ORDINANCE NO. 1434 <br />AN.EMERGENCY ORDINANCE OF THE CITY OF NEWPORT <br />BEACH REQUIRING CITY COUNCIL APPROVAL FOR THE <br />.,,ISSUANCE OF BUILDING PERMITS IN BLOCKS 100 AND <br />200 OF NEWPORT CENTER AND THE REMAINDER OF THE <br />NEWPORT BEACH CIVIC CENTER SITE NOT INCLUDED <br />IN ORDINANCE NO. 1371 <br />WHEREAS, the City Council of the City of Newport Beach <br />adopted Ordinance.No. 1371 on March 8, 1971, enacting a specific <br />_plan to establish a sight plane defining the maximum permitted <br />height of structures on a portion of the proposed Newport Beach <br />Civic Center site; and <br />WHEREAS, the City Council instructed the Department of <br />Community Development to consider a sight plane defining the maxi- <br />mum- .permitted height of structures in the remainder of that portion <br />of the Newport Beach Civic Center not included in Ordinance No.1371, <br />and that area of Newport Center known as Blocks 100 and 200; and <br />WHEREAS, the.City Council will request the Planning Com- <br />mission to consider adopting a specific plan to establish a sight <br />plane defining the maximum permitted height of structures above <br />35 feet in height in the remainder of that portion of the Newport <br />Beach Civic. Center not included in Ordinance No. 1371 and that area <br />of Newport Center known as Blocks 100 and 200; and <br />WHEREAS, Section 65858 of the California Government Code <br />specifically authorizes the adoption of interim zoning ordinances <br />as emergency measures prohibiting uses which may conflict with a <br />zoning proposal which the legislative body is considering; and <br />WHEREAS, Section 412 of the City Charter authorizes the <br />adoption of ordinances as emergency measures when declared by the <br />City Countil to be necessary in preserving the public peace, health <br />or safety; and <br />WHEREAS, in enacting this ordinance the City Council <br />hereby declares that it is acting pursuant to authority of said <br />-1- <br />
