HomeMy WebLinkAbout84-22 - Extending the Moratorium on the Use of Property Within the City for Fortune-Telling PurposesORDINANCE NO. 84 -22 • AN URGENCY ORDINANCE OF THE CITY OF NEWPORT BEACH EXTENDING THE MORATORIUM ON THE USE OF PROPERTY WITHIN THE CITY FOR FORTUNE- TELLING PURPOSES WHEREAS, on August 27, 1984, the City Council adopted an Urgency Ordinance imposing a moratorium on the use of property within the City for fortune - telling purposes, and directing the Planning Department and the Planning Commission to conduct a study to deal with the planning and use of fortune - telling areas within the City; WHEREAS, the Moratorium Ordinance, by its own terms, expires on October 11, 1984; and WHEREAS, pursuant to Government Code Section 65858, the City Council may extend the Moratorium Ordinance if it determines that there is a need.for such extension; and •WHEREAS, the City Council has determined that there is insufficient time for the Planning Department and the Planning Commission to complete their study with respect to fortune- telling activities by October 11, 1984; and WHEREAS, the City Council has determined that the Planning Department and the Planning Commission can, and will complete the study with respect to fortune- telling activities within 90 days, if granted the opportunity to do so; and WHEREAS, the City Council has determined that it is desirable and in the City's best interest to have the Planning Department and the Planning Commission complete their study and to extend the moratorium on fortune - telling activities during the pendency of the study; and WHEREAS, if the Moratorium Ordinance is not extended on • an urgency basis, the City will have no regulations nor provisions prohibiting fortune - telling activities pending the study of the Planning Department and the Planning Commission, which would not be in the best interest of City, and which would 1 interfere with and limit the ability of the City to protect and preserve the public health, safety and welfare of its citizens. • NOW, THEREFORE, the City Council of the City of Newport Beach does ordain as follows: Section 1. Moratorium Ordinance No. 84 -20, adopted on August 27, 1984, is hereby and shall be extended in full force and effect for 90 days beyond Octobe.r 9, 1984. Section 2. This Ordinance is declared by the City Council to be necessary as an emergency measure for preserving the public peace, health, safety and welfare for the reasons stated herein, and shall take effect immediately. Section 3. This Ordinance shall be published once in the offical newspaper of the City of Newport Beach. This Ordinance was introduced and adopted as an Urgency Ordinance, at a regular meeting of the City Council of the City of Newport Beach, held on the 9th day of October, 1984, and was • adopted on the 9th day of-"October, 1984, by the following vote: AYES, COUNCILMEMBERS Hart, Maurer, Heather.
