Y4 5 7 AN ORDINANCE OF THE CITY OF NEWPORT BEACH AMENDING CHAPTER 15.05 OF THE NEWPORT BEACH • MUNICIPAL.CODE TO ADOPT THE UNIFORM MECHANICAL CODE, 1970 EDITION The City Council of the City of Newport Beach does ordain as follows: SECTION 1. Chapter 15.05 of the Newport Beach Municipal Code is amended to read: "Chapter 15.05 MECHANICAL CODE Sections: 15.05.010 Adoption of Uniform Mechanical Code. 15.05.020 Addition of Section 106 to the Mechanical Code. 15.05.030 Amendment to Section 202 of the Mechanical Code. 15.05.040 Addition of Subsections (e) and (f) of Section 303 to the Mechanical Code. 15.05,050 Amendment to Section 304 of the Mechanical Code. 15.05.060 Amendment to Section 420 of the Mechanical Code. 15.05.070 Amendment to Section 704.(1) of the Mechanical Code. 15.05.010 Adoption of Uniform Mechanical Code. Subject to the particular additions, deletions and amendments herein- after set forth in this Chapter, the rules, regulations, pro- visions and conditions set forth in that certain Code entitled "Uniform Building Code, volume II - Uniform Mechanical Code, 1970 Edition," which Code is promulgated and published by the International Conference of Building Officials and the Inter - nation'al Association of Plumbing and Mechanical Officials, three full printed copies of which, printed as a Code in book form, were by the City Council ordered filed and which have been actually filed in the office of the City Clerk and which as so on file are hereby referred to, adopted and made a part hereof as fully and for all intents and purposes as though set forth herein at length, shall be and the same are hereby estab- lished and adopted as the rules, regulations, provisions and conditions to be observed and followed in the installation and maintenance of heating, ventilating, comfort cooling and re- frigeration systems, of all buildings or portions thereof used, designed or intended to be used for human habitation within the City; and subject to said additions, deletions and amendments hereinafter set forth, said Code is hereby established and adopted and the same shall be designated, known and referred to as the "Mechanical Code" of and for the City of Newport Beach. -1- 15.05.020 Addition of Section 106 to the Mechanical Code. Section 106 is added to the Mechanical Code, herein- before adopted in Section 15.05.010, to read: 'Sec. 106„ All references to the "Mayor and Council" contained within the Mechanical Code shall • mean the Mayor and City Council of the City of New- port Beach. All references to the "City" shall mean the incorporated area of the.City of Newport Beach. The provisions of the Mechanical Code of the City of Newport Beach shall apply to and affect all of the incorporated territory of.Newport Beach, except work located primarily in a public way, public utility towers and poles, mechanical equipment not specifically regu- lated in this Code, hydraulic floor control structures, facilities for the production, generation, storage or transmission of water or electrical energy by a local agency, and the buildings and structures for administra- tion and instruction of public schools.' 15.05.030 Amendment to Section 202 of the Mechanical Code. Section 202 of the Mechanical Code, hereinbefore adopted in Section 15.05.010, is amended to read: 'Sec. 202 Penalty for Violations. Any person, firm, corporation, partnership or copartnership who wilfully violates any of the provisions or fails to comply with any of the mandatory requirements of this Title is guilty of a misdemeanor, and upon conviction thereof, shall be pun- ishable by a fine not to exceed Five Hundred Dollars ($500) or by imprisonment in the City Jail, not to exceed six (6) months or by both fine and imprisonment, except that nothing contained herein shall be deemed to bar any legal, • equitable, or summary remedy to which the City of Newport Beach or other political subdivision, or any person, firm, corporation, partnership or copartnership may otherwise be entitled. The City of Newport Beach or any other politi- cal subdivision or person, firm, corporation, partnership or copartnership, may file a suit in the Superior Court of the County of Orange, to restrain or enjoin any at- tempted or proposed subdivision or sale in violation of this Title.' 15.05.040 Addition of Subsections (!)a and (f) of Section 303 to the Mechanical Code. Subsections (e nd f of Section 303 are added to the Mechanical Code, hereinbefore adopted in Section 15.05.010, to read: Sec. 303 '(e) Surrender of Permit. If no portion of the work or construction covered by a permit issued by the Building Official under the provisions of this Code has been com- menced, the person to whom such permit has been issued may deliver such permit to the Building Official with a request that such permit be canceled. The Building Of- ficial shall thereupon stamp or write on the face of such permit the words, "Canceled at the request of the Permittee." Thereupon such permit shall be null and void and of no ef- fect. -2- (f) Refunds. In the event that any person shall have obtained a permit.and..no portion of the work or construction covered by such permit shall have been com- menced and such permit shall have been canceled as pro- vided for in Subsection (b) of Section 303, the permittee upon presentation to said Building Official of a request therefor, in writing on a special form, shall be entitled to a refund in an amount equal to 80 percent of the per- mit fee actually paid for such permit. The Building Official shall satisfy himself as to the right of such applicant to such refund and each such refund shall be paid as provided by law for the payment of claims against the City of Newport Beach. No portion of the plan- checking fee shall be refunded, unless no checking has been.performed on a set of plans, in which case 80 percent of the plan- checking fee shall be returned.' 15.05.050 Amendment to Section 304 of the Mechanical Code. Section 304 of the Mechanical Code, hereinbefore adopted in Section 15.05.010, is amended to read: !Sec. 304. Any person desiring a permit required by' this Code, shall, at the time of filing an application therefor, pay a fee as required by this Section. 1. For the issuance of each permit .............. $ 3.00 2. For the installation or relocation of each forced -air or gravity type furnace or burner, including ducts and vents at- ', tacked to such appliance - A. Up to and including 100,000 BTU .......... 5.00 B. More than 100,000 BTU up to and including 500,000 BTU .................... 7.50 C. More than 500,000 BTU up to and including 1,000,000 BTU .................. 10.00 D. More than 1,000,000 BTU up to and including 2,000,000 BTU .................. 15.00 E. More than 2,000,000 BTU .................. 25.00 3. For the installation or relocation of each floor furnace including vent ............ 5.00 4. For the installation or relocation of each suspended heater, recessed wall heater or floor- mounted unit heater including vents ........................... 5.00 5. For the installation, relocation, or replacement of each appliance vent installed and not included in an appliance permit .......................... 2.00 6. For the repair or alteration of, or addition to each heating applicance, refrigeration unit, comfort cooling unit, absorption unit, or each comfort heating, cooling, absorption, or evapora- tive cooling system, including installation of controls regulated by this Code ........... 5.00 -3- • • 7. For the installation or relocation of each boiler or compressor up to and including five.horsepower, or each absorption system up to and including 100,000 BTU (including vent) ....... 5.00 S. For the installation or relocation of each boiler or compressor over five horsepower up to and including 15 horse- power, or each absorption system over 100,000 BTU up to and including 500,000 BTU (including vent) 7.50 9. For the installation or relocation of each boiler or compressor over 15 horsepower up to and including 30 horse- power, or each absorption system over 500,000 BTU up to and including 1,000,000 BTU (including vent) ............... 10.00 10, For the installation or relocation of each boiler'or compressor over 30 horse- power up to and including 50 horsepower, or each absorption system over 1,000,000 BTU up to and including 2,000,000 BTU (including vent) 15.00 11. For the installation or relocation of each boiler or refrigeration compressor over 50 horsepower, or each absorption system over 2,000,000 BTU (including vent) .......... 25.00 12, For each air handling unit up to and including 2,,000 cubic feet per minute, including ducts attachted thereto ............ 2.00 13. For each ventilation system which is not a portion of any heating or air condi- tioning system authorized by a permit (commercial) .. ............................... 4.00 20. For the installation of each hood which is served by mechanical exhaust, including the fans and ducts attached thereto .......... 5.00 21. For the installation or relocation of each commercial or industrial type incinerator .... 20.00 22. For each appliance or piece of equipment regulated by this Code, but not classed in other appliance categories, or for which no other fee is listed in this Code .... 4.00 23. For incidental gas piping ................... 24. Mechanical Plan Check Fee Whenever mechanical plans are required by the Building Official, plan check fees shall be in accordance with the following schedule: A. Fifty percent of the Mechanical Permit Fee shall be required for the following: • 1. Any Group A, B, C, D or E occupancy. 2. New buildings having an aggregate floor area of 15,000 square feet and over. 3. Installations other than those listed in 1 and 2 above, where the aggregate BTU input capacity is 350,000 BTU and over for comfort heating, or an aggre- gate of 25 horsepower and over for comfort cooling, or an aggregate of 350,000 BTU input capacity and over for absorption units. 1.75 B. Plan Check Fee for alterations to approved plans (per hour) ......................... 12.00 C. Minimum charge (per half hour or less) ..... ............................... 15.05.060 Amendment to Section 420 of the Mechanical Code. Section 420 of the Mechanical Code, hereinbefore adopte in Section 15.05.010, is amended to change the definition of the following term only. All words, phrases or terms not here- inafter defined by amendment shall have the same meaning as set forth in Section 420. -5- 6.00' 'READY ACCESSIBLE means capable of being reached safely and quickly for operation, repair, or inspection without requiring those to whom ready access is requisite to climb over or remove obstacles without the use of portable ladders.' 15.05.070 Amendment to Section 704(1) of the Mechanical Code. Section 704(1 ) of the Mechanical Code, hereinabove adopted in Section 15.05.010, is amended by deleting Exception No. 1." SECTION 2. This ordinance shall be published once in the official newspaper of the City, and the same shall be effective 30 days after the date of its adoption.
