7 <br />Ll <br />J <br />ORDINANCE NO. 924 <br />AN ORDINANCE OF THE CITY <br />OF NEWPORT BEACH RE- <br />PEALING SECTION 9105.4(h) <br />OF THE NEWPORT BEACH <br />MUNICIPAL CODE AND ADD- <br />ING SECTION 9105.41 TO SAID <br />CODE RELATING TO SWIM- <br />MING 'POOLS <br />The City Council of the City <br />of Newport Beach does ordain as <br />follows: <br />SECTION 1. Section 9105.4(h) <br />of the Newport Beach Municipal <br />Code is repealed. <br />SECTION 2. Section 9105.41 is <br />added to the Newport Beach Mu- <br />nicipal Code to read: <br />"SECTION 9105.41. YARDS - <br />SWIMMING POOLS. (a) Any <br />swimming pool, fish pond, or <br />other body of water which <br />contains water eighteen (18) <br />inches or more in depth for <br />use in connection with any <br />single family, duplex, multi- <br />ple or apartment dwelling, <br />shall be at least five (5) feet <br />from any side or rear yard <br />property line and ten (10) <br />feet from any front yard <br />property line. No such body <br />of water shall be permitted <br />in any required yard space <br />unless the enclosing fence <br />required in Section 8150 of <br />this Code is permitted under <br />the provisions of Section <br />9105.2(b). <br />(b) Any pump, filter, or <br />i <br />heater installed to serve <br />such body of water shall be <br />located not less than five (5) <br />feet from any side or rear <br />yard property line and in no <br />event nearer than ten (10) <br />feet to any dwelling on ad- <br />joining properties. Any such <br />pump, filter, or heater shall <br />not be considered an acces- <br />sory building so long as any <br />required housing therefor <br />does not exceed six (6) feet <br />in height. Pump may be op- <br />erated o n 1 y between the <br />hours of 8 A.M. and 8 P.M." <br />SECTION 3. This ordinance <br />shall be published once in the <br />official newspaper of the City, <br />and the same shall be effective <br />30 days after the date of its <br />adoption. <br />This ordinance was introduced <br />at a regular meeting of the City <br />Council of the City of Newport <br />Beach held on the 13th day of <br />June, 1960, and was adopted on <br />the 11th day of July, 1960, by <br />the following vote, to wit: <br />AYES, COUNCILMEN: Hart, <br />Lorenz, Somers, Kingsley, <br />Atkinson, Cook. <br />NOES, COUNCILMEN: None. <br />ABSENT COUNCILMEN: <br />Stoddard. <br />CHARLES E.
