ORDINANCE NO. 792 <br />AN ORDINANCE OF THE <br />CITY OP NEWPORT BEACH <br />AMENDING SECTION 6507 <br />OF CHAPTER V OF ARTICLE <br />VI OF THE MUNICIPAL <br />CODE OF THE CITY OF <br />NEWPORT BEACH. <br />The City Council of the City <br />of Newport Beach does ordain as <br />follows: <br />SECTION 1: That Section 6507 <br />of Chapter V of Article VI of the <br />Municipal Code of the City of <br />Newport Beac4 adopted by Ordi- <br />nance NQ. 772,, be and the same <br />is hereby amended to lead as <br />follows: <br />"SECTION 6507. EXISTING <br />SALES AND USE TAX PROVI- <br />SIONS SUSPENDED. As of April <br />1, 1955, the provisions of Chapter <br />4, Part 1, Sections 6426 through <br />6449, Inclusive, and Part 11, Sec. <br />tions 6460 through G484, inclu- <br />sive, of Article V,I of the Munici- <br />pal Code of the City of Newport <br />Beach shall be suspended and <br />shall not again be of any force or <br />effect until and unless for any <br />reason the State Board of Equal - <br />lzation ceases to perform the <br />functions incident to the admini- <br />stration and operation of the <br />sales and use tax hereby im. <br />posed; provided, however, that if <br />for any reason it is determined <br />that the City of Newport Bea ^_his <br />without power to adopt this ordi- <br />nance. or that the State Board of <br />Equalization is without power to <br />perform the functions incident to <br />the administration and operation <br />of the taxes imposed .oy Chapter <br />V, Article VI of the Municipal <br />Code of the City of Newport, <br />Beach, the provisions of Chapter <br />4, Part I, Sections 6426 through <br />6449, inclusive, and Part 11. Sec. <br />tiuns 6460 through 6484, inclu- <br />sige, of Article -VI of the Munici. <br />pal Code of the City o Newport <br />Beach shall not be deemed to <br />have been suspended, but shall <br />h^ de-emel to have been in full <br />force and effect at the rate of <br />one percent (1%) continuously <br />from and after April 1, 1956, <br />.Upon the ceasing of the State <br />Board of Equalization to perform <br />the functions incident to the ads <br />ministrat.ldn'and operation of the <br />taxes imposed by Chapter 'V`bf <br />Article VI of the Municipal Code <br />of the City of Newport Beach, the <br />provisions of Chapter 4, Part I, <br />Sections 6426 through 6449, in. <br />elusive, and Part 11, Sections 646Q <br />through 6484, inclusive, of Article <br />V1 of the Municipal Code of thqq <br />City of Newport Beach shall bA <br />again In full force and effect al <br />the rate of one percent (15o). <br />Nothing in this ordinance shall <br />be construed as relieving any <br />person of the obligation to pay <br />to the City of Newport Beach any <br />sales or use tax accrued and <br />owing by reason of the provi- <br />sions of Chapter 4, Sections W-,� <br />through 6425 of Article VI of the <br />Municipal Code of the City of <br />Newport Beach in force and ef- <br />fect prior to and including March <br />31, 1956." - <br />SECTION 2: This ordinance, In- <br />asmuch as it amends the City <br />Sales and Use Tax laws as con- <br />tained in Chapter V of Article <br />VI of the Municipal Code, which <br />provides for a tax levy for the <br />usual current expenses of the <br />City of Newport Beach, shall <br />take effect immediately upon the <br />passage thereof and shall be <br />published once in the NEWPORT <br />IiARBOR ENSIGN, a newspaper <br />of general circulation, printed <br />and published, and circulated in <br />the City of Newport Beach. <br />The above and foregoing ordi- <br />nance was introduced and <br />adopted at a regular meeting of <br />the City Council of the City of <br />Newport Beach, held on the 9th <br />day of July, 1956, by the follow - <br />iarz vote, to -wit: <br />AYES, COUNCILMEN: Hart, <br />Wilder, MacKay, Higbie, Ridder- <br />hof.
