Any proposed <br />change in or expansion of the area <br />within the City of Newport Beach <br />in which slant drilling or subter- <br />ranean . drllling is allowed by Sec- <br />tion 9124 of this Code shall first <br />be submitted to the qualified elec- <br />tors of the City of Newport Beach <br />for approval or disapproval. If a <br />majority of said qualified electors <br />vote in favor of such a question, <br />then and only then shall the City <br />Council have the power to act on <br />such question. This section shall <br />apply only to the boundaries, of <br />the City of Newport Beach as they <br />exist on April '13, 1954, together <br />with any territory in the process <br />of annexation on said date. This <br />section shall not apply retroactive - <br />ly to any drilling operation or con - <br />4ract entered into prior to the ef- <br />fective date of this section. <br />l"It is specifically declared that <br />it is the intention of this Section <br />9124.1 that it shall apply solely to <br />the question of a change in or ex- <br />pansion of the area in which slant <br />or subterranean drilling is per- <br />mitted and shall not apply to env <br />other question involving the drill- <br />ing for or production of oil, gas <br />or other hydrocarbon substances <br />within the City of Newport Beach, <br />under the City of Newport Beach <br />or its tide and submerged lands." <br />SECTION 2: This Ordinance <br />shall not become effective until <br />the same shall have been submit-1 <br />ted to the electors of the City of <br />Newport Beach at a general elec- <br />tion to be held in the City of New- <br />port Beach on the 13th day of! <br />April, 1954, and at said general: <br />election there shall be and is here- <br />by submitted to the electors of the <br />City of Newport Beach, this ordi- <br />nance and the electors of the City <br />of Newport Beach shall be, and <br />they are hereby, invited to vote for <br />or against this Ordinance, and the <br />adoption thereof; and the form in <br />which this said ordinance shall be <br />submitted to said electors as here - <br />inbefore provided for, shall be as <br />follows: <br />"PROPOSITION NO. 4 <br />Shall Section 9124.1 be <br />added to the Municipal <br />Code, providing for the <br />submission to the ap- <br />proval of the majority <br />of voters at an election, <br />any question of the ex- <br />pansion of or change <br />in the oil drilling area I Yes -1 <br />within or under the I No 1 1 <br />City of Newport Beach, <br />'specifically excluding <br />any oil drilling opera- <br />tions or agreements in <br />effect at the time of <br />the passage of this <br />Ordinance, be adopt- <br />ed ?" <br />SEC ION T. If - at said election <br />the majority of voters vote in fa- <br />t vor of this Ordinance, and if upon <br />canvassing the votes so cast, <br />thereat, a majority of them are <br />found to be in favor of this ordi- <br />nance, it shall become effective 10 <br />days after the canvassing of said <br />votes so cast. I <br />JSECTION 4: The above and <br />foregoing ordinance shall be pub-1 <br />lished once in the Newport -Bel- <br />boa Press, a newspaper of general <br />circulation, printed, published and <br />circulated in the City of Newport <br />Beach, and upon said publication <br />and upon its being voted in favor <br />of by a majority of the votes cast <br />at the election as shown by the <br />canvassing of said votes. and upon <br />the expiration of 10 days from the <br />canvass of said votes, it shall take <br />effect and be in force. <br />The above and foregoing Ordi- <br />nance was passed at a regular ad- <br />journed meeting of the City Coun- <br />cil ofjthe City of Newport Beach <br />held on the 2nd day of March, 1954 <br />by the affirmative vote of the fol- <br />lowing members thereof, to wit: <br />AYES, Councilmen: Smith, Ben- <br />nett, -Finch, Isbell, Miller <br />NOES,.Coulicilmen: None <br />ABSENT Councilmen: None <br />I NORMAN MILLER <br />Mayor <br />ATTEST: <br />C.
