HomeMy WebLinkAbout823 - Service Feesi ORDINANCE NO. 823 AN ORDINANCE OF THE CITY OF NEWPORT BEACH AMEND- ING SECTIONS 7208, 7210, 7211, 7216, 7217, 7218 AND 7221 AND ADDING A NEW SECTION, 7211(a), TO CHAPTER 2 OF ARTICLE VII OF THE MUNICI- PAL CODE The City Council of the City of Newport Beach does ordain as follows: SECTION 1: Section 7208 of the Municipal Code of the City of Newport Beach, entitled "Serv- ice Fees" is hereby amended to read as follows: "Section 7208. Service Fees. The fees for the installation of water services, or for enlarging those already in place, shall be paid in advance and shall be as follows: "(a) For % -inch meter or less ...............- -- .......- -$ 85.00 (b) For 1 -inch meter 110.00 (c) For all other size meters, the installation fee shall be the actual cost to the city, including the cost of the meter, labor and material in laying such service and replacing the pavement, plus 15% of such cost for over- head, plus $25.00. "In the case provided for in sub - paragraph (c) hereof, the cost of material and labor shall be estimated by the Water De- partment and the estimated cost shall be paid to the Water De- partment by the person applying for such installation before the work of connecting the main with the property is begun. Whenever the estimated cost is not sufficient to cover the total expense for labor and material, the deficit shall be charged to the property for which such in- stallation was made and to the owner thereof. Any excess pay- ment shall be returned to the person applying for the installa- tion." SECTION 2: Section 7210 of the Municipal Code of the City of Newport Beach, entitled "Wa- ter Rates" is hereby amended to read as follows: "Section 7210. Water Rates. The water rates to be charged and collected either monthly or bi- monthly, at the discretion of the city, from consumers of water supplied by the City to its in. habitants, are hereby established and the Water Department is hereby authorized and directed to charge and collect the same in accordance with the provisions of this Chapter." SECTION 3: Section 7211 of the Municipal Code of the City of Newport Beach, entitled "Meter' Rates" is hereby amended to read as follows: "Section 7211. Readiness to Serve Charges. Com m July 15, 1957, where water meters have been installed, including future installations, there shall be charged and collected a monthy readiness to serve fee, as follows: "For /4 -inch meter or less --- ------ --------- ------ -----$ 1.75 For 1 -inch meter ............ 2.25 For lY2 -inch meter ........ 3.50 For 2 -inch meter ............ 4.75 For 2Y2 -inch meter ........ 6.00 For 3 -inch meter ............ 7.00 For 4 -inch meter ............ 9.50 For 6 -inch meter ------ - - - - -- 14.00 For 8 -inch meter ............ 18.75 For any size meter not above I' described, the monthly readiness to serve charge may be estab- lished from time to time by reso. lution of the City Council of the City of Newport Beach." SECTION 4: Section 7211 (a) of the Municipal Code of the City of Newport Beach, entitled "Quantity Charges" is hereby added to read as follows: "Section 7211(a). Quantity Charges. Commencing July 15, 1957, in addition to the readiness to serve charges set forth in Sec- tion 7211, where water is fur- nished through a meter, the rate for wafer consumed, other than pursuant to written agreement authorized by the City Council, shall be as follows: To and including 250,000 cu. feet per month ........ $0.14 per 100 cu. ft. The excess of 250.000 cu. ft. to and including 500,000 cu. feet per month -- - - - - -- $0.11 per 100 cu. ft. The excess of 500,000 cu. feet per month -- - - - - -- $0.07 per 100 cu. ft. SECTION 5: Section 7216 of the Municipal Code of the City of Newport Beach, entitled "Turn. on Charges" is hereby amended to read as follows: "Section 7216. Turn -on Charges. When water service to any premises has been turned off be- cause of non - payment of bill or violation of any of the provisions of this Chapter, or ordered turned off by the owner or ten- ant, a turn -on charge shall be made and collected in advance, as follows: "For % -inch meter ..........$ 7.00 For 1 -inch meter ............ 9.50 For 1% -inch meter ........ 14.00 For 2 -inch meter ------ - - - - -- 18.50 For 2%.inch meter ........ 23.50 For 3 -inch meter ------ - - - - -- 28.00 For 4 -inch meter ............ 37.50 For 6 -inch meter ............ 56.00 For 8 -inch meter ------ - - - - -- 74.50 "For any meter not above des- cribed, the turn -on charge may be established from time to time by resolution of the City Coun- cil of the City of Newport Beach." SECTION 6: Section 7217 oP the Municipal Code of the City of Newport Beach entitled "Pay. ment of Water and Meter Charges" is hereby amended to read as follows: "Section 7217. Payment of Wa. ter and Meter Charges. The charges set forth in Section 7211, 7211 (a) and 7216 shall be made against the property, the owner, the tenant and /or the person in possession of the premises in- volved at the discretion of the city." SECTION 7: Section 7218 of the Municipal Code of the City of Newport Beach entitled "Date Payable" is hereby amended to read as follows: "Section 7218. Date Payable. All water users shall be billed bi- monthly and all charges for water shall be payable on the first day of the month following the meter reading date as shown on the bill." SECTION 8: Section 7221 of the Municipal Code of the City of Newport Beach entitled "Ten- ant Deposit" is hereby amended to read as follows: "Section 7221. Tenant Deposit. In the event that the applicant for water service shall not be the owner in fee of the property to be supplied with water, or does not own the improvements there. on, the Water Department shall require a deposit as follows: "For 9'4 -inch meter ----- - - - - -$ 7.00 For finch meter ............ 9.50 For lV2 -inch meter ........ 14.00 For 2 -inch meter ............ 18.50 For 2% -inch meter ........ 23.50 For 3 -inch meter ............ 28.00 For 4 -inch meter ............ 37.50 For 6 -inch meter ............ 56.00 For 8 -inch meter ............ 74.50 "When the foregoing condi- tions are fulfilled, the Water De- partment shall turn on the water for the qualified consumer." SECTION 9: This ordinance shall be published at least once in the Newport Harbor Ensign, a newspaper of general circula- tion, printed and published and circulated in the City of Newport Beach and the same shall be in full force and effect 30 days after this passage. The above and foregoing ordi- nance was introduced at a regu. lar meeting of the City Council of the City of Newport Beach held on the 13th day of May, 1957, and was finally passed and adopted on the 27th day of May, 1957, by the following vote, to wit: AYES, COUNCILMEN: Hart, Wilder, MacKay, H i g b i e, Stoddard, Ridderhof, Hill.
