11 <br />i. <br />ORDINANCE NO. 932 <br />AN ORDINANCE OF THE CITY <br />OF NEWPORT BEACH ADD. <br />ING SECTIONS 9105.9 AND <br />9105.91 TO AND AMENDING <br />SECTIONS 9107.43, 9107.44, <br />AND 9107.45 OF THE NEW- <br />PORT BEACH MUNICIPAL <br />CODE RELATING TO PLAN- <br />NING AND ZONING <br />The City Council of the City <br />of Newport Beach does ordain as <br />follows: <br />SECTION 1. Section 9105.9 is <br />added to the Newport Beach Mu. <br />nicipal Code to read: <br />"SECTION 9105.9. OFFI- <br />CIAL PLAN LINE — MASTER <br />STREET A N D HIGHWAY <br />PLAN. (a) For the purposes <br />of this Article, 'mapped <br />highway' shall be any sec- <br />ondary, primary, or major <br />highway, whether existing or <br />proposed, shown on map en- <br />titled 'Master Plan, City of <br />Newport Beach, California, <br />Street and Highway', adopt- <br />ed by City Council Resolu- <br />tion No. 5224 on April 25, <br />1960, and all amendments <br />thereafter and hereafter <br />adopted thereto; 'center line <br />shall be either (1) a line <br />midway between the proper- <br />ties abutting the right of <br />way of a mapped highway <br />or (2) a line, if any, shown <br />as such on a map entitled <br />'Precise Plan of Highway <br />Alignment' and any amend. <br />ments thereto (in the event <br />of conflict between (1) and <br />(2), the line described in (2) <br />shall govern); 'official plan <br />line' shall be either (1) a <br />line at the herein required <br />distance from the center line <br />of any mapped highway, on <br />each side thereof, or (2) a <br />line, if any, shown as such <br />on a map entitled 'Precise <br />Plan of Highway Alignment' <br />and any amendments there- <br />. to (in the event of conflict <br />'between (1) and (2), the <br />line described in (2) shall <br />govern). <br />(b) Official plan line for <br />real property abutting a <br />mapped highway in the City <br />of Newport Beach, measured <br />from the center line of said <br />highway, shall be as fol- <br />lows: <br />(1) Forty -two (42) feet for a <br />secondary street or high- <br />way. <br />(2) Fifty (50) feet for a pri- <br />mary street or highway. <br />(3) Sixty (60) feet for a ma- <br />jor street or highway. <br />(c) No building shall be <br />erected, constructed, moved, <br />or structurally altered so as <br />to be closer to the center <br />line of a mapped highway <br />than the official plan line <br />applicable thereto. Yards <br />where required by this Arti. <br />cle shall be determined in <br />accordance with Section <br />9105.4(d)." <br />SECTION 2. Section 9105.91 is <br />added to the Newport Beach Mu- <br />nicipal Code to read: <br />"SECTION 9105.91. OFFI- <br />CIAL PLAN LINE — MASTER <br />STREET A N D HIGHWAY <br />PLAN — EXCLUSIONS. The <br />hereinafter, described por- <br />tions of mapped highways <br />shall be excluded from the <br />provisions of Section 9105.9: <br />(1) B a l b o a Boulevard be. <br />tween 45th a n d 32nd <br />Streets. <br />(2) B a l b o a Boulevard be- <br />tween Alvarado Street <br />and Gib Street. <br />(3) Newport Boulevard be- <br />tween 30th Street and <br />McFadden Place. <br />(4) Irvine Avenue between <br />Westcliff Drive and Cliff <br />Drive. <br />(5) Dover D r i v e between <br />Westcliff Drive and <br />Coast Highway. <br />(6) Marguerite Avenue be- <br />tweer, 5th Avenue and <br />Ocean Boulevard; <br />provided, however, that in <br />the event an official plan <br />line is shown as such on a <br />map entitled 'Precise Plan of <br />Highway Alignment' for any <br />portion described above, then <br />ORDINANCE 932 —PAGE 1 <br />
