HomeMy WebLinkAbout1804 - Redefining Dwelling Unit & FamilyORDINANCE NO. 1804 AN ORDINANCE OF THE CITY OF NEWPORT BEACH AMENDING SECTION 20.87.140 OF THE NEWPORT BEACH MUNICIPAL CODE TO REDEFINE THE TERM "DWELLING UNIT" AND AMENDING SECTION 20.87.180 OF THE NEWPORT BEACH MUNICIPAL CODE TO REDEFINE THE TERM "FAMILY" The City Council of the City of Newpi rt-gB ch DOES ORDAIN as follows: SECTION 1. Section 20.87.140 of the Newport Beach Municipal Code is amended to read as follows: "20.87.140 DWELLING UNIT. The term 'dwelling unit'shall mean a single unit providing complete independent living facilities for one or more persons, including provisions for living, sleeping, and sani- tation, and having at least one entrance opening to the outside or to a common hallway or entryway shared by other dwelling units or facilities. Dwelling units constructed after August 24, 1972, must contain a minimum of 600 square feet of superficial floor area. Every dwelling unit shall have at least one room which shall have not less than 150 square feet of floor area. Other habitable rooms, except kitchens, shall have an area of not less than 70 square feet. An efficiency type unit shall have a living room of not less than 220 square feet of superficial floor area. An additional 100 square feet of superficial floor area shall be provided for each occupant of each unit in excess of two persons. The kitchen facilities shall be provided with a clear working Isthan 30" in front. The unit sha a separate bathroom containing a lavatory and bathtub or shower. the Housing Code regulations for light, and ventilation. space of not less L1 be provided with water closet, All areas must meet ceiling height, Existing units not meeting the above outlined criteria shall not be occupied by more than two persons. The provisions of Chapter 20.83 entitled 'Nonconforming Structures and Uses' notwithstanding the following regulation shall apply to buildings on lots which contain a greater number of dwelling units than permitted. Buildings on lots which contain a greater number of dwelling units than permitted by Chapter 20 of the Newport Beach Municipal Code must be altered to con- form to the requirements of the Code within 30 years from date of original construction, unless specifi- cally exempted by the City Council. A room and bath or set of rooms which are a part of another dwelling unit-but which can be made into a separate dwelling unit by the mere shutting of a door or erection of a partition, shall, for the purposes of determining the number of dwelling units on a lot, be deemed a dwelling unit." SECTION 2. Section 20.87.180 of the Newport Beach Municipal Code is amended to read as follows: "20.87.180 FAMILY. The term 'family' shall mean (1) a set of persons all related by blood, marriage, or adoption, and also, at most, one additional person; or -2- :0 (2) any set of at most four persons. The term 'family' shall not apply to residential care facilities for six or fewer developmentally disabled, mentally disordered, or otherwise handi- capped persons." SECTION 3. This ordinance shall be published once in the official newspaper of the City, and the same shall be effective thirty (30) days after the date of its adoption.
