THE CITY <br />OF NEWPORT BEACH <br />The City Council of the City <br />of Newport Beach does ordain <br />as follows: <br />SECTION 1: That Section <br />9105.4 (h) entitled "Swimming <br />Pools" br added to Chapter 5 of <br />Article IX of the Municipal Code <br />of the City of Newport Beach, <br />to read as follows: <br />"Section 9105.4 (h). Swimming <br />Pools. <br />"(1) Any swimming pool, fish <br />pond or other body of water <br />which contains water eighteen <br />inches (18 ") or morn in depth <br />in R districts shall be at least <br />five feet (51) from any side or <br />rear yard property line and ten <br />feet (10') from any front yard <br />property line. No such swim - <br />ning pool, fish pond or other <br />!body of water shall be permit- <br />ted in any required yard space <br />unless enclosing fence herein- <br />after required is permitted with- <br />in the yard required by Section <br />9105.2 (b) of. the Municipal <br />Code. <br />"Prkrip, filter and heater in- <br />stallation shall be enclosed in a <br />vault of masonry construction <br />and located not less than five <br />feet' (5') from any side or rear <br />yard -property line and in no <br />event nearer than ten feet (10') <br />to any main dwelling on adjoin- <br />ing properties. Pump may be <br />operated only between the hours <br />of 8:00 a.m. and 8:00 p.m. <br />"(2) Fences. Every person <br />owning land on which there is <br />situated a swimming pool, fish <br />pond or other body of water <br />which contains water 18 inches <br />or more in. depth at any point,. <br />shall. erect and - maintain there- <br />on an adequate fence 'sufficient <br />to make such body of water in- <br />accessible to small children. Such <br />fence, including gates therein, <br />must be not less than five feet <br />above the underlying ground; all <br />gates must be, self - latching with <br />latches placed five feet above <br />the underlying ground or other-; <br />wise made inaccessible from the <br />-out-sift to small ch ldreli : . <br />"(3) Time for Compliance. All <br />Ste persons maintaining such pools <br />shall comply with the provisions <br />Df of paragraph (2) of Section <br />;EC 9105.4 (h) of this code within <br />ninety (90) days after the ef- <br />Th fective date of this ordinance. <br />"(4) Modifications. The Plan - <br />ning Commission may permit <br />other protective devices or struc- <br />tures to be used so long as the <br />degree of protection afforded by <br />the substitute devices or strut- <br />turas is not less than the pro- <br />. tection afforded by the fence, ; <br />gate and latch described herein. <br />Upon the application of a prop- . <br />erty owner, the Building Depart- <br />ment may grant extensions of <br />time for compliance, for good <br />cause shown in individual cases. <br />Such extensions shall not ex- <br />ceed thirty (30) days at a <br />time." <br />SECTION 2: Thiy ordinance <br />shall be published at least once <br />in the Newport Harbor News- <br />Press a newspaper of general <br />circulation, printed, published <br />and circulated in the City of <br />Newport Beach and the same <br />shall be in full force and effect <br />30 days after this pasage. <br />The above and foregoing or- <br />dinance was introduced at a <br />regular meeting of the City <br />Council of the City of Newport <br />-Beach held on the 14th day of <br />October, 1957, and was finally <br />passed and adopted on the 28th <br />day of October, 1957, by the <br />following vote. to-wit: <br />AYES, COUNCILMEN; Hart, <br />Wilder.
