HomeMy WebLinkAbout941 - Impounding Fowl & Animals0 ORDINANCE NO. 941 AN ORDINANCE OF THE CITY OF NEWPORT BEACH AMENDING SECTIONS 4108, 4114, AND 4115 OF THE NEW- PORT B A C H MUNICIPAL CODE RELATING TO IM- POUNDING FOWL AND ANI- MALS The City Council of the City of Newport Beach does ordain as follows: SECTION 1. Section M08 of the Newport Beach Municipal Code is amended to read: "SECTION 4105. Impounding Fowl, Dogs, or Other Animals. All dogs, fowl, or other animals found running at large on the streets, alleys, parks, beaches or other public ,places in the City shall be impounded. If a dog is picked up which is properly tagged, notice shall at once be given either personally or by postcard to the owner of such dog that such dog is impound- ed. If such dog is not properly tagged, or if any fowl or other animal is impounded, written notice that such dog, fowl or animal is impounded shall be given by posting a notice there- of on the bulletin board in the City Hall. Such notice shall con- tain a brief description of such dog, fowl or animal and shall contain a statement to the ef- fect that if such dog is not re- deemed and the license paid, if such license is due, or as to any fowl or other animal, if such fowl or animal is not re- deemed within three days, such dog, fowl or animal shall be deemed abandoned and shall become the property of the City, and will be destroyed or sold. Food and water shall be provid. ed for such dogs, fowl or ani- mals during the time that the same are impounded." SECTION 2. Section 4114 of the Newport Beach Municipal Code is amended to read: "SECTION 41.14. Fees for Im- ,.pounding. The impounding fee for each dog impounded under the terms of this Code shall be Three Dollars; the impounding fee for any cat impounded under the terms of this Code shall be One Dollar; the impounding fee for any other animal impounded under the terms of this Code, weighing under one hundred pounds, shall be Three Dollars; and the impounding fee for any other animal not otherwise here. in provided, weighing in excess of one hundred pounds, shall be Five Dollars. The fee for any bird or fowl impounded under the terms of this Code shall be One Dollar." SECTION 3. Section 4115 of the Newport Beach Municipal Code is amended to read: "SECTION 4115. Boarding Charges. A daily charge shall be made for boarding any bird, fowl, dog, cat or other animal impounded under the provisions of this Code. Such charge shall be estab- lished by the City Council by resolution." SECTION 4. This ordinance shall be published once in the official newspaper of the City, and the same shall be effective 30 days after the date of its adoption. This ordinance was introduced at a regular meeting of the City Council of the City of Newport Beach held on the 26th day of September, 1960, and was adopt- ed on the 10th day of October, 1960, by the following vote, to wit: AYES, COUNCILMEN: Kingsley, Atkinson, Cook, Stoddard, Hart, Lorenz, Som- ers.
