AN EMERGENCY ORDINANCE OF THE CITY OF NEWPORT
_ BEACH EXTENDING THE INTERIM ZONING REGULATIONS
ESTABLISHING A USE PERMIT REQUIREMENT FOR
CERTAIN USES WITHIN THE M -1 DISTRICT
WHEREAS, on the 28th day of February, 1972, the City
Council of the City of Newport Beach adopted Ordinance No. 1430
providing for interim zoning regulations establishing a use permit
requirement for certain uses within the M -1 District; and
WHEREAS, said Ordinance No. 1430 was adopted pursuant
to the authority of Section 65858 of the California Government Code,
which authorizes the adoption of interim zoning ordinances as
emergency measures prohibiting uses which may conflict with a
zoning proposal which the legislative body is considering and
pursuant to the authority of Section 412 of the City Charter which
authorizes the Council to adopt emergency measures; and
date of its adoption, which effective period terminates on May 28,
1972.- and
WHEREAS, the City Council has introduced Ordinance No. 1441
relating to the establishment of a use permit requirement for
certain non - manufacturing uses within the M -1 District; and
WHEREAS, said Ordinance No. 1441 is set for public hearing
on.May 22, 1972, and if adopted would not become effective until
30 days after the date of its adoption; and
WHEREAS, the City Council has determined that it would be
in the best interest of the citizens of Newport Beach to extend the
interim zoning regulations establishing a use permit requirement
for certain uses within the M -1 District, in order to allow time for

WHEREAS, the City Council has held a public hearing for

WHEREAS, Section 2 of Ordinance No.
1430
provides that
said ordinance shall be effective for a period
of
90 days from the
date of its adoption, which effective period terminates on May 28,
1972.- and
WHEREAS, the City Council has introduced Ordinance No. 1441
relating to the establishment of a use permit requirement for
certain non - manufacturing uses within the M -1 District; and
WHEREAS, said Ordinance No. 1441 is set for public hearing
on.May 22, 1972, and if adopted would not become effective until
30 days after the date of its adoption; and
WHEREAS, the City Council has determined that it would be
in the best interest of the citizens of Newport Beach to extend the
interim zoning regulations establishing a use permit requirement
for certain uses within the M -1 District, in order to allow time for

WHEREAS, the City Council has held a public hearing for

the purpose of considering the proposed extension of Ordinance
No. 1430;
NOW, THEREFORE, the City Council of the City of Newport
Beach DOES ORDAIN as follows:
SECTION 1. All uses within the M -1 District will require
a Use Permit, except building material yards; contractors yards;
fuel yards,- machine shops; lumber yards; building and repair of
boats; instrument manufacturing, manufacturing uses; and any other
uses which, in the opinion of the Planning Commission are of
similar nature, but under the same limitations and restrictions
specified in sections governing same;
SECTION 2. This ordinance shall be effective for a period
of one year from the date of its adoption, or until Ordinance No. 1441
is adopted and becomes effective, whichever shall first occur.
SECTION 3. This ordinance is declared by the City Council
to be necessary as an emergency measure for preserving the public
peace, health, safety and welfare for the reasons stated herein,
and shall take effect immediately upon its adoption.
SECTION 4. This ordinance shall be published once in the
official newspaper of the City.
This ordinance was introduced and adopted as an emergency
ordinance at a regular meeting of the City Council of the City of
Newport Beach held on the 22nd day of Mav , 1972, by the
following vote, to wit:
