HomeMy WebLinkAbout1329 - Relocatable BuildingsORDINANCE NO. 4 3Z U AN ORDINANCE OF THE CITY OF NEWPORT BEACH ADDING CHAPTER 15.21 TO THE NEWPORT BEACH MUNICIPAL CODE REGULATING THE ERECTION, USE AND OCCUPANCY OF RELOCATABLE BUILDINGS The City Council of the City of Newport Beach does ordain as follows: SECTION 1. Chapter 15.21 is added to the Newport Beach Municipal Code to read: EREC'. OF Sections: 15.21.010 15.21.020 15.21.030 15.21.040 "CHAPTER 15.21 LION, USE AND OCCUPANCY RELOCATABLE BUILDINGS Definitions. Minimum Floor Area. Use Permit Required. Compliance With Building Code. 15.21.010 Definitions. As used in this Chapter the words defined in this Section shall have the following meanings assigned to them unless from the context it appears that a different meaning was intended: (a) 'Relocatable Building' shall mean a structure designed for human occupancy for industrial, commercial or professional purposes in such a manner as to be readily transportable from site to site. (b) 'Readily Transportable' shall mean easily moveable from one location to another without the use of professional housemoving equipment, i.e., in order to move the building to the site all that is necessary is to add temporary '.trailer -type' wheels directly to the frame of the building or to carry it on a typical motor vehicle. 15.2.1.020 Minimum Floor Area -1- No person shall once. 15.21.040 Compliance With Building Code. No building permit or relocation permit shall be issued for the creation or placement of a relocatable building within the City of Newport Beach until the applicant for such permit shall have furnished evidence satisfactory to the Building Director that the building will comply with the City building code, or in lieu thereof, the Building Director may require that the applicant apply for a relocation permit pursuant to Chapter 15.20 of the Newport Beach Municipal Code and pay the applicable fees therefor." SECTION 2. This ordinance shall be published once in -2- construct or move into the City of Newport Beach any relocatable building which contains less than 600 square feet of floor area on at least one floor thereof, excluding garage space, or any relocatable building which shall be less than 15 feet in width. 15.21.030 Use Permit Required. No building permit or relocation permit shall be issued for the erection or placement of a relocatable building unless the applicant for said building permit has first applied for and obtained a use permit from the Planning Commission to maintain said relocatable building at a specific location. The provisions of Chapter 20.46 of the Newport Beach Municipal Code relating to procedure and right of appeal shall be applicable to use permits required under this Section. Any such use permit may limit the amount of time during which any re- locatable building may be permitted to remain at any particular location. Any use permit which is granted subject to a time limitation may not be renewed more than once. 15.21.040 Compliance With Building Code. No building permit or relocation permit shall be issued for the creation or placement of a relocatable building within the City of Newport Beach until the applicant for such permit shall have furnished evidence satisfactory to the Building Director that the building will comply with the City building code, or in lieu thereof, the Building Director may require that the applicant apply for a relocation permit pursuant to Chapter 15.20 of the Newport Beach Municipal Code and pay the applicable fees therefor." SECTION 2. This ordinance shall be published once in -2- the official newspaper of the City, and the same shall be effective 30 days after the date of its adoption.
