This space is for the County Clerk's Filing Stamp ORDINANCE NO. 715 -AN ORDINANCE OF THE CITY OF NEWPORT BEACH ADD- ING SECTION 9124.1 TO THE MUNICIPAL CODE OF THE CITY OF NEWPORT BEACH PROVIDING THAT ANY QUESTION ON THE EXPAN- SION OF OIL DRILLING WITHIN OR UNDER THE CITY OF NEWPORT BEACH BE SUBMITTED TO THE VOTERS OF SAID CITY AT AN ELECTION FOR APPROV- AL OR DISAPPROVAL THEREOF. The People of the City of New- port Beach do ordain as follows: SECTION 1: .There is hereby added to the,Municipal Code of the City of Newport Beach Section 9124.1, to read as follows: "Section 9124.1. Any proposed change in or expansion of the area within the City of Newport Beach in which slant drilling or subter- ranean . drllling is allowed by Sec- tion 9124 of this Code shall first be submitted to the qualified elec- tors of the City of Newport Beach for approval or disapproval. If a majority of said qualified electors vote in favor of such a question, then and only then shall the City Council have the power to act on such question. This section shall apply only to the boundaries, of the City of Newport Beach as they exist on April '13, 1954, together with any territory in the process of annexation on said date. This section shall not apply retroactive - ly to any drilling operation or con - 4ract entered into prior to the ef- fective date of this section. l"It is specifically declared that it is the intention of this Section 9124.1 that it shall apply solely to the question of a change in or ex- pansion of the area in which slant or subterranean drilling is per- mitted and shall not apply to env other question involving the drill- ing for or production of oil, gas or other hydrocarbon substances within the City of Newport Beach, under the City of Newport Beach or its tide and submerged lands." SECTION 2: This Ordinance shall not become effective until the same shall have been submit-1 ted to the electors of the City of Newport Beach at a general elec- tion to be held in the City of New- port Beach on the 13th day of! April, 1954, and at said general: election there shall be and is here- by submitted to the electors of the City of Newport Beach, this ordi- nance and the electors of the City of Newport Beach shall be, and they are hereby, invited to vote for or against this Ordinance, and the adoption thereof; and the form in which this said ordinance shall be submitted to said electors as here - inbefore provided for, shall be as follows: "PROPOSITION NO. 4 Shall Section 9124.1 be added to the Municipal Code, providing for the submission to the ap- proval of the majority of voters at an election, any question of the ex- pansion of or change in the oil drilling area I Yes -1 within or under the I No 1 1 City of Newport Beach, 'specifically excluding any oil drilling opera- tions or agreements in effect at the time of the passage of this Ordinance, be adopt- ed ?" SEC ION T. If - at said election the majority of voters vote in fa- t vor of this Ordinance, and if upon canvassing the votes so cast, thereat, a majority of them are found to be in favor of this ordi- nance, it shall become effective 10 days after the canvassing of said votes so cast. I JSECTION 4: The above and foregoing ordinance shall be pub-1 lished once in the Newport -Bel- boa Press, a newspaper of general circulation, printed, published and circulated in the City of Newport Beach, and upon said publication and upon its being voted in favor of by a majority of the votes cast at the election as shown by the canvassing of said votes. and upon the expiration of 10 days from the canvass of said votes, it shall take effect and be in force. The above and foregoing Ordi- nance was passed at a regular ad- journed meeting of the City Coun- cil ofjthe City of Newport Beach held on the 2nd day of March, 1954 by the affirmative vote of the fol- lowing members thereof, to wit: AYES, Councilmen: Smith, Ben- nett, -Finch, Isbell, Miller NOES,.Coulicilmen: None ABSENT Councilmen: None I NORMAN MILLER Mayor ATTEST: C.
