ORDINANCE NO. 1163
AN ORDINANCE OF THE CITY OF NEWPORT BEACH ADDING
SECTIONS 4254 THROUGH 4259 TO THE NEWPORT BEACH
MUNICIPAL CODE RELATING TO THE LICENSING OF
SURFBOARDS
The City Council of the City of Newport Beach does ordain
as follows-
SECTION 1. Section 4254 is added to the Newport Beach
Municipal Code to read-
"SECTION 4254. Surfboards - Licenses Required.
No person shall have in his possession or use any surf-
board on any beach or in the ocean within the City which has
not been licensed as required by this chapters Any person
engaged in the business of renting surfboards within the
City shall obtain a license for each surfboard used in such
business. As used in this section, the term 'surfboard'
shall mean any surfboard, paddleboard or similar device made
of any hard material or substance which exceeds forty - eight
(48) inches in. length.A°
SECTION 2. Section 4255 is added to the Newport Beach
Municipal Code to reads
"SECTION 4255. License Arswlications.
Applications for surfboard licenses shall be filed with
the City Finance Director or with such other licensing agents
as may be designated by the City Manager. The application
form shall be prescribed by the City Manager and shall con-
tain such information as he deems necessary to carry out the
purposes of this chapter. The annual fee for such licenses
shall be Three Dollars ($3.00), which shall be paid at the
time of application for a license."
SECTION 3e Section 4256 is added to the Newport Beach
Municipal Code to read*
"SECTION 4256. Issuance of License.
Upon receipt of a completed license application and pay-
ment of the license fee by the applicant, the Finance Director
or other licensing agent shall issue to the applicant a
receipt indicating payment of the license fee and a license
tag which shall be valid for the calendar year in which the
license is issued."
SECTION 4. Section 4257 is added to the Newport Beach
Municipal Code to read-
"®SECTION 4257. License Tag to be Affixed to Surfboard.
After obtaining a license the licensee shall securely
affix the license tag to the surfboard in a location to be
determined by the City Manager."
SECTION 5. Section 4258 is added to the Newport Beach
Municipal Code to read-
"SECTION 4258. Transfer of License.
Upon transfer of ownership of any surfboard licensed
pursuant to this chapter, the new owner shall within .five
(5) days following the change of owne -r --yip apply to the
Finance Director or other authorized licensing agent for
• a transfer of the license, After completion of the pre-
scribed form and payment of a One Dollar ($1000) transfer
fee, the existing license shall be transferred to the name
of the new owner."
SECTION 6. Section 4259 is added to the Newport Beach
Municipal Code to reads
"SECTION 4259. Penalty.
Any person convicted of a violation of Sections 4254,
4257, and 4258 shall be punishable by a fine of not less
than Ten Dollars ($10.00)."
SECTION 7. This ordinance shall be published once in
the official newspaper of the City, and the same shall be effective
30 days after the date of its adoption.
This ordinance was introduced at a regular meeting of
the City Council of the City of Newport Beach held on the 25th
day of April. , 1966, and was adopted on the 9th day
