ORDINANCE NO. 812 <br />AN ORDINANCE OF THE CITY <br />OF NEWPORT BEACH AMEND- <br />ING SECTIONS 3107, 3108, 3110 <br />AND 3112 OF CHAPTER 1 OF <br />ARTICLE III OF THE MUNICI- <br />PAL CODE OF THE CITY OF <br />NEWPORT BEACH. <br />The City Council of the City <br />of Newport Beach does ordain as <br />follows: <br />SECTION 1: That Section 3107 <br />of Chapter 1 of Article III of the <br />Municipal Code of the City of <br />Newport Beach be amended to <br />read as follows: <br />"Section 3107. Open Air Fires <br />Within Zones One and Two. No <br />person shall set fire to, ignite <br />or burn any material In the open <br />air, or in any incinerator within <br />Fire Zones One and Two, except <br />In designated beach or camp <br />fire areas." <br />SECTION 2: That Section 3108 <br />of Chapter 1 of Article III of the <br />Municipal Code of the City of <br />Newport Beach be amended to <br />read as follows: <br />"Section 3108. Open Air Fire <br />Within Zone Three. No person <br />shall set fire to, ignite, or burn <br />any material In the open air, or <br />in any incinerator, within Fire <br />Zone Three at any time other <br />than between the hours of six <br />o'clock a.m. and ten o'clock a.m. <br />of the same day, provided, how -, <br />ever, that the Chief of the Fire' <br />Department, upon application <br />thereof, may issue a written per. <br />mit for the burning of material' <br />in the open air or In any Incin. <br />erator after ten o'clock a.m." <br />SECTION 3: That Section 3110 <br />of Chapter 1 of Article III of the <br />Municipal Code of the City of <br />Newport Beach be amended to <br />rAd as follows: <br />"Section 3110. Burning Refuse <br />in Open Air Fires. No building <br />refuse, manufacturing and shop <br />refuse shall be burned in open <br />air fires or incineraters, except <br />the burning of only untreated <br />wood and /or untreated paper <br />products, provided that such <br />burning Is no closer than one <br />hundred feet from any structure. <br />Prior to such burning, written <br />permits must be obtained from <br />the City Fire Department and <br />the Orange County Air Pollution <br />Control District" <br />SECTION 4: That Section 3112 <br />of Chapter 1 of Article III of the <br />Municipal Code of the City of <br />Newport Beach be amended to <br />read as follows: <br />"Section 3112. Camp Fires. No <br />beach or camp fires shall be <br />made, set or maintained at any <br />place within the City of Newport <br />Beach, except as follows: <br />"At areas where proper con- <br />tainers are provided for such <br />fires by the City and where City <br />signs are plainly posted indicat. <br />Ing such fires are permissible. <br />"Beach or camp fires must be <br />within the confines of the fire <br />containers provided by the City. <br />"Such beach or camp fire areas <br />shall be designated by the City <br />Manager, subject to the recom. <br />mendation of the Park, Beaches <br />and Recreation Commission." <br />SECTION 5: This ordinance <br />shall be published at least once <br />in the Newport Harbor Ensign, <br />a newspaper of general circula. <br />tion, printed and published and <br />circulated in the City of Newport <br />Beach and the same shall be in <br />full force and effect 30 days after <br />this passage. <br />The above and foregoing ordi- <br />nance was introduced at a regu. <br />lar meeting of the City Council <br />of the City of Newport Beach <br />held on the 11th day of March, <br />1957, and was finally passed and <br />adopted on the 25th day of <br />March, 1957, by the following <br />vote, to wit: <br />AYES, COUNCILMEN: <br />Hart, Wilder, MacKay, <br />Higbie, Stoddard, <br />Ridderhof, Hill <br />NOES, COUNCILMEN: <br />None <br />ABSENT COUNCILMEN: <br />None <br />DORA O.
