Nota Publ ic in County of Orange, State of California. ... � ray. so. me., ORDINANCE NO. 1016 AN ORDINANCE OF THE CITY OF NEWPORT BEACH AMEND- ING AND ADDING CERTAIN SECTIONS TO ARTICLE IX, "PLANNING AND ZONING", OF THE NEWPORT BEACH MUNICIPAL CODE The City Council of the City of Newport Beach does ordain as follows: SECTION 1. Section 9103.481 of theNewport Beach Municipal Code is amended to read: "Section 9103.481. Uses Permitted: (a) Professional offices, com- munity centers, social halls, lodges and clubs. (b) Retail stores and personal service establishments within a building, including appli- ance stores, bakeries (not wholesale ), banks, barber shops, beauty parlors, book stores, department stores, drug stores, food shops, hardware stores, nurseries, offices, rad- io stores, restaurants, antique shops, shoe shops, studios, tailor shops, and other uses which in the opinion of the Planning Commission are of a similar nature. (c) One non - flashing sign appurtenant to any permitted use and not over thirty -five (35) square feet in area for each side (if two sides are used). " SECTION 2. Section 9103. 481. 1 is added to the Newport Beach Municipal Code to read: "SECTION 9103.481.1. Uses permitted, subject to first securing a Use Permit in each case: - (a) Gasoline service stat- ions. " SECTION 3. Section 9103. 492 of the Newport Beach Muni- cipal Code is amended to read: "SECTION 9103.492. Uses permitted, subject to first se- curing a Use Permit in each case: (a) Light manufacturing, including repair of boats, and other uses which in the opinion of the Planning Commission are of a similar nature. (b)Gasoline service stations.. (c) Signs, other than those appurtenant to any permitted use. " SECTION 4. Section 9103. 51 of the Newport Beach Municipal Code is amended to read: "SECTION 9103.51. Uses Permitted: (a) Professional offices, community centers, social halls, lodges and clubs. (b) Retail storesand person- al service establishmeau with- in a b irdJng, including appli- ance stores, bakeries (riot wholesale ), banks, barber shops, beauty parlors, book stores, department stores , drug stores, food shops, hard- ware stores, nurseries, offices, radio stores, restaurants, an- tique shops, shoe shops, stud- ios, tailor shops, and other uses which in the opinion of the Planning Commission are of a similar nature. (c) Signs appurtenant to any permitted use. " SECTION 5. Section 9103.52 of the Newport Beach Municipal Code is amended to read: 'SECTION 9103.52. Uses, permitted, subject to first se- curing a Use Permit in each case: (a) Animal hospitals, auto sales and repair shops, boat sales, gasoline service stat- ions, marine service stations, cleaning establishments, lau- ndries, launderettes, mort- uaries, outdoormarkets, who- lesale stores, outdoor sales establishments, pet shops, public garages, trailer courts, theatres, used car sales lots and other uses which in the opinion of the Planning Com- mision are of a similar nature. (b) Handicraft enterprises, including the manufacturing and, repair of household furn- ishings, clothing, ceramics, novelties and toys, and uses ORDINANCE 1016 -- Page 1 r • A r -1 LJ which in the opinion of the Planning Commission are of a similar nature. (c) Hotels, motels, board- ing houses and residential uses. (d) Signs, other than those appurtenant to any permitted use, including billboards. " SECTION 6. Section 9103.62 of the Newport Beach Municipal Code is amended to read: "SECTION 9103.62. Uses permitted, subject to first se- curing a Use Permit in each case: (a) Lumber yards, light manufacturing, including ma- nufacture and repair ct beats: clothing, novelties and toys, gasoline service stations, and uses which in the opinion of the Planning Commission are of a similar nature. (b) Hotels, motels, residen- tial uses and trailer courts. (c) Signs, other than those appurtenant to any permitted use. " SECTION 7. Section 9103. 72 of the Newport Beach Municipal Code is amended to read: "SECTION 9103.72. Uses permitted, subject to first se- curing a Use Permit in each case: (a) Gasoline service stat- ions, and fish smoking, curing or freezing. (b) Signs, other than those appurtenant to any permitted use, including billboards. " SECTIONS. Section 9103. 92 ofthe Newport Beach Municipal Code is amended to read: "SECTION 9103.92. Uses permitted, subject to first se- curing a Use Permit in each case from the Planning Com- mission. Said uses must com- ply with the limitations and restrictions of the M -1 -A District: Furniture upholstering, furn- iture manufacturing, finished paper products, assembling and construction of paper pro- ducts with finished paper stock, garment manufacturing, boat building within a building, laundry and dry cleaning plants, gasoline service stat- ions, manufacture of novel - ties, toys and small appli- ahces, medical and dental offices and clinics, other uses which in the opinion of the Planning Corn mission are com- parable and similar in char- acter with the uses permitted in the District and which com- ply with the limitations and restrictions specified in the M -1 -A District. " SECTION 9. This ordinance shall be published once in the official newspaper of the City, and the same shall be effective 30 days after the date of its adoption. Thisordinance was introduced at a regular adjourned meeting of the City Council of the City of Newport Beach held on the 29thdayof October, 1962, - and was adopted on the 13th day of November, 1962, by the follow- vote, to wit: AYES, COUNCILMEN: Stoddard..
