AN EMERGENCY ORDINANCE OF THE CITY OF NEWPORT
BEACH ESTABLISHING INTERIM ZONING REGULATIONS
IMPOSING A MAXIMUM BUILDING HEIGHT LIMIT WITHIN
THE AREA KNOWN AS THE PROPOSED LOWER NEWPORT
BAY CIVIC DISTRICT
WHEREAS, Newport Bay has played a major role in
establishing and maintaining the physical, social and economic
character of the City of Newport Beach and represents a major
public asset; and
WHEREAS, the rapid growth of the City has created in-
creasing pressures for intensive development and redevelopment
of properties surrounding the Lower Newport Bay; and
WHEREAS, in order to preserve and enhance public
access to and enjoyment of the Lower Newport Bay, the City Council
and the Planning Commission have initiated planning studies to
develop adequate development standards for the multiple resi-
dential, commercial and industrial properties surrounding the
Lower Newport Bay; and
WHEREAS, on November 17, 1970, a Special Civic District
Committee, consisting of representatives of both the City Council
and the Planning Commission, was created to work with the staff;

WHEREAS, the Special Civic District Committee has
recommended that the City Council adopt an emergency ordinance
establishing maximum building height regulations within the area
of the proposed civic district in order to prohibit the
construction of buildings which might be in conflict with future
recommendations concerning zoning regulations which may be made
by said Committee; and
WHEREAS, pending the receipt of the report and reccm -.
mendations of the Special Civic District Committee and the

adoption of. permanent zoning legislation imposing appropriate
height limit standards within the area of said Lower Newport
Bay civic district, it is the judgment of the City Council that
it is essential for the public peace, health, safety and welfare
that interim building height limits be adopted and imposed within
the proposed Lower Newport Bay civic district; and
WHEREAS, Section 65858 of the California Government
Code specifically authorizes the adoption of interim zoning
ordinances as emergency measures; and
WHEREAS, Section 412 of the City Charter authorizes
the adoption of ordinances as emergency measures when declared
by the City Council to be necessary in preserving the public
peace, health or safety; and
WHEREAS, in enacting this ordinance the City Council
hereby declares that it is acting pursuant to authority of said
Section 65858 of the California Government Code and pursuant to
its powers as set forth in Section 412 of the City Charter; and
WHEREAS, the City Council has held a public hearing
for the purpose of considering this ordinance;
NOW, THEREFORE, the City Council of the City of Newport
Beach DOES ORDAIN as follows:
SECTION 1. No building permits shall be issued for any
structure or any portion thereof within the Lower Newport Bay civic
district study area, as shown on the drawing designated.Exhibit "A"
which is attached hereto and incorporated herein by reference, which
structure exceeds 35 feet in height from finished grade.
SECTION 2. This ordinance shall be effective for a
period of 90 days from the date of its adoption; provided,
however, that after notice pursuant to Section 65856 of the
California Government Code and public hearing, the City Council

may by a four - fifths vote extend this ordinance for an additional
period not to exceed one year.
SECTION 3. This ordinance is declared by the City
Council to be necessary as an emergency measure for preserving
the public peace, health, safety and welfare for the reasons
stated herein and shall take effect immediately upon its
adoption.
SECTION 4. This ordinance shall be published once in
the official newspaper of the City.
This ordinance was introduced and adopted as an emergency
ordinance at a regular meeting of the City Council of the City of
Newport Beach held on the 22nd day of February 1971, by the
following vote, to wit:
AYES, COUNCILMEN: McInnis, Kymla, Rogers,
Hirth, Dostal, Parsons
NOES, COUNCILMEN: Croul
ABSENT COUNCILMEN: None
