HomeMy WebLinkAbout803 - Tustin Avenue & 22nd Street Annexis i ORDINANCE NO. 803 AN ORDINANCE OF THE CITY OF NEWPORT BEACH AP- PROVING THE ANNEXATION TO THE CITY OF NEWPORT BEACH OF CERTAIN INHAB- ITED TERRITORY DESIG- NATED AS "TUSTIN AVENUE AND 22ND STREET ANNEX," WHICH IS CONTIGUOUS TO THE CITY OF NEWPORT BEACH, UPON THE TERMS CONTAINED IN THE QUES. TION SUBMITTED AT A SPE- CIAL ELECTION HELD IN SAID TERRITORY ON THE SIXTEENTH DAY OF OCTO- BER, 1956. WHEREAS, pursuant to the provisions of an Act of the Legis- lature of the State of California, known as the "Annexation Act of 1913," and pursuant to Resolution No. 4531 passed by the City Coun. cil of the City of Newport Beach on the 13th day of August, 1956, a special election was held on the 16th day of October, 1956, in that certain inhabited territory contiguous to the City of New- port Beach designated as "Tustin Avenue and 22nd Street Annex" and which is hereinafter more particularly described; and, WHEREAS, at said special elec- tion the following question was submitted to the qualified elec- tors residing in said territory: "SHALL TUSTIN AVENUE AND 22ND STREET ANNEX BE AN- NEXED TO, INCORPORATED IN AND MADE A PART OF THE CITY OF NEWPORT BEACH AND THE PROPERTY IN SUCH TERRI- TORY BE, AFTER SUCH ANNEX- ATION, SUBJECT TO TAXATION EQUALLY WITH THE PROPERTY WITHIN THE CITY OF NEW- PORT BEACH, TO PAY THE EN- TIRE BONDED INDEBTEDNESS OF THE CITY OF NEWPORT BEACH OUTSTANDING OR AU- THORIZED AT THE DATE OF THE FIRST PUBLICATION OF THE NOTICE OF ELECTION FOR ANNEXATION, FOR THE ACQUI- S I T 10 N, CONSTRUCTION OR COMPLETION OF MUNICIPAL IMPROVEMENTS?" WHEREAS, it appears from the canvass of the returns of the votes cast at said special election that a majority of all votes cast in said territory on the question of said annexation to the City of Newport Beach and the assump- tion of said indebtedness favor annexation upon the terms con- tained in the question submitted; and, WHEREAS, it appears that said special election and all proceed- ings relating thereto have been conducted strictly in accordance with law; NOW, THEREFORE, the City Council of the City of Newport Beach does ordain as follows: SECTION U That the annexa- tion of that certain inhabited ter- ritory contiguous to the City of Newport Beach designated as "Tustin Avenue and 22nd Street Annex" be and the same is here- by approved upon the terms con- tained in the aforesaid question which was submitted at the spe- cial election held on the 16th day of October, 1956. Said territory is described as follows: Beginning at an angle point in Boundary line of the City of Newport Beach, said angle point being the point of inter- section of the northwesterly line of that County Road known as Irvine Avenue extension, 80 feet in width, and the south- westerly line of Lot 298 as shown upon a map of Newport Heights recorded in Miscellane- ous Map Book 4, Page 83, Rec- ords of Orange County, Califor- nia, said angle point also being in the northeasterly line of 22nd Street as shown upon said map of Newport H e i g h t s; thence northwesterly a I o n g said northeasterly line of 22nd Street to a point of intersection with the southeasterly line of Tustin Avenue as shown upon said map of Newport Heights; thence northeasterly along said southeasterly line of Tustin Avenue to an angle point in the boundary line of the City of Newport Beach; said angle point being the most northerly corner of Lot 104 as shown 20 upon a map of Tract No. 300, recorded in Miscellaneous Map Book 14, Pages 11 and 12, Rec- ords of said Orange County; thence southeasterly along said City Boundary line to a point of intersection with the west- erly line of the aforementioned Irvine Avenue Extension, 80 feet in width; thence southerly along said westerly line and along said City Boundary line to a point of intersection with the southeasterly line of said Lot 104; thence southwesterly along said City Boundary line to an angle point; said angle point being distant 52 feet northeasterly from the most westerly corner of Lot 318 as shown upon the aforemen- tioned map of Newport Heights; thence southeasterly along said City Boundary line to a point of intersection with the aforementioned westerly line of Irvine Avenue exten- sion; thence southerly and southwesterly along the west- erly and northwesterly line of said Irvine Avenue extension and along said City Boundary line to the point of beginning. SECTION 2: This ordinance shall be published at least once in the Newport Harbor Ensign, a newspaper of general circulation, printed and published and circu- lated in the City of Newport Beach, and the same shall be in full force and effect 30 days after this passage. The above and foregoing ordi- nance was introduced at a regu- lar meeting of the City Council of the City of Newport Beach held on the 22nd day of October, 1956, and was finally passed and adopted on the 13th day of No- vember, 1956, by the following vote, to -wit: Ayes, Councilmen: Hart, Mac - Kay, Stoddard, Higbie, Ridderhof, Hill.
