AN ORDINANCE OF THE
CITY OF NEWPORT BEACH
AMENDING SECTION 9255.28
(a) OF THE NEGPORT BEACH
MUNICIPAL CODE RELATING
TO UNDF. RG ROUND UTILITIES
The City Council of the City
of Newport Beach does ordain
as follows:
SECTION 1. Section 9255.28
(a) of the Newport Beach Munici.
pal Code is amended to read:
"SECTION 9255.28(a). Under-
ground Utilities. Utility lines,
including but not limited to
electric, communications, and
cable television, shall be re-
quired to be placed under-
ground. The subdivider shall
make the necessary arrange-
ments with the utility com-
panies for the installation of
such facilities. For the pur-
pose of this section, appur-
tenances and associated equip-
ment such as, but not limited
to, surface mounted trans-
formers, pedestal mounted ter-
minal boxes and meter cabin-
ets, and concealed ducts in an
underground system may be
placed aboveground. The lo-
cation of such facilities in the
public right of way shall be
subject to the approval of the
City Engineer. The City Coun-
cil upon the recommendation

may waive the requirements of
this section if topographical,
soil or any other conditions
make such underground instal-
lations unreasonable or im.
practical.
This section shall not apply
to utility lines which do not
provide service to the area
being subdivided."
SECTION 2. This ordinance
shall be published once in the
official newspaper of the City,
and the same shall be effective
30 days after the date of its
adoption.
This ordinance was introduced
at a regular meeting of the City
Council of the City of Newport
Beach held on the 8th day of
November, 1965, and was adop-
ted on the 22nd day of Novem.
