HomeMy WebLinkAbout1328 - Tideland Use FeesORDINANCE NO. g AN ORDINANCE OF THE CITY OF NEWPORT BEACH AMENDING SECTION 17.33.080, ENTITLED "ADMINISTRATION ", OF CHAPTER 17.33 OF THE NEWPORT BEACH MUNICIPAL CODE RELATING TO TIDELAND USE FEES The City Council of the City of Newport Beach does ordain as follows: SECTION 1. Section 17.33.080 of the Newport Beach Municipal Code is amended to read: "17.33.080 Administration. The Harbor and Tidelands Administrator shall administer the provisions of this Chapter, except for the collection of fees, which shall be the responsibility of the Finance Director. In assessing use fees for non - commercial piers on City tidelands pursuant to Section 17.33.040, the Harbor and Tidelands Administrator shall not assess a fee against any owner or permit holder unless at least fifty per cent (50 %) of the floating portion of such pier is located on City tide or submerged lands as measured along a line drawn perpendicular to the bulkhead line. In assessing use fees for commercial piers pursuant to Section 17.33.050, the Harbor and Tide- lands Administrator shall assess only that portion of the floating part of such pier that is located over City tide or submerged lands. The methods of computing use fees shall be described in the City Harbor Permit Policies." SECTION 2. This ordinance shall be published once in the official newspaper of the City, and the same shall be effective 30 days after the date of its adoption.
