HomeMy WebLinkAbout82-8 - Amending Section 5.50.150 of the Newport Beach Municipal Code Pertaining to Massage ParlorsNO. 82 -8 AN ORDINANCE OF THE CITY OF NEWPORT BEACH • AMENDING SECTION 5.50.150 OF THE NEWPORT BEACH MUNICIPAL CODE PERTAINING TO MASSAGE PARLORS The City Council of the City of Newport Beach DOES ORDAIN as follows: SECTION 1. Sections 5.50.150 of the Newport Beach Municipal Code is amended as follows: Section 5.50.150 - Revocation of Permit A permit issu- ed pursuant to this Chapter, may be revoked when: (1) A Permittee has failed to comply with any of the provisions of this Chapter; (2) An illegal act has been committed by Permittee, or by a per- son employed by, or acting under, Permittee at or near the mas- sage parlor owned or operated by, or employing Permittee; or (3) Permittee has been convicted of a felony, or a crime involving moral turpitude. • When the City Manager concludes that grounds for revocation exist, the City Manager shall serve Permittee, either personally or by certified mail addressed to the business address of Permittee, with a Notice of Intent to Revoke Permit, which notice shall state the reasons for the proposed revocation, the effective date of the revocation if no appeal is filed by Permittee, and the right of the Permittee to appeal, to the City Council, the decision of the City Manager to revoke the permit. The City Council of the City of Newport Beach may pre- side over the hearing on appeal or, in the alternative, appoint a hearing officer to conduct the hearing, receive relevant evidence and to submit to the City Council findings and recommendations to be considered by the City Council of the City of Newport Beach. The City Council of the City of Newport Beach shall render its decision within 45 days from the date of the hearing or, in the event that a hearing officer has been appointed, within 45 days from the date on which the City Council receives the findings and recommendations of the hearing officer. SECTION 2. This Ordinance shall be published once in • the official newspaper of the City, and the same shall be effec- tive thirty (30) days after the date of its adoption, This Ordinance was introduced at a regular meeting of the City Council of the City of Newport Beach held on the day of Auril 26, 1982, and was adopted on the loth day of May , 1982, by the following vote, to wit: • ATTEST: City Clerk O- 6A- Massage2 042682 0 AYES, COUNCIL MEMBERSL Heather, Cox, Hart, Hummel.
