<br />BEING AN ORDINANCE WHICH PROVIDES FOR -THE
<br />AMEND:f1ENT TO OR THE REPEAL OF .GER3AW,
<br />SECTIONS IN CHAPTER I, ART. IQLE VI AND CH.Api
<br />TER 2, ARTICLE VI OF THE A &ICIPAL CODE OF
<br />THE CITY OF NEWPORT BPh.AILK AS MORE PAR-
<br />TICULARLY SETFORTH IN 9AJD.iORDINANCE.
<br />The City Council of the City of Newport Beach does ordain as
<br />SECTION 1: Section 6109 of Chapter 1 of Article VI of the
<br />Municipal Code of the City of Newport Beath be, ar4k1he same is
<br />hereby amended to read as follows:
<br />"Section 6109. 'Dancing Academy' is a place where dancing
<br />is taught and a fee is paid for such instruction."
<br />SECTION 2: That Section 6113 of Chapter 1 of Article VI
<br />of the Municipal Code of the City of Newport Beach entitled "Gen -
<br />Igral Contractor" .be, and the same is hereby, amended as follows:
<br />"Section 6113. 'General Contractor' is' a person, other than a
<br />:dubcpntractor as herein defined, who enters into a contract to
<br />c6.tfstruct or repaid buildings or structures, or any part thereof in
<br />the City for a- contract price or for a percentage of its costs,
<br />where the value of any such construction or repair when completed
<br />or the contract price thereof shall be $50.00 or more.
<br />"'Subcontractor' is a person who shall enter into a contract
<br />with a general contractor to construct or repair any portion of a
<br />building or structure, when the contract price thereof shall be
<br />$50.00 or more. For the. purposes of this Section, any person who
<br />shall commence the erection, construction or repair of any por.
<br />tion of a building or structure, when the value of said erection,
<br />construction or repair shall be $50.00 or more, shall be deemed
<br />a subcontractor, as herein defined and shall be liable to pay the
<br />license herein provided for unless the owner of said building or:
<br />structure or the owner of the land upon which such buliding or
<br />structure is being erected, constructed or repaired shall first make
<br />a sworn statement that he is erecting, constructing or repairing a
<br />portion of such building or structure as the owner then . - that
<br />he has.not. entered into a contract either verbal or Ni with'
<br />any contractor or subcontractor, or any person wh to
<br />erect, construct, or repair any portion of said building ure
<br />and that a portion of said building or structure is be" ted,.
<br />constructed or repaired by day labor at a stipulated,. said]
<br />wage to be specified in said statment), and further that ek-
<br />ing such representations in order that said person wfl avei
<br />to pay the license fees herein provided for and that ew?X, f said
<br />representations are true. h
<br />"For the purposes of this Section, every person who mall com-
<br />mence the erection or construction of any building or structure, or
<br />shall repair in any manner any building or structure, in the City,
<br />shall be deemed a contractor as herein defined and shall be liable
<br />to pay 'the license hereinafter provided for, providing that the
<br />contract price or the value of said structure or building when
<br />completed shall be more than $50.00, unless the owner of said'
<br />building or structure, or the owner of the land on which such
<br />building or structure is being erected, constructed or repaired,
<br />shall first make a sworn statement that he is erecting, construct -
<br />ing,or repairing such building or structure as the owner thereof,
<br />and that he has not entered into a contract either verbal or writ -'
<br />ten, with any contractor or subcontractor, or any person whatso-
<br />ever, to erect or construct or repair said building or structure, and
<br />that said building or structure is being erected or constructed or
<br />repaired by day labor at a,stipulated wage (said wage to be speci-
<br />fied in said statement) and further that he is making such repre-
<br />sentatiorls in order that said person will not have to pay the li-
<br />cense fees herein provided for and that each of said representa-
<br />tions are true.
<br />"A general contractor engaging in or conducting other busi-
<br />nesses. otherwise subject to the payment of a separate business
<br />license fee as provided in this Code, shall pay the same fee for
<br />each such business as otherwise provided in this Code."
<br />SECTION 3: That Section 6126 of Chapter 1 of Article VI
<br />of the Municipal Code of the City of Newport Beach entitled "Li-
<br />cense Regtlh'ed" be, 'and the same is hereby, amended as follows::
<br />"Section' 6126. License Required. No person, other than those
<br />specifically excepted by law, shall operate any business specified
<br />in this Code, in the City, without first having obtained'a license
<br />.from said City to do so or without complying with any and all
<br />regulatons of such business contained in this Code; and the car-
<br />rying on of such business without first having obtained a license
<br />'from said City to do so, 'or without complying with any and all
<br />regulations of such business contained in this Code, shall consti-
<br />tute a separate violation of this Code for each and every day that
<br />such business is so carried on.
<br />"Any, business which operates another business or businesses
<br />not ordinarily an accepted part of such business otherwise sub-
<br />ject to the payment of a separate business license fee shall pay
<br />the additional license. fee for each such additional business as
<br />otherwise prescribed in this Code."
<br />SECTION 4: That Section 6129 of Chapter 1 of Article VI
<br />of the Municipal Code of the City of Newport Beach entitled "Issu-
<br />ance of License" be, and the same is hereby, amended as follows:
<br />" Section 6129. Issuance of License. All licenses issued. under
<br />and by virtue of this Article shall be printed in,blank form signed
<br />by the Director of Finance, who -shall set forth (1) the name of
<br />'the party to whom the license is issued, (2) the nature of the trade
<br />or business he is licensed to pursue, (3) the place of business,
<br />(4) time for which the same is granted, (5) the date thereof,
<br />(6) the amount paid therefore and (7} `r;informatign as
