0 <br />• <br />L7 <br />ORDINANCE NO.-737 <br />AN ORDINANCE AMENDING <br />eS E C T I ONS 9106.21, 9105.31 <br />AND 9106.51 OF THE MU- <br />NICIPAL CODE OF THE <br />CITY OF NEWPORT BEACH, <br />CHANGING THE APPLICA- <br />CATION FEES FOR USE <br />PERMITS, VARIANCES AND <br />AMENDMENTS. <br />The City Council of the City of <br />:Newport Beach does hereby or- <br />dain as follows: <br />SECTION 1: Section 9106.21 of <br />the Municipal' Code of the City of <br />Newport Beach is hereby amend - <br />.ed1to read as follows: <br />"Section 9106.21. Application: <br />.`(a) Application for Use Per- <br />mit shall be made to the <br />Planning Commission in <br />writing on a form pre - <br />,scribed by the Comihis- <br />-sion And shall be ac- <br />companted by plans and <br />elevations necessary to <br />show the detail of the <br />"proposed use or.building. <br />Such applications shall <br />be accompanied by a fee <br />of 'ten dollars ($10.00)" <br />SECTION 2: Section 9106.31 of <br />the Municipal Code of the City <br />of Newport Beach is hereby <br />amended to read as follows: <br />'Section 9106.31. Application: <br />(A) Application for variance <br />shall be made by the pro- <br />perty owner in writing on <br />a form prescribed by the <br />Planning Commission and <br />shall be accompanied by <br />a fee of fifteen dollars <br />($15.00) and statement, <br />plans and evidence show- <br />ing: <br />(1,) That there are ex- <br />ceptional or extra- <br />ordinary circum- <br />stances applying to <br />the land, building or <br />use referred to in the <br />application,. w h i c h <br />circumstances or <br />conditions do not <br />apply generally to <br />land, buildings and/ <br />or uses in the same <br />district. <br />(2) That the granting of <br />the application is <br />necessary f or the <br />preservation and en- <br />joyment of substan- <br />tial property rights <br />of the petitioner. <br />(3) That the granting of <br />such application will <br />not, under the cir- <br />cumstances of the <br />particular case, ma- <br />, <br />terially a f f e c ad- <br />versely the health or <br />safety of persons re- <br />siding or working ih <br />the neighborhood of <br />the property of the <br />applicant, and will <br />not under the cir- <br />cumstances of the <br />particular case, be <br />materially detrimen- <br />tal to the public wel- <br />fare or injurious to <br />property or improve. <br />ments in said neigh. <br />borhood." <br />SECTION 3: Section 9106.51 of <br />the Municipal Code of the City <br />of Newport Beach is hereby <br />amended to read AS follows: <br />"Section 9106.51. Initiation: <br />(a) An amendment may be <br />initiated by: <br />(1) The verified petition <br />of one or more own- <br />ers of property af- <br />fected by the pro- <br />posed amendment, <br />�4hfch petition shall <br />be filed with the <br />Planning Commis- <br />sion and shall be ac. <br />companied by a fee <br />of fifty do11ats <br />($50.00),, no paet of <br />which. shall be re- <br />turnable to the peti- <br />tioner, or by <br />(2) Resolution of inten- <br />tion of the City <br />Council, or by <br />(3) Resolution of inten- <br />tion of the Planning <br />Commission." <br />SECTION 4: This Ordinance <br />shall be published once in the <br />Newport Harbor Ensign, a news- <br />paper of general circulation; <br />printed and published in the <br />City of Newport Beach, and the <br />Same shall ho in full force and <br />effect 30 days after the passage <br />thereof. <br />The foregoing Ordinance \:QA's <br />introduced at a regular :n3ocinF <br />of the City Council of th?
