HomeMy WebLinkAbout1434 - Building Permits for Civic Center SiteORDINANCE NO. 1434 AN.EMERGENCY ORDINANCE OF THE CITY OF NEWPORT BEACH REQUIRING CITY COUNCIL APPROVAL FOR THE .,,ISSUANCE OF BUILDING PERMITS IN BLOCKS 100 AND 200 OF NEWPORT CENTER AND THE REMAINDER OF THE NEWPORT BEACH CIVIC CENTER SITE NOT INCLUDED IN ORDINANCE NO. 1371 WHEREAS, the City Council of the City of Newport Beach adopted Ordinance.No. 1371 on March 8, 1971, enacting a specific _plan to establish a sight plane defining the maximum permitted height of structures on a portion of the proposed Newport Beach Civic Center site; and WHEREAS, the City Council instructed the Department of Community Development to consider a sight plane defining the maxi- mum- .permitted height of structures in the remainder of that portion of the Newport Beach Civic Center not included in Ordinance No.1371, and that area of Newport Center known as Blocks 100 and 200; and WHEREAS, the.City Council will request the Planning Com- mission to consider adopting a specific plan to establish a sight plane defining the maximum permitted height of structures above 35 feet in height in the remainder of that portion of the Newport Beach Civic. Center not included in Ordinance No. 1371 and that area of Newport Center known as Blocks 100 and 200; and WHEREAS, Section 65858 of the California Government Code specifically authorizes the adoption of interim zoning ordinances as emergency measures prohibiting uses which may conflict with a zoning proposal which the legislative body is considering; and WHEREAS, Section 412 of the City Charter authorizes the adoption of ordinances as emergency measures when declared by the City Countil to be necessary in preserving the public peace, health or safety; and WHEREAS, in enacting this ordinance the City Council hereby declares that it is acting pursuant to authority of said -1- Section 65858 of the California Government Code and pursuant to its powers.as set forth in Section 412 of the City Charter; NOW, THEREFORE, the City Council of the City of Newport Beach.DOES ORDAIN as follows: SECTION 1. No building permits will be issued for structures above 35 feet in height to be located within that area known as Blocks 100...and 200 of Newport Center and that portion of the proposed Newport Beach. Civic. Center site not included in Ordi- nance No. 1371 unless such permits have first been reviewed and approved by the City Council of the City of Newport Beach. SECTION 2. This ordinance shall be effective for a period of 90 days from the date of its adoption, PROVIDED, however, that after notice pursuant to Section 65858 of the California Government Code and public hearing, the City Council may by a four - fifths vote extend this ordinance for one year. Not more than two such extensions may be adopted. SECTION 3. This ordinance is declared by the City Coun- cil to be necessary as an emergency measure for preserving the pub- lic peace, health, safety and welfare for the reasons stated herein, and shall take effect immediately upon its adoption. SECTION 4. This ordinance shall be published once in the official newspaper of the City.
