0 <br />ORDINANCE NO. 941 <br />AN ORDINANCE OF THE CITY <br />OF NEWPORT BEACH <br />AMENDING SECTIONS 4108, <br />4114, AND 4115 OF THE NEW- <br />PORT B A C H MUNICIPAL <br />CODE RELATING TO IM- <br />POUNDING FOWL AND ANI- <br />MALS <br />The City Council of the City <br />of Newport Beach does ordain <br />as follows: <br />SECTION 1. Section M08 of <br />the Newport Beach Municipal <br />Code is amended to read: <br />"SECTION 4105. Impounding <br />Fowl, Dogs, or Other Animals. <br />All dogs, fowl, or other animals <br />found running at large on the <br />streets, alleys, parks, beaches or <br />other public ,places in the City <br />shall be impounded. If a dog <br />is picked up which is properly <br />tagged, notice shall at once be <br />given either personally or by <br />postcard to the owner of such <br />dog that such dog is impound- <br />ed. If such dog is not properly <br />tagged, or if any fowl or other <br />animal is impounded, written <br />notice that such dog, fowl or <br />animal is impounded shall be <br />given by posting a notice there- <br />of on the bulletin board in the <br />City Hall. Such notice shall con- <br />tain a brief description of such <br />dog, fowl or animal and shall <br />contain a statement to the ef- <br />fect that if such dog is not re- <br />deemed and the license paid, <br />if such license is due, or as to <br />any fowl or other animal, if <br />such fowl or animal is not re- <br />deemed within three days, such <br />dog, fowl or animal shall be <br />deemed abandoned and shall <br />become the property of the City, <br />and will be destroyed or sold. <br />Food and water shall be provid. <br />ed for such dogs, fowl or ani- <br />mals during the time that the <br />same are impounded." <br />SECTION 2. Section 4114 of the <br />Newport Beach Municipal Code <br />is amended to read: <br />"SECTION 41.14. Fees for Im- <br />,.pounding. The impounding fee <br />for each dog impounded under <br />the terms of this Code shall be <br />Three Dollars; the impounding <br />fee for any cat impounded under <br />the terms of this Code shall be <br />One Dollar; the impounding fee <br />for any other animal impounded <br />under the terms of this Code, <br />weighing under one hundred <br />pounds, shall be Three Dollars; <br />and the impounding fee for any <br />other animal not otherwise here. <br />in provided, weighing in excess <br />of one hundred pounds, shall be <br />Five Dollars. The fee for any <br />bird or fowl impounded under <br />the terms of this Code shall be <br />One Dollar." <br />SECTION 3. Section 4115 of <br />the Newport Beach Municipal <br />Code is amended to read: <br />"SECTION 4115. Boarding <br />Charges. A daily charge shall be <br />made for boarding any bird, <br />fowl, dog, cat or other animal <br />impounded under the provisions <br />of this Code. <br />Such charge shall be estab- <br />lished by the City Council by <br />resolution." <br />SECTION 4. This ordinance <br />shall be published once in the <br />official newspaper of the City, <br />and the same shall be effective <br />30 days after the date of its <br />adoption. <br />This ordinance was introduced <br />at a regular meeting of the City <br />Council of the City of Newport <br />Beach held on the 26th day of <br />September, 1960, and was adopt- <br />ed on the 10th day of October, <br />1960, by the following vote, to <br />wit: <br />AYES, COUNCILMEN: <br />Kingsley, Atkinson, Cook, <br />Stoddard, Hart, Lorenz, Som- <br />ers. <br />NOES, COUNCILMEN: none. <br />ABSENT COUNCILMEN: <br />none. <br />JAMES B.
