HomeMy WebLinkAbout794 - Restricting the Use of Water in EmergenciesF-1 • • ORDINANCE NO. 794 AN ORDINANCE REGULA- TING AND RESTRICTING THE USE OF CITY OF NEW- PORT BEACH WATER IN CASE OF EMERGENCY AND THE GRANTING OF POW- ERS TO THE CITY MANA- GER OF SAID CITY. WHEREAS, there now exists a threatened shortage of water available to the city of Newport Beach for domestic and irriga- tion purposes; and WHEREAS, a major source of supply of such water is from the Metropolitan Water District and an inadequate supply of such water for use by the city of New- port Beach and its residents and others using said water with the consent of said city appears to be imminent by reason of de- mands on such water from cities and other communities lying northerly of the city limits of said city of Newport Beach; and WHEREAS, it appears to be necessary that emergency powers be granted to the city manager of said city in the event of a finding by him that an emer- gency exists in connection with the water supply of said city; NOW, THEREFORE, the city council of the city of Newport Beach does ordain as follows: 1. That the city manager of the city of Newport Beach, in the event of a finding by him to the effect that an emergency exists as a result of the water supply available for use in said city and by contracting parties with said city. be, and he is hereby, granted the following powers to be exercised by him in the order that he deems for the benefit and best interest of said city and of the persons, firms or cor- porations using city water: (a) To proclaim and order that no water user shall use any water of the city to the extent that any of such water shall leave or run off the immediate property on which said water is being used; (b) To proclaim and order that the water used by contrac- ting persons located outside of the city limits of the city of New. port Beach be restricted to the extent necessary in the judg- ment of said city manager; and (c) To make such other proc- lamations and orders as shall, in his judgment, be deemed necessary to maintain sufficient water for domestic use by resi- dential water users within the city of Newport Beach. 2. In the event of such emer- gency, said city manager shall declare such emergency to exist in writing and shall file same with the city clerk of said city. 3. That the times when the orders, rules and regulations made and promulgated pursuant to this ordinance shall be in ef- fect, they shall supersede all existing ordinances, orders, rules and regulations insofar as the latter may be inconsistent there- with. 4. Such rules, orders and reg- ulations and restrictions promul- gated by said city manager shall continue during the time of such emergency as determined by said city manager or by the city council of said city of Newport Beach. 5. FINDING OF EMERGENCY. This ordinance is passed as an emergency measure and the city council does by the vote by which this ordinance is passed, hereby declare that an emer- gency exists which makes it im- perative that this ordinance shall become effective forthwith; the nature of said emergency being as follows: That there now exists a threat- ened lack of supply of water to the city of Newport Beach and that in the event of an inade- quate supply, this ordinance is being adopted so that water will be available for necessary do- mestic use in said city. The above and foregoing ordi. nance was introduced at a regu. lar meeting of the city council of the city of Newport Beach held on the 23rd day of July, 1955, by the following vote, to wit: AYES, COUNCILMEN: Hart, Wilder, MacKay, Stoddard, Hig. bie, Ridderhof, Hill.
