Novelnbe.r._1.7....... 19 59 ORDINANCE NO. 834 A-N ORDINANCE OF THEI CITY OF NEWPORT BEACH AMENDING SECTION 8100 h TO PROVIDE FOR THE ADOPTION OF THE UNI- FORM BUILDING CODE, 1955 EDITION; AMENDING SEC- . TIONS 8105, 8106, 8108, 8114 8115 AND 8116 PROVIDED FOR THE FEES AND. IN- SPECTION FOR PLASTER - ING AND CHD}INEY WORK;' ADDING SECTIONS 8100.1. 8100.2, 8100.3 AND 8106.1 AND REPEALING SECTIONS 8103, 8109, 8110. 8111 AND 8112 OF CHAPTER 1 OF ARTICLE VIII OF THE MUNICIPAL CODE OF THE CITY OF NEWPORT BEACH. The City Council of the City of Newport Beach does ordain as follows: SECTION 1: That Sectiont 8100 of Chapter 1 of Article' VIII of the Municipal Code of the City of Newport Beach be and the same is hereby amended to read as follows: "Section 5100. Adoption of Uniform Building Code. That certain document, three copies of which are on file, for the use and examination of the public in the office of the City Clerk, P being marked and designated as 'Uniform Building Code 1955 Edition, published by the Pacific Coast Building Officials Confer- ence.' and the whole thereof, In specifically including all the ap- pendicles theretp, to -wit: Chap- ters 7. 13, 23, 25. 48, 49 and 51, save and except such portions. as are herein deleted, modified' or amended by Section, 8100.1, 8100.1 and 8100.3, be and the same is hereby adopted as the Building Code of the City of Newport Beach for regulating the erection, construction. en -1 largement ,alteration. repair, moving. removal. demolition, conversion, occupancy, equip- ment, use. height ,area. and maintenance of all buildings .and /or structures in the City of Newport Beach; providing for is- suance of permits and collection of fees therefor; providing pen. alties for violation of such code: declaring and establishing fire zones. except as in this code: modified ,amended or otherwise changed; and each and all of the regulations, provisions, pen- alties, conditions and terms of such 'Uniform Building Code, 1955 Edition, published by the Pacific Coast Building Officials Conference) on file in the office of the City Clerk are hereby referred to, adopted and made a part hereof as if fully set out in this code." ' SECTION 2. That Section - 8100.1 and 8100.2 and 8100.3 be added to Chapter 1 of Article VIII of the Municipal Code of the City of Newport Beach to read as follows: "Section 8100.1 Amendment to Section 1709 of the Uniform Building Code. Section 1709 of the Uniform Building Code, 19551 Edition, is amended to read as( "PARAPETS. "Section 8100.2 Amendment to Section 3302 (b) of the Uni- form Building Code. Section '3302 (b) of the Uniform Build. ;Ing Code. 1955 Edition. is amended to read as follows: "(b) Number of Exits. Not less than two (2) exits shall be; provided from buildings or por- tions thereof housing Croup D,• E. H and I occupancies having an occupant load of more than ten (10); or housing Croup F occupancies having „aa,;.O�upant cad o more than thirty (30); or housing Croup A, B, C, and G occupancies having occupant load of more than fifty (50); Group C and D occupancies more than one (1) story in height shall have not -less than ,.two (2) exits, remotely located :from each other, from ?esch.fleor. "Buildings, or portions thereof, having an occupant load of 500 to 999 shall have not less than three (3) exits. "Buildings, or portions there- of, having an occupant load of 1,000 or more shall have not s than four (4) exits. loom above the first floor, basements or cellars used; for other than service of the building, shall have not less than two (2) exits. "Exception: Only one (1) exit need be provided for an upper floor in a Croup I occupancy, or from a second floor or mez -' zanine having an area of not more than five hundred square 'feet (500 sq. ft.) in a Croup F� or C occupancy." "Section 8100.3 Amendment to, Section 304 (e) of the Uniform, Building Code. Section 304 (e) of the Uniform Building Code, 1955 'Edition, is amended to read as follows: "(e) Other Inspections. In ad- dition to the called inspections specified above, the Building. Official may make any other inspections of- any construction work to ascertain compliance with the provisions of this Code and other laws which are en. forced by the Department of Building and Safety. "Any additional inspection for any cause may be charged for at the rate of Five Dollars per, inspection and when any, changes or alterations ordered• are completed, notice of com -' tion of such work shall be n to the Building Inspector re- inspection requested; pro. vided, however, that where the character of . construction is; such that one inspection is not sufficient, additional inspection$ shall be made as the work pro. greases without. payment of ad- ditional fees. Permit for Plastering. A permit from the ctor of Building and Safety be required for the doing o any plastering or lathing in, or upon any building or strue- lture where the cost of the work, exceeds Twenty -five Dollars." SECTION 5: That Section 8106 of Chapter 1 of Article VIII of the Municipal Code of the City of Newport Beach be and the same is hereby amended to read as follows: "Section 8106. Fees. SECTION 6: That Section 8106.1 be added to Chapter 1: of Article VIII of the Municipal! Code of the City of Newport Beach to read as Yollow's: "Section 8106.1. Inspection) The Building Inspector, upon no- tification from the permit hold- er, shall make an inspection of the rough and finish work. Any additional inspection for any cause may be, charged Yor at the rate of Five Dollars per in- spection and when any changes or alterations ordered are pleted, notice of completion oY. such work shall be given to the 'Building Inspector and re-in - spection requested; provided,' however, that where the charac- ter of construction is such that one inspection is not sufficient,' additional inspections shall be made as the work progresses without payment of additional "Requests for inspection shall indicate the kind of inspection to be made; such as rough or finish, and shall identify the job by owner's name and permit number or by the name of the owner and a description of the location of the work. "Inspection will be made when; possible within forty -eight (48) hours, Saturdays, Sundays and holidays excepted, after notice', of inspection is received by the, Building Inspector. "Failure to inspect following otice as above required shall be reported to the Director of Building and Safety for imme- diate attention." SECTION 7: That Section 8108 of Chapter 1 of Article VIII of the Municipal Code of, the City of Newport Beach be and the same is hereby amended to read as follows: "Section 8108. Tile or Marble Setting Contractor. No person shall do any tile or marble set- ting in, or upon any building or structure unless the person do- ing such work is duly licensed under the provisions of this Code' to engage in the business of the or marble setting." SECTION 8: That Sections 8109, 8110, 8111 and .8112 of Chapter 1 of Article VIII of the Municipal Code of the City of Newport Beach be, and the same are hereby repealed. SECTION 9: That Section 1 8114 of Chapter 1 of Article f VIII of the Municipal Code of II the City of Newport Beach be, t and the same is, hereby amend-!' ad to read as follows: I' "Section 8114. Permit For Chimney Construction. A permit from the Director of Building and Safety shall be required for the doing of any chimney con- struction in, or upon, any build- ing or structure where the cost of the work exceeds Ten Dol. lars." SECTION 10: That Section i 8115 of Chapter I of Article.; VIII of the Municipal Code of the City of Newport Beach be, and the same is, hereby amend- ed to read as follows: "Section 8115. Fees. The fees to be paid to the Director of Building and Safety for the is- suance of a permit for each building on which. chimney con- struction is to be made, shall be Ono Dollar per chimney. In the event said permit shall not' be applied for before said work is commenced, a charge of Ten' Dollars Shall be paid for the j Issuance of each permit." SECTION 11: That Section 8116 of Chapter 1 of Article VIII of the Municipal Code of the City of Newport Beach be and the same is hereby, amend- ed to read as follows: 'Section 8116. Inspection. The Building Inspector upon notifica- tion of the permit holder, shall inspect the reinforcing, rough and finish work of said chimney. The Building Inspector at the time of said inspection shall either approve said chimney construction as complying with the Building Code, or the Build- ing Inspector shall notify the permit holder wherein the work fails to comply with said Build- ing Code, and no mantel shall be built or constructed on said chimney until approved by the Building Inspector. "Any additional inspections Yor .any cause may be charged for $,the rate of Five Dollars 155.001 per inspection and when 'any changes or alterations or- dered are completed, notice of .completion of such work shall be given to the Building Inspee- 'tor and re- inspection requested; provided, however, that where the character of construction is such that one inspection is not sufficient, additional inspection shall be made as the %vork progresses without payment of additional fees. "Requests for inspection shall indicate the kind of inspection to be -made; such as reinforcing, rough or finish and .shall identi- fy the job by owner's name and permit number or by the name of the owner and a description of the location of the work. 'Ynspection will be made when possible within forty -eight (48) hours, Saturdays, Sundays and holidays excepted, after notice of inspection is received by the Building Inspector. "Failure to inspect following notice as above required shall be reported to the Director of Building and Safety for imme- diate attention." SECTION 12: This ordinance shall be published at least once in the Newport Harbor News Press, a newspaper of, general circulation, printed and publish. ed and circulated in the City of Newport Beach and the Same shall be in full force and effect 30 days after this passage. The above and foregoing ordi. nance was introduced at a regal. lar meeting of the City Council of the City of Newport Beach held on the 10th day of Septem. ber, 1957, and was finally passed and adopted on the 14th day of October, 1957, by the following vote, to -wit: AYES, Councilmen: Hart, Wilder, MacKay, Stoddard, Higbie, Ridderhof, Hill.
