TION NO. 55" WHEREAS, pursuant to the provi- sions of an act of the Legislature of the State of California, known as the "Annexation of Uninhabited Territory Act of 1939 ", the City of Newport Beach Instituted proceedings for the annexa- tion of certain uninhabited territory contiguous to the City of Newport Beach and designated as "Annexation No. 55 ", and which Is hereinafter more Particularly described; and WHEREAS, the City Council of the City of Newport Beach has determined in accordance. -with the Annexation of Uninhabited Territory Act of 1939 the ownership of the properly in the afore- said territory proposed to be annexed; and W18EREAS, the owners of more than two-thirds 'of the value of the properly in the said territory have tiled written consent with the City Clerk of the City of Newport Beach "prior to the adoption of this ordinance, whereby consent was given to the annexation of said Annexa- tion No. 55 to we City of Newport Beach and that the property in said territory be sublecied to taxation after annexation equally with property in the City of Newport Beach to pay any indebtedness and liabilities of the City of Newport Beach outstanding, con- tracted, authorized, or existing prior to or at the time of annexation; and WHEREAS, the City Council, by the adoption of a resolution within ten days after the hearing on protests to the annexation was finally adjourned, has found and declared that a majority Protest to the annexation was not made; and WHEREAS, it appears that the nec- essary proceedings relating to annexa- tion have been conducted strictly in ac- cordance with the law; NOW, THEREFORE-,r the City Council Of the City of Newport Beach does or- dain as follows: SECTION 1.
