0 <br />l <br />ORDINANCE NO. 923 <br />AN ORDINANCE OF THE CITY <br />OF NEWPORT BEACH ADD- <br />ING SECTIONS 8150 AND 8151 <br />TO THE NEWPORT BEACH <br />MUNICIPAL CODE RELATING <br />TO SWIMMING POOLS <br />The City Council of the City of <br />Newport Beach does ordain as <br />follows: <br />SECTION 1. Section 8150 is <br />added to the Newport Beach Mu. <br />nicipal Code to read: <br />"SECTION 8150. S W I M - <br />MING POOLS. FENCES. No <br />person shall construct, use, <br />permit, maintain, operate or <br />control any swimming pool, <br />fish pond, or other body of <br />water eighteen (18) or more <br />inches in depth on any land <br />owned by him or under his <br />possession or control without <br />erecting and maintaining a <br />fence to make such body of <br />water inaccessible to small <br />children. Such fence, includ. <br />ing all gates, must be not <br />less than five (5) feet above <br />the underlying ground. All <br />gates must be self - closing <br />and self - latching, with the <br />latches not less than five (5) <br />feet above the underlying <br />ground or constructed in a <br />way so they cannot be open- <br />ed from the outside by chil- <br />dren. No such fencing shall <br />be required on land used for <br />any hotel, motel, apartment <br />house, club or trailer park <br />consisting of ten (10) or <br />more units Where the owner <br />of such use or an employee <br />thereof is on duty on such <br />land twenty -four (24) hours <br />each day. This does not re- <br />quire fencing any body of <br />water which forms a part of <br />Newport Bay. <br />The Director of Building <br />and Safety may permit other <br />protective devices or struc- <br />tures to be used so long as <br />the degree of protection af. <br />forded by the substitute de. <br />vices or structures is not less <br />than the protection afforded <br />by the fence as required <br />herein." <br />�, SECTION 2. Section 8151 is <br />added to the Newport Beach Mu- <br />nicipal Code to read: <br />.'SECTION 8151. S W I M - <br />-=NG POOLS. PUMP, FIL- <br />TER, HEATER. (a) No person <br />shall construct, use, permit, <br />;y v <br />maintain, operate, or control <br />any pump, filter, or heater <br />to serve any swimming pool, <br />fish pond, or other body of <br />water eighteen (18) or <br />more inches in depth on any <br />land owned by him or under <br />his possession or control un- <br />less any such pump or filter <br />be installed in tight housing <br />of one - hour fire - resistant <br />construction with solid core <br />wood lid or door not less <br />than one and three - quarters <br />(13/4) inches thick, and un- <br />less such pump, filter, the <br />housing therefor, and any <br />heater serving such body of <br />water, be set upon and an- <br />chored to monolithic concrete <br />foundation not less than six <br />(6) inches thick. <br />(b) Such pump, filter, the <br />housing therefor, and any <br />such heater may be installed <br />in a garage or any accessory <br />building and may be so in- <br />stalled without providing <br />said housing when the walls <br />and ceiling of such garage <br />or accessory building are of <br />one-hour fire - resistant con- <br />struction; provided, however, <br />that any such installation <br />shall be adequately guarded <br />against mechanical injury <br />and shall be so located as <br />not to impair any required <br />parking area in a garage, <br />and any such heater shall be <br />adequately guarded against <br />contact with combustible <br />materials." <br />SECTION & This ordinance <br />shall be published once in the <br />official newspaper of the City, <br />and the same shall be effective <br />30 days after the date of its <br />adoption. <br />This ordinance was introduced <br />at a regular meeting of the City <br />Council of the City of Newport <br />Beach held on the 13th day of <br />June, 1960, and was adopted on <br />the 11th day of July, 1960, by the <br />following vote, to wit: <br />AYES, COUNCILMEN: Hart, <br />Lorenz, Somers, Kingsley, <br />Atkinson, Cook. <br />NOES, COUNCILMEN: None. <br />ABSENT COUNCILMEN: <br />Stoddard. <br />CHARLES E.
