ORDINANCE NO. 924
AN ORDINANCE OF THE CITY
OF NEWPORT BEACH RE-
PEALING SECTION 9105.4(h)
OF THE NEWPORT BEACH
MUNICIPAL CODE AND ADD-
ING SECTION 9105.41 TO SAID
CODE RELATING TO SWIM-
MING 'POOLS
The City Council of the City
of Newport Beach does ordain as
follows:
SECTION 1. Section 9105.4(h)
of the Newport Beach Municipal
Code is repealed.
SECTION 2. Section 9105.41 is
added to the Newport Beach Mu-
nicipal Code to read:
"SECTION 9105.41. YARDS -
SWIMMING POOLS. (a) Any
swimming pool, fish pond, or
other body of water which
contains water eighteen (18)
inches or more in depth for
use in connection with any
single family, duplex, multi-
ple or apartment dwelling,
shall be at least five (5) feet
from any side or rear yard
property line and ten (10)
feet from any front yard
property line. No such body
of water shall be permitted
in any required yard space
unless the enclosing fence
required in Section 8150 of
this Code is permitted under
the provisions of Section
9105.2(b).
(b) Any pump, filter, or
i
heater installed to serve
such body of water shall be
located not less than five (5)
feet from any side or rear
yard property line and in no
event nearer than ten (10)
feet to any dwelling on ad-
joining properties. Any such
pump, filter, or heater shall
not be considered an acces-
sory building so long as any
required housing therefor
does not exceed six (6) feet
in height. Pump may be op-
erated o n 1 y between the
hours of 8 A.M. and 8 P.M."
SECTION 3. This ordinance
shall be published once in the
official newspaper of the City,
and the same shall be effective
30 days after the date of its
adoption.
This ordinance was introduced
at a regular meeting of the City
Council of the City of Newport
Beach held on the 13th day of
June, 1960, and was adopted on
the 11th day of July, 1960, by
the following vote, to wit:
AYES, COUNCILMEN: Hart,
Lorenz, Somers, Kingsley,
Atkinson, Cook.
NOES, COUNCILMEN: None.
ABSENT COUNCILMEN:
Stoddard.
