is <br />ORDINANCE NO. <br />AN ORDINANCE OF THE CITY OF NEWPORT BEACH <br />ADDING SECTION 17.32.015 TO THE NEWPORT <br />BEACH MUNICIPAL CODE PERTAINING TO VESSEL <br />HOLDING TANK REQUIREMENTS <br />The City Council of the City of Newport Beach does ordain <br />as follows: <br />SECTION 1, Section 17.32.015 is added to the Newport <br />Beach Municipal Code to read: <br />"17.32.015 Vessel Holding Tank Requirements. A. VES- <br />SEL WASTES. No person shall own or operate a vessel equipped <br />with any head (toilet) or receptacle for human body wastes in <br />the waters of Newport Bay unless: <br />(1) said vessel is also equipped with a holding tank <br />designed to retain all human body wastes deposited in <br />said head or receptacle until such time as said sewage <br />can be discharged into a sanitary sewer system or dis- <br />charged otherwise in accordance with law; or <br />(2) said head or receptacle is connected directly to <br />a sanitary sewer system; or <br />(3) said head or receptacle is connected to an on- <br />board sewage treatment system which produces an ef- <br />fluent meeting such standards as may be approved by <br />the County Health Officer for discharge into the waters <br />of Newport Bay. <br />B. MARINA PUMP -OUT FACILITIES. The owner and operator of <br />every commercial marina shall provide a permanent holding <br />tank pump -out facility or equivalent services which are <br />operable and available for use at all times and which are <br />capable of servicing all vessels berthed, docked, or moored <br />at said marina," <br />-1- <br />
