DNS 4771 THROUGH 4996 OF,
AND ADDING NEW SECTIONS 4771
THROUGH 4774 TO, THE NEWPORT
BEACH MUNICIPAL CODE RELAT-
ING TO CURFEW HOURS FOR mi.
NORS
The City Council of the City Of New -
Port Beach does ordain as follows:
SECTION 1. Sections 4771 through
4226 of the Newport Beach Municipal
Code are hereby repeated.
SECTION 2. A new Section 4221 Is
added to the Newport Beach Municipal
Code to read:
"SECTION 4221. Minor Defined. For
the Purpose of sections 4223 and 4224,
any Person under the age of eighteen
(18) years shall be deemed a minor."
SECTION 3. A new Section 4222 Is
added to the Newport Beach Municipal
Code to read:
"SECTION 4277. Service and Mar-
ried Persons Excepted. Provisions of
Sections 4223 and 4224 shall not apply
to any minor in the military service
of the United States or any minor
legally married."
SECTION 4. A new section 4223 is
added to the Newport Beach Municipal
Code to read:
"SECTION 4773. Curfew Hours. It
shall be unlawful for any minor to
loiter, wander, or Play In or upon
the Public streets, alleys, Parks, Play-
grounds or Other Public Places or
Places of amusement or entertain-
ment, vacant lots or other unsuper-
vised Places or trespass on Private
Property between the hours of 10 P.M.
and 6 A.M. of the following day; Pro-
vided, however, that the Provisions of
this section shall not apply to a minor
accompanied by his or her parent,
.guardian, or Other adult Person having
the care and custody of said minor
or to a minor upon an emergency er-
rand at the direction of such Parent,
guardian, or adult Person, or to a mi-
nor engaged In an employment which
makes it necessary for such minor
to be on the streets durh,g the above

"SECTION 4224. Enforcement. Every
Police officer is hereby authorized and
empowered to demand from any Per-
son who he has reasonable cause to
belle" is In violation of Section 4773
that such Person give his or her
name, address, Proof of age, the name
of Parent, guardian air adult having
care or custody of such Person if a
minor as herein defined, and other
information reasonably necessary to
determine whether such violation
exists.
Any such minor found to be in vio-
lation of the provisions of Section 4273
may be taken Into custody by such
officer and thereafter may be re-
leased to the Parent, guardian or other
adult Person having the care and cus-
tody of such minor or may be dealt
with in accordance with the Juvenile
Court Law of the State. The refusal
or failure of any such Parent, guard-
ian or adult Person to assume cus-
tody and control of such minor or to
take such mirror home when requested
to do so by any Police officer Is here-
by declared to be a misdemeanor."
SECTION 6. This ordinance shall be
published once In the official newspaper
Of the City, and the same shall be af-
fective 30 days after the date of Its
adoption.
This ordinance was Introduced at a
regular meeting of the City Council W
the City of Newport Beach held on the
27th day of January, 1964, and was
adopted on the 23d day of March, 1964
by the following vote, to wit:

Hart, Lorenz, Marshall
NOES, COUNCILMEN: Cook
ABSENT, COUNCILMEN: Gruber,
Elder.
