the adoption of said new zoning ordinance is deemed and hereby found to be for the best interests of the citizens of the City of Newport Beach in that the adoption of said ordinance will promote the growth of the City of Newport Beach -in an orderly manner. and will promote and protect the public health. safety. peace. comfort and gen- eral welfare. and will protect the character and social and economic sta- bility of all districts within the City of Newport Beach. and will assure the or- derly and beneficial development of such areas: NOW. "C11_AFTER 1. PURPOSE Section 9101.0 The purpose of this Article _1X, is to promote the growth of the City of NeveDort Beach- in an or- derly manner and to promae and pro- tect the public health. safety. peace. comfort and general welfare and to protect the character and social and economic stability of all districts within the City and to assure the orderly and beneficial development of such areas. Section 9101.1 The Zonifig or Dis- tricting Plan effectuated by this article is a part of the Master Plan and con- sists of the establishment of various districts including all the territory with- in the boundaries of the City. within which. the use of land and 'buildings. the space for buildings and the height and built of buildings are regulated. Section 9101.2 No building or struc- ture shall be erected. reconstructed or structurally altered in any manner. nor shall any building or land be used for any purpose, other than as permitted by and in conformance with this Article and all other Ordinances. DISTRICTS Section 9102.0 The several general districts established are as follows: Agricultural- Residential Districts or R -A District Single Family Residential District or P. -1 District Duplex Residential District or R -2 District Restricted Multiple Family Resi- dential District or R -3 District Multiple Residential Distract or R -4 District Light Commercial District or C -1 District General Commercial District or C -2 District Manufacturing District or M -1 Dis trict Unclassified or U District Section 9102.1 In addition to the gen- eral districts established above. the fol- lowing special districts are established which. when combined with the above general districts. establish additional special regulations: Combining or " -B" Districts Combining or " -H" Districts Section 9102.2 The designations, loca- tions and boundaries of the districts established are delineated upon the maps entitled "Districting Map for the City of Newport Beach. California" dated November 27. 1950. which maps and all notations and information thereon are hereby made a part of this Article by reference. Said Districting Map to con- sist of a series of maps numbered 1 to 23 inclusive. consisting of 23 maps. as at- tached hereto. CHAPTER S. REGULATIONS Section 9103.0 Agricultural - Residential or R -A District The following regulations shall apply in all R -A Districts and shall be subject to the provisions of Section 5. Section 9103.01 Uses Permitted: (a) Single Family Dwellings (b) Light farming. except commercial dairies. commercial kennels. com- mercial rabbit. fox, goat or hog farans, or commercial chicken or poultry ranches. (c) Accessory uses normally incidental to a single family dwelling or light farming. This is not to be con- strued as permitting any commerci- al use. (d) One sign. not over six (6) .,square feet in area and unlighted. per- taining only to the sale. lease or rental of the property upon which the sign -[is to be located. Section 9103.02 Building Height Limit: (a) Maximum of thirty -five (35) feet. Section 9103.03 Building Site Area and Lot Width Required: (a) Minimum of six thousand (6,000) square feet and a minimum width of sixty (60) feet. In no case shail there be more than one (1) single family dwelling on any one (1) building site.. Section 9103.04 Percentage of Build- ing Site Coverage Permitted: (a) For aggregate building coverage. maxinmm of forty (40) percent of building site area. Section 9103.05 Y a r d s and o p e n Spaces Required: (a) Front yards; minimum twenty (20) feet except as may be otherwise in- dicated on the districting Maps. Section 9103.11 Uses Permitted: (a) Single Family dwellings. (b) One accessory building only if con - structcd simultaneous'.y with or sub- sequent to the main building on the same lot. (c) Accessory uses normally incidental to single family dwellings. This is not to be construed as permitting' commercial uses. (d) One sign. not over six (6) square feet in area. and pertaining only to the sale, lease or rental of the prop- erty upon which tn@ sign is to be located. Scction 91.03.12 Building Height Limit: (a) For dwellings - maximum t w o stories but not exceeding thirty -five (35) feet. (b) For accessory buildings -- maximum fifteen (15) feet. Section 9103.13 Building Site Area and Lot Width Required: (a) For each dwelling - minimum of four thousand (4.000) square feet and minimum width of forty (40) feet on interior lots; minimum of five thousand (5,000) square feet and minimum width of fifty (50) feet on corner lots. In no case shall there be more than one (1) single family dwelling on any one (1) building site. (see Section 9105.3 for exceptions). Section 9103.14 Building Site Cover- age Permitted: (a) Full coverage, less required front. side and rear yards. (Except in combining or " -B" Districts. See Section 9104.1). Section 9103.15 Yards Required: (a) Front yards: Minimum required twenty (20) feet and maximum per - mitted thirty -five (35) feet. except as may be otherwise indicated on the Districting Maps. Distances shown on Districting Maps are to be measured from front lot line. (b) Side yards: Each side yard shall not be less than three (3) feet wide on building sites forty (40) feet wide or less. or four (4) feet on lots wider than forty (40) feet. provided that the side yard on the rear twenty (20) feet of the street side of a corner lot. where there is re- versed frontage. shall not be less than the front yard required or existing oil the adjacent reversed frontage. (c) Rear yards: Minimum requirement of ten (10) feet, (Where alleys exist. see Section 9105.4 (d). Section 9103.2 Duplex Residential or R-2 District The following regulations shall apply in all R -2 Districts and shall be sub- ject to the provisions of Chapter 5. Section 91.03.21 Uses Permitted: (a) Single family dwellings. (b) Two detached single family dwell- ings or one duplex. Section 9103.22 Building Height Limit: (a) For dwellings - maxiamm two stories but not exceeding thirty -five (35) feet. (b) For Accessory buildings. Maximum fifteen (15) feet. Section 9103.;,13 Building Site Area and Lot Width Required: (a) For each two (2) dwellings or one duplex - minimu n of four thous- and (4.000) square feet and mim- mum width of forty (40) feet on interior lots: minimum of five thousand (5,000) square feet and minimum width of fifty (50) feet on corner lots. In no case shall there be more than two (2) single family dwellings or one duplex on any one (1) building site. (See Section 9105.3 for exceptions). Section 910324 Building Site Cover- age Permitted: (a) For aggregate building coverage - full coverage. less required front, side. and rear yards. (Except in Combining or " -B" districts. see Section 9103.25 Yards Required: Section 9104.1), (a) Front yards: Minimum required twenty (20) feet, and maximum Permitted thirty -five (35) feet. ex- cept as may be Otherwise indicated on the Districting Maps. (b) Side yards: Each side yard shall not be less than three (3) feet wide on building sites forty (40) feet wide or less, or four (4) feet on lots wider than forty (40) feet, provided that the side yard on the rear twenty (20) feet of the street side of a corner lot, where there is re- versed frontage, shall not be less than the front yard required or iftxisting on the adjacent reversed frontage. (c) Rear yards: Miinimum requirement of ten (10) feet. (Where alleys exist, see Section 9105.4 (d) ). (d) Between detached buildings; Min: mum ten (10) feet. Section 9103.3 Restricted Multiple Fam- ily Residential or R -3 District The following regulations shall apply in all R -3 Districts and shall be subject to thy, provisions of Chapter 5. Section 9103.31 Uses Permitted: (a) Single Family Dwellings. (b) Plot more than three detached single family dwellings, one triplex, or one duplex. ('c) Signs not over twelve (12) square feet in area and attached to the main building. Section 9103.32 Uses permitted, sub- ject to first securing a Use Permit in each case: (a) Multiple dwellings in excess of three (3) single family units. apart- ment, houses, dweMng groups, and rooming or boarding houses and motels. (b) Community centers, social halls, lodges, clubs and rest homes, sub - 'ject to first securing a Use Permit in each case. (c) Signs larger than twelve (12) square feet and appurtenant to any use.. Section 9109:33 Accessory Uses Per- mitted: (a) Accessory uses and buildings nor- mally incidental to any of the above. This shall not be construed as permitting any commercial use For .occupation other than those specifically listed. Section 9103.34 Building Height Limit: (a) For main buildings - maximum thirty -five (35) feet. (b) For accessory buildings - maxi- mum fifteen (15) feet. Section 9013.35 Building Site Area Required: (a) For each building or group of buildings - minimum of f o u r thousand (4,000) square feet and minimum width of forty (40) feet on interior lots; minimum of five thousand (5,000) square feet and minimum width of fifty (50) feet on corner lots. (b) For each family unit in any build- ing or group of buildings minimum of one thousand (1,000) square feet. Section 9103.36 Building Site Cover- age Permitted: (a) For aggregate building coverage, full coverage, less required front, side and rear yards, (Except in combining or " -B" districts, see Section 9104.1). Section 9103.37 Yards Required: (a) Front yards: Minimum required twenty (20) feet, and maximum permitted thirty -five (35) feet, ex- cept as may be otherwise indicated on the Districting Maps. Distances shown on Districting Maps are to be measured from front let lines. (b) Side yards: Each side yard shall not be less than three (3) feet wide on building sites forty (40) feet wide or less, or four (4) feet on lots wider than forty (40) feet, pro - cided.that the side yard on the rear 0twenty (20) feet of the street side of a corner lot, where there is re- versed frontage, shall not be less than the front yard required o existing on the adjacent reversed frontage. Section 9103.4 Maitiple Residential or R -4 District The following regulations shall apply in all R -4 Districts and shall be subject to the provisions of Chapter 5. Section 9103.41 Uses Permitted: (a) Single Family Dwellings, and Du- plexes or triplexes. (b) Multiple dwellings, apartment houses and dwelling groups. (c) Signs not over twelve (12) square feet in area and attached to the main building. Section 9103.42 Uses permitted, sub- ject to first securing a Use Permit in each case: (a) Hotels, motels and rooming or boarding houses, trailer camps. (b) Professional offices. (c) Community centers, social haPs, lodges and clubs. (d) Signs larger than twelve (12) square feet and appurtenant to any use. Section 9103.43 Accessory Uses Per- mitted: (a) Accessory uses and buildings nor- mally incidental to any of the above. This shall not be construed as per- mitting any commercial use or ce- cupation other than those specific- ally listed. Section 9103.44 Building Height Limit: (a) For main buildings - thirty -five (35) feet provided that the height limit may be increased to a maxi - mum of seventy -five (75) feet upon the obtaining of a Use Permit In each case. (b) For accessory buildings - maxi- mum fifteen (15) feet. Section 9103.45 Building Site Area Rc quired: (a) Same as specified for R -3 Districts. Section 9109.46 Building Site Cover - erage Permitted: (a) Same as specified for R -3 Districts. Section 9103.¢7 Yards Required: (a) Front, side, rear ana special yard requirements, same as specified for R -3 Districts. Section 9103.5 Light Commercial or C -1 District The following regulations shall apply in all C -1 Districts and shall be subject to the provisions of Chapter 5. Section 9103.51 Uses Permitted: (a) Single family dwellings, duplexes, multiple dwellings, apartment houses, dwelling groups, hotels, motels, boarding houses, profession- al offices, community centers, soci- al halls, lodges and clubs. (b) Retail stores and personal service establishments within a building, including appliance stores, bakeries (not wholesale), banks, barber shops, beauty parlors, book stores, department stores, drug stores, food shops, hardware stores, nurseries, offices, radio stores, gasoline ser- vice stations, restaurants, antique shops, shoe shops, studios, tailor shops, and other uses which in the opinion of the Planning Commis- sion are of a similar nature. (c) Signs appurtenant to any permitted use. Section 9103.52 Uses permitted, sub- ject to first securing a Use Permit in each case: (a) Animal hospitals, auto sales and re- pair shops, boat sales, marine ser- vice stations, cleaning establish- ments, laundries, launderettes, mor- tuaries, outdoor markets, w h o I e- sale stores, outdoor sales establish- ments, pet shops, public garages, trailer courts, theatres, used car r sales lots and other uses which, in the opinion of the Planning Com- mission are of a similar nature. (b) Handicraft enterprises, including the manufacturing and repair of household furnishings, clothing, ceramics, novelties, and toys, and uses which in the opinion of the Planning Commission are of a sim- ilar nature. (c) Signs, other than those appurten, ant to any permitted use, including billboards. (b) Side yard - None, except where the side of a lot abuts upon the side of a lot in an "R" District, in which case the side yard shall not be less than three (3) feet. (c) Rear yard - None, except where the rear of a lot abuts on an "R" District, in which case the rear yard shall not be less than three (3) feet. (d) Rear yard abutting alleys -mini- mum ten (10) feet. Section 9103.6 General Commercial or C -2 District The following regulations shall apply in all C -2 Districts and shall be subject to the provisions of Chapter 5. Section. 9103.61 Uses Permitted: (a) Multiple dwellings, apartment houses, dwelling groups, hotels, mo- tels, rooming and boarding homes, professional offices, community centers, social halls and clubs. (b) Wholesale stores and storage with- in a building, wholesale bakeries. (c) The, following uses when conducted within a building or enclosed by a solid board or masonry fence at least six (6) feet in height -in each case: Creameries, bottling works, building material yards, contractors yards, feed'and fuel yards, includ- ing gasoline storage, machine shops, storage of goods and materi- als and other uses which in the opinion of the Planning Commis- sion are of a similar nature. (d) Signs appurtenant to any permitted use. Section 9103.62 Uses permitted, sub- ject to first securing a Use Permit in each case: (a) Lumber yards, light manufacturing, Including manufacture and repair of boats, clothing, novelties and toys,- and uses which, in the opinion of the Planning Commission are of similar nature. (b) Single family dwellings, duplexes, and trailer courts. (c) Signs, other than those appurten- ant to any permitted use. Section 9103.63 Building Height Limit: (a) Maximum height of any building - fifty (50) feet, provided that ad- ditional height may be permitted if a Use Permit is first secured in each case. Section 9105.2 Height Limits: (a) Chimneys, cupolas, flag poles, monuments, radio and other tow- ers, water tanks and similar struc- tures and mechanical appurtenances may be permitted in excess of height limits, subject to first se- curing a Use Permit in each case. (b) No fence, hedge or screen planting of any kind shall hereinafter be con- structed or grown to exceed six (6) feet in height, within any required side yard to the rear of the front line of any dwelling or along any rear property line nor to exceed three (3) feet in height along the Property line to the front of any dwelling or within fifteen (15) feet of the street corner on any corner lot. Section 9105.3 Building Site Area: (a) Any lot or parcel of land under one ownership and of record on August 2, 1943 may be used as a building site even when of less area or width than that required by the regula- tions for the District in which it is located. (c) Not less than one (1) garage space for each two (2) guest rooms in any rooming house. (d) Not less than one (1) parking space for each four (4) guest rooms in any hotel. (e) Parking space required for other uses allowed in any "R" District and not set forth above shall be determined by the Planning Com- mission and set forth as a condi- tion to the granting of the Use Per- mit for such use. Section 9105.6 Architectural Control: (a) In case an application is made for a permit for any building or struc- ture in any "C" or "M" District, said application shall be accom- panied by architectural drawings or sketches and plot plans all to a workable scale, showing the eleva- tion of the proposed building or struc- ture and proposed landscape or other treatment of the grounds around such building or structure and other physical features such as trees, hydrants, poles, etc. Such drawing or sketches shall be con- sidered by the Planning Commission in an endeavor to provide that such buildings or structures and grounds be in keeping with the character of the neighborhood and such as not to be detrimental to the orderly and harmonious development of the r- City m, to impair the desirability X_ of investment or occupation in the lf neighborhood. at (b) The Planning Commission may appoint an Architectural Committee I. of three members, who may be em- ch ployees in the following depart - ot ments of the City of Newport Beach; Building Inspection and City ❑g Engineer. g (c) The Architectural Committee shall nt have authority to approve architec- tural sketches within the meaning as of Section 9105.6 of this Article, e- but all approvals shall be based on d standards of good architectural de- ll sign, such standards which shall e be entitled "Drawings and Illustrat- ❑- ed Architectural Standards for Cer- 11 tain Areas Designated in Article IX of the Municipal. The Architectural Committee, may if it deems it advis- able, refer any application for archi- tectural approval to the Planning Commission for its decision. (e) In case the applicant is not satis- fied with the action of the Plan- ning Commission, he may within f thirty (30) days appeal in writing to the City Council and said Coun- cil shall render its decision within thirty (30) days after the filing of such appeal, (f) No permit shall be issued in any case hereinabove mentioned until such drawings and sketches have been approved by the Planning Commission or by the City Council in the event of appeal from the Planning Commission, and all build - iugs, structures and grounds shall be in accordance with the drawings and sketches. Section 9105.7 Non - Conforming Uses: (a) The lawful use of land existing at the time of the adoption of this Article, although such use does not conform to the regulations herein Specified for the district in which such land is located, may be con- tinued, provided that no such use shall be enlarged or increased, nor be extended to occupy a greater area than that occupied by such use at the time of the adoption of this Article, and that if any such use ceases, the subsequent use of such land shall be in conformity to the regulations specified by this Article, for the district in which such land is located. (b) The lawful use of buildings existing at the time of the adoption of this Article may be continued, although Such use does not conform to the regulations specified for the district in which such buildings are located. (c) The non - conforming use of a por- tion of a building may be extended throughout the building provided that in each case a Use Permit shall first be obtained. (d) The non - conforming use of a build- ing may be changed to a use of the same or more restricted nature provided that in each case a Use Permit shall first be obtained. (e) If the non - conforming use of s. building ceases for a continuous period of six (6) months, it shall be considered abandoned and shall thereafter be usod only in accord- ance with the regulations for the District in which it is located. (f) A non- conforming building damaged or destroyed by fire, explosi :r, earthquake, or other act to an ex- tent of more than ninety (90) per- cent of its appraised value at the time of the damage, as fixed by the General Appraisal Company of Los Angeles, California, or other equally responsible firm, or to an extent of 100 percent of the apprais- (Continued on Next Page) r 1 LJ • 0 value thereof according to the as= sessment by the Assessor for the fiscal year during which such de- struction occures, may be restored only if a Use Permit is first ob- tained in each case. (g) Ordinary maintenance and repair's may be made to any nonconform- ing building providing no structural alterations are made and providing that such work does not exceed fifteen (15) percent of the apprais- ed value thereof according to the as- sessed value in any one (1) year pe- riod. Other repairs or alterations may be permitted provided that a Use Permit shall first be secured in each case. (h) Nothing contained in this Article shall be deemed to require any change in the plans, construction or designated use of any building for which a building permit has properly been issued, in accordance with the provisions of ordinances then effective, and upon which actual construction has'been start- ed prior to the effective date of this Article, provided that in all such cases actual construction shall be diligently carried on until com- plebes of the building. CFIAPTER 6. PLR_,,11'TS VARI- ANCES AND A1kMNDTiIENTS Section 9106.1 Zoning Permits Section 9106.11 Zoning Permits shall be required for all buildings and struc- tures hereinafter erected, constructed, altered, repaired, or moved within or into any district established by this Article, and for the use of vacant land or for a change in the character of the use of land, within any district estab- lished by this Article—Such permit may be a part of the building permit and shall be issued by the Pu7dSng inspec- tor prior to any construction. Section 9106.2 Use Permits Use permits, revocable, conditional or valid for a term period may be issued for any of the uses or purposes for which such permits are required or per- mitted be the. terms of this Article. Section 9106.21 Application: (a)Application for Use Permit shall be made to the Planning Commission In writing on a form prescribed by the Commission and shall be accom- panied by plans and elevations nec- essary to show the detail of the proposed use or building. Such applications shall be accompanied by a fee of five dollars ($5.00). Section 9106.22 Public Bearings: (a) No public hearing need be held thereon, provided that the Planning Ceinrnissior. may hold any hearings, as it deems necessary. (b) In case a public, hearing is deemed necessary, a notice of such !:oaring shall be posted on the property in- volved or adjacent thereto at least ten (10) days prior to such hear- ng. Section 9106.23 Action by Commis- sion: (a) In order to grant any Use Permit the findings of the Planning Com- mission shall be that the establish- ment, maintenance or operation of the use or building applied for will not, under the circumstances of the pa�ticular case, be detrimental to the health, safety, peace, morals, comfort and general welfare of per - sans residing or working" in the neighborhood of such proposed use or be detrimental or injurious t property and improvements in th neighborhood or to the general wel- fare of the City. (b) The Planning Comm` -scion may des- ignate such conditions in connec- tion with the Use Permit, as i deems necessary to secure the pur- poses of this Article and may re- quire such guarantees and evident that such conditions are being o will be complied with. In cast where the Use Permit is refused the Planning Cormission shall state its reasons for such refusal: Use Permits shall not become effec- tive for fifteen (15) days after being granted, and in the event appeal is filed, said permit shall not become effective until a deci- sion is made ay the City Council on such appeal. Section 9106.24 Appeal: (a) In case the applicant or any other person, firm or corporation is not " satisfied with the action of the Planning Commiss` -on, he may with- in fifteen (15) days appeal in writ- ing to the City Council. (b) The City Council shall set date for public hearing and shall post notice as set forth in Section 9106.22 (b). Notice shall also be given to the Planning Commission of such appeal and the Planning Commission shall submit a report to the City Council setting forth the reasons for action taken by the Commission, or shall be represented at the hearing. (c) decision within n sixty (60) days after the filing of such appeal. Section 9106.25 Most: No building or zoning permit shall be issued in any case where a Use Permit is required by the terms of this 0-din- ance unless and until such Use Permit has been granted by the Planning Com- mission or in the event of appeal by the City Council and then only in accord- ance with the terms and condit_ons of the Use Permit granted. Section 9106.3 Variance and Appeals: Where practical difficulties, unneces- sary hardships end results inconsistent (Continued on Next Page) with the general purpose of this Article may result from tae strict application of certain provisions thereof, variance may be granted as provided in Sections 9106.31 to 91106.35 both inclusive. Section 9106.3f Application: (a) Application for variance shall be made by the property owner in writing on a form prescribed by the Planning Ccmmission and shall be accompanied by a fee of ten dollars (u10.00) and statement, plans andl evidence showing:. (1) That there are exceptional or ext-raardinary circumstances applying to the land, building or use referred to in the appli- cation, which circumstances or conditions do not apply gener- ally to land, buildings and /or uses in the same district. (2) That the granting of the appil- cation is necessary for the )reservation and enjoyment or substantial property rights of the petitioner. (3) That the granting of such appli- cation will not, under the cir- cumstances of the particular case, materially affect adverse- ly the health or safety of per- sons residing or wm9cing in the neighborhood of the property of the applicant and will not, un- der the circumstances of the particular case, be materially detrimental to the public wcl- fare or injurious to property or improvements in said neigh- borhood. Section 9106.32 Public Bearing: (a) A public hearing shall be held with- in forty -five (45) Lays after filing of application, notice of which shall be given by one (1) publication in e a newspaper of general circulation o in the City at least seven (7) days e prior to such hearing and by post- ing notices on the property involved, or adjacent thereto, at least seven (7) days prior to such hearing. Section 9106.33 Action by Commis- sion: t (a) After the conclusion of the public hearing, the Planning Commission e shall make a written finding of facts showing whether the qualifi- r cations under Section 9106.31 (a), s apply to the land, building or use for which variance is sought and whether such variance shall be in harmony with the general purposes of this Article. Such written find- g of facts shall be submitted to the City Council within thirty (30) days after the public hearing and may include recommendations for such conditions as the Planning Commission deems necessary to secure the purpose of this Article. Section 9106.34 Action by City Coun- cil: a) The City Council shall consider the application for variance within thirty (30) days after receipt of the Planning Commission ropes'!., and if the City Council finds that the qualifications under Section 9106.31 (a), apply to the land, building or use for which variance is sought and the, such variance is in harmony with the general cur. pose of this Article, said City Coun- cil shall by resolution grant such variance. (b) The City Council may designate such conditions in connection wish the variance as it deems necessary to secure the purposes of this Article, and may require such guarantees and evidence that such conditions are being or will be earn- plied with. Section 9106.35 Appeals: (a) The Planning Commission shall have the power to hear and decide appeals based on the enforcement or interpretation of the provisions of this Ordinance. (b) In case an applicant is not satisfied with the action of the Planning Commission on his appeal he may within fifteen (15) days appeal in writing to the City Council. (c) Notice shall be given to the Plan- ning Commission of such appeal and a report shall be submitted by the Planning Commission to the City Council setting forth the reasons for action taken by the Commission or shall be presented at the Coun- cil rr-ceting. (d) The City Council shall render its decision within thirty (30) days after the filing of such appeal. Section 9106.4 Revocation of Permits or Variances: Sector 9106.41 Any zoning pormit use permit, or variance granted in no- oordance with the terms of this Article Shall bo revoked if not used within six mouths from dots of approval. Section 9106.42 Any zoning permit, use nermit, or variance granted in so- cortlarce with the terms of this Article may be revoked if any of the conditions or tetlus of such permit or variance are violated, or if pay law or ordinance is violated in connection therewith. Sect °or 91,06.43 The Planning Com- mission shall hold a hearing on any proposed revocation after giving writ- ten notice to the permittee at least ten (10) days prior to the hearing and shall submit its recommendations to the City Council. The City Council shall act thereon within sixty (60) days after receipt of the recommendations of the Planning Commission. (Continued on Next Page) Section 9106.5 Amendments: This article may be amended by changing the boundaries of districts or by changing any other provision thereof whenever the public necessity and con - venicnce and the general welfare require such amendment by following the pro- cedure of Sections 9106.51 to 9106.54, inclusive. Section 9106.51 Initiation: (a) An amendment may be initiated by: (1) The verified petition of one or more owners of property af- fected by the proposed amend- ment, which petition shall be filed with the Planning Commis- sion and shall be accompanied by a fee of twenty -five dol- • cars, ($25.00), no pare of which Shall be returnable to the peti- tioner, or by (2j Resolution of intention of the City Council, or by (3) Resolution of intention by the Planning Commission. .Section 9106.52 Public Hearings: W The Planning Commission shall hold two (2) public hearings on any pro- posed amendment at least ten (10) days apart, and shall give notice thereof by at least one publication in a newspaper of general circula- tion within the City at least ten (10) days prior to the first of such hearings. (b) In case the proposed amendment consists of a change of the bound- aries of any district so as to re- classify property from any district to any other district, the Planning Commission shall give additional notice of the time and place of such hearings and of the purpose there- of by posting at least three public notices thereof not less than ten (10) days prior to the date of the first of such hearings along streets upon which the property proposed to be reclassified abuts. Each such notice shall consist of the words "Notice of Proposed Zoning Change" in Idlers not less than one (1)' inch in height, and in addition thereto, a statement in small let - ters setting forth a general descrip- tion of the property involved in the proposed change of district, the time and place at which the public hearings on the proposed change will be held and any other informa- tion which the Planning Commis- sion may deem to be necessary. Any failure to post public notices as aforesaid shall not invalidate any proceedings for amendment of this Article. Section 9106.53 Action by Planning Commission: fa) Following the aforesaid hearings the Planning Commission shall make a report of its findings and recommendations with respect to the proposed amendment and shall file with the City Council an attest- ed copy of such report within ninety (90) days after the notice of the first of said hearings; pro- vided that such time limit may be extended upon the mutual agree- ment of the parties having an in- terest in the proceedings. Failure of the Planning Commission so to report within ninety (90) days without the aforesaid agreement shall be deemed to be approval of the proposed amendment by the Planning Commission. Section 9106.54 Action by City Coun- cil: (a) Upon receipt of such report from the Planning Commission or upon the expiration of such ninety (90) days as aforesaid, the City Council Shall set the matter for public hearing after notice thereof of the proposed amendment, be given as provided by law. After the conclu- sion of such hearing, the City Coun- cil may adopt the amendment or any part thereof set forth in the petition in such form as said Coun- cil may deem to be advisable. The Council may refer the recommen- datior, of the Planning Commission back to that body for further study and recommendation. (b) The decision of the City Council shall be rendered within sixty (60) days after the receipt of a report and recommendation from the Plan- ning Commission or after the expir- ation of ninety (90) days as stated in paragraph (a) of Section 9106.54. CHAPTER 7. DEFINITIONS Section 9107.1 For the purpose of this Ordinance, certain terms used here- in are defined as follows: Section 9107.11 "ALLEY" Any public thoroughfare which affords only a secondary means of access toabutt- ing property. Scction 9107.12 " A U T O M O B I L.E COURT (MOTELS)" A group of 2 or more detached or semi - detached buildings containing guest rooms or apartments with automobile storage space serving such rooms or apartments provided in connec- tion therewith which group is de- signed and used primarily for the accommodation of transient auto- mobile travelers. Section 9107.13 "BOARDING HOUSE" A dwelling other than a hotel where lodging or lodging and meals for three (3) or more per- sons is provided for compensation. Section 9107.13 "BUILDING" Any structure having a roof supported by columns or by walls and de- (Continued on Next Page) signed for the shelter or housing of any person, animal or chattel. Section 9107.15 "BUILDING, ACCES SORY" A subordinate building, the use of which is incidental to that of the main building on the same lot and /or building site. Section 9107.16 "BUILDING, MAIN" A building in which is conducted the principal use of the lot and /or building site on which it is situ- ated. Section. 9107.17 "BUILDING SITE" A lot or parcel of lard, in single or joint ownership, and occupied or to be occupied by a main building and accessory buildings, or by a dwelling group and its accessory buildings, together with such open spaces as are required by the terms of this Article and having its prin- cipal frontage on a street, road, highway or waterway. Section 9107.13 "BUSINESS, RE- TAIL" The retail sale of any arti- cic, substance, or commodity for profit or livelihood, conducted with- in a building but not including the sale of lumber or other building ma- terials or the sale of used or sec - oudhand goods or materials of any kind. Section 9107.19 "B U S I N E S S, WHOLESALE" The wholesale handling of any article, substance or commodity for profit or livch- hood, but not including the hand- ling of lumber or other building materials or the open storage or sale of any material or commodity and not including the processing or manufacture of any product or substance. Section 9107.20 "COMBINING DIS- TRICT" Any district in which the general district regulations are combined with-"-B" or " -H" for the purpose of adding additional special regulations, i.e. "R -1" com- bined with " -B" (R -1 -13) increases the area and yard requirements. "C -P" combined with " -H" (C -1 -H) adds the additional requirement of off - street parking. Section 9107.21 "DISTRICT" A por- tion of the City within which cer- tain uses of land and buildings are permitted or prohibited and within which certain yards and other open spaces are required and certain height limits are established for buildings, all as set forth and speci- fied in this Article. Section 9107.22 "DWELLING, ONE SINGLE FAMILY" A building containing only one kitchen, de- signed for or used to house not more than one family,. including all necessary employees of such fam- ily. Section 9107.23 "DWELLING, TWO FAMILY OR DUPLEX" A building containing not more than two kitch- ens, designed and /or used to house not more than two families, living independently of each other,includ- ing all necessary employees of each such family. Section 9107.24 "DWELLING, MUL- TIPLE" A building or portion therof used and designed as a resi- dence for three or more families living independently of each other, and doing their own cooking in said building, including a p a r t m e n t houses, apartment hotels and flats, but not including automobile courts. Section 9107.25 "DWELLING GROUPS" A group of two or more detached or semi - detached, 1 -fam- ily, 2- family, or multiple dwellings occupying a parcel of land, in one ownership and having any yard or court in common, but not including automobile courts. Section 9107.26 "FAMILY" One or more persons occupying a premises and living as a single housekeep- ing unit, as distinguished from• a group occupying a hotel, club, fra- ternity or sorority house. A family shall be deemed to include neces- sary servants. Section 9107.27 "GARAGE SPACE" An accessible and usable covered space of not less than eight (8) feet by twenty (20) feet for the parking of automobiles off the street, such space to be so located on the lot so as to meet the re- quirements of this Article for an accessory building. Section 9107.28 "HEIGHT OF BUILD- INGS" The vertical distance from the average level of the highest and lowest point of that portion of the lot covered by the building to the topmost point of the roof. Section 9107.29 "HOTEL" Any build- ing or portion thereof containing 6 or more guest rooms used, de- signed or intended to be used, let, or hired out to be occupied or which are occupied by 6 or more individ- uals for compensation whether. the compensation for hire to be paid directly or indirectly. Section 9207.30 "JUNK YARD" The use of more than 100 square feet of the area of any lot or the use of any portion of that half of any lot, which half adjoins any street, for the storage of junk, including scrap metals or other scrap mater- ials or for the dismantling or "wrecking" of automobiles or other vehicles, or machinery whether for sale or storage. Section 9107.31 "NON- CONFORM- ING USE" A use that does not con- form to the regulations for the dis- trict in which•it is situated. Section 9107.32 "PARKING SPACE" An accessible and usable space on the building site at least eight (8) feet by twenty (20) feet located off the street with access for the parking of automobiles. Section 9107.33 "REVERSED FRONTAGE" A key lot or the first lot to the rear of a corner lot, the front line of which is a continua- tion of the side line of the corner lot and fronting on the street which intersects the street upon which the side of a corner let abuts. Section 9107.34 "ROOMING OR BOARDING HOUSE" A dwelling other than a hotel where lodging and /or meals for three or more per- sons are provided for compensation. Section 9107.35 "STREET" A public or private thoroughfare which af- fords principal means of access to abutting property, including ave- nue, place, way, drive, lane, boule- vard, highway, road, and any other thoroughfare except an alley as defined herein. Section 9107.36 "STREET LINE" The boundary between a street and property. Section 9107.37 "STRUCTURE" Any- thing constructed or erected, the, use of which required location on the ground or attachment to some- thing having location on the ground. Section 9107.38 "STRUCTURE AL- TERATIONS" Any change in the supporting members of a building, such as bearing walls, columns, beams or girders. Section 9107.39 "TRAILER COURT" Land or premises used or intended to be used, let or rented for occu- pancy by or of trailers or movable dwellings, rooms or sleeping quar- ters of any kind. • • Section 9107.40 "USE" The purpose for which land or premises of a building thereon is designed, ar- ranged, or intended or for which it is or may be occupied or maintain- ed. Section 9107.41 "USE- ACCESSORY" A use incidental and accessory to the principal use of a lot or a build- ing located on the same lot. Section 9107.42 "YARD" An open space other than a court on the same lot with a building, which open space is unoccupied and un- obstructed from the ground up- ward, except as otherwise permit- ted in Section 9105.4. Section 9107.43 "YARD- FRONT" A yard extending across the front of the lot between the inner side yard lines and measured from the front line of the lot to the .nearest line of the building; provided that if any building line or Official Plan Line has been established for the street upon which the lot faces then such measurement shall be taken from such building line or Official Plan Line to the nearest line of the building. Section 9107.44 "YARD- REAR" A yard extending across the full width of the lot and measured be. tween the rear line of the lot and the nearest line of the main build - Sect on 9107.45 "YARD- SIDE" A yard between the side line of the; lot and the nearest line of the build- ing and extending from the front line of the lot to the rear yard. CHAPTER 8. INTERPRETATION Section 9108.1 When interpreting and applying the provisions of this Article, they shall be held to be the minimum requirements adopted for the.promotion of the public health, safety, comfort, convenience and general welfare. Except as specifi- cally herein provided, it is not in- tended'by the adoption of this Arti- pic to repeal, abrogate, annul or in any way to impair or interfere with any existing provision of law of the Municipal. Code of the City of Newport Beach, or any rules, regulations or . permits previously adopted or issued. or which shall be adopted or issued pursuant to law relating to the erection, construc- tion, establishment, moving, altera- tion or enlargement, of any legal building or improvement; nor is it intended by this Article to inter- fere with or abrogate or annul any easement, covenant, or other agree- ment between parties; provided, however, that in cases in which this Article imposes a greater restric- tion upon the erection, construc- tion, establishment, moving, altera- tion or enlargement of legal build- ings or the use of any such build- ing or premises in said several dis- tricts or any of them, than is im- posed or required by such existing provisions of law or the Municipal Code of the City of Newport Beach, or by such rules, regulations or per- mits or by such easements, cove- nants or agreements, then in such case the provisions of this Article shall control. CHAPTER 9. ENFORCEMENT, PENALTIES AND LEGAL PROCEDURE. Section 9109.1 All departments, offi- cials and public employees of the City of Newport Beach, vested:with the duty or authority to issue per- mits or licenses shall conform to the provisions of this Article and shall issue no permit or license for uses, buildings, or purposes in con. flict with the provisions of this Article; and any such permit or licenses issued in conflict with the provisions of this Article shall be null and void. It shall be the duty of the Building Inspector of the City to enforce the provisions of this Article pertaining to the cre- ation, construction, reconstruction, moving, conversion, alteration or addition to any building or struc- turc. Section 9109.3 Any building or struc- ture set up, erected, constructed, altered, enlarged, converted, moved or maintained contrary to the pror visions of this Article, and any use of any land, building or premises established, conducted, operated or maintained contrary to the provi- sions of this Article, shall be and the same is hereby declared to be unlawful and a public nuisance; and the City Attorney of said City shall, upon order of the City Council, immediately commence action or proceedings for the abatement and removal and enjoinment thereof in the manner provided by law, and shall take such other steps and shall apply to such courts as may have jurisdiction to grant such relief as will abate and remove such build- ing or structure, and restrain and enjoin any person, firm or corpora- tion from setting up, erecting, build- ing, maintaining, or using any such building contrary to the provisions of this Article. Section 9109.4 The remedies provid- ed for herein shall be cumulative and not exclusive. CHAPTER 10. REPEALING Section 9110.1 Ordinance No. 525 is hereby repealed and all other ordi- nances and parts of ordinances of said City in conflict with this Article to the extent of such con- flict and no further, are hereby re- pealed provided that nothing herein contained shall be deemed to repeal, or amend any ordinance of said City requiring a permit or license or both to cover any business trade or occupation. CHAPTER 11. VALIDITY Section 9111.1 If any section, subsec- tion, sentence, clause or phrase of this Article is for any reason held by a court of competent jurisdic- tion to be invalid, such decision shall not affect the validity of the remaining portions of this Article. The City Council hereby declares that it would have passed this Article and each section, subsec- tion, sentence, clause and phrase, hereof, irrespective of the fact that any one or more sections, subsec- tions, sentences, clauses or phrases be declared invalid. CHAPTER 12. REFERENCE Section .9112.1 This Article shall be known and cited as the Zoning Law of the City of Newport Beach. Refer- ences to section numbers herein are to the sections of this Article. Section 3: This ordinance shall be published at least once in the New- port- Balboa Press, a newspaper of general circulation, printed and published in the City of Newport Beach and shall-be in force and effect thirty (30) days after the final publication thereof.
