ORDINANCE NO. 1652
AN ORDINANCE OF THE CITY OF NEWPORT BEACH
ADDING CHAPTER 1.30 TO THE NEWPORT BEACH
MUNICIPAL CODE, ENTITLED "ANNEXATION"
The City Council of the City of Newport Beach DOES
ORDAIN as follows:
SECTION 1. Chapter 1.30 is added to the Newport Beach
Municipal Code to read:
"CHAPTER 1.30
ANNEXATION"
Sections:
1.30.010 Election Required For Annexation
of Territory In Excess of One Hundred
Acres.
1.30.020 Exception.
1.30.030 Retroactive.
1.30.040 Amendment - Repeal
1.30.010 Election Required For Annexation Of Territory
In Excess Of One Hundred Acres. The City Council shall
not initiate proceedings to annex territory, nor consent
to the commencement of proceedings to annex territory, nor
approve the annexation of territory if the amount of territory
to be annexed to the City exceeds one hundred (100) acres
in the contemplated annexation or if the City has within
one (1) year last past annexed territory, other than territory
excepted under Section 1.30.020 of this Chapter, and the
combined acreage of the contemplated annexation and said
previously annexed territory exceeds one hundred (100) acres,
without having said contemplated annexation approved by a
majority of the registered electors of the City voting on such
proposition at any general or special municipal election.
1.30.020 Exception. The provisions of this Chapter
shall not prohibit the City Council from initiating

proceedings to annex territory to the City without a
vote of the registered electors when such territory
is surrounded on three (3) or more sides by the
boundaries of the City of Newport Beach.
1.30.030 Retroactive. The provisions of this
Chapter shall not apply retroactively to any annexation
proceeding which has been approved by the City Council
prior to the effective date of this ordinance.
1,30.040 Amendment - Repeal. None of the
provisions of this Chapter shall be amended, modified
or repealed without a duly noticed and legally
advertised public hearing.
SECTION 2. This ordinance shall be published once
in the official newspaper of the City, and the same shall be
effective thirty (30) days after the date of its adoption.
This ordinance was introduced at a regular meeting of
the City Council of the City of Newport Beach held on the 12th
day of January , 1976, and was adopted on the 26th
day of January , 1976, by the following vote, to wit:
