ORDINANCE NO. 85 -18 <br />• AN ORDINANCE OF THE CITY OF NEWPORT BEACH <br />AMENDING PROVISIONS OF N.B.M.C. SECTIONS <br />12.56.010 AND 12.56.140 REGARDING THE <br />DEFINITION AND OPERATION OF BICYCLES <br />The City Council of the City of Newport Beach DOES <br />ORDAIN as follows: <br />SECTION 1. Section 12.56.010 of the Newport Beach <br />Municipal Code is amended to read as follows: <br />1112.56.010 Definitions. As used in this Chapter, the <br />following terms and words shall have the following meanings: <br />BICYCLE shall mean any device upon which a person may <br />ride, which is propelled by human power through a system of <br />belts, chains or gears, and which has two wheels at least twenty <br />(20) inches in diameter and a frame size of at least fourteen <br />(14) inches." <br />• SECTION 2. Section 12.56.140 of the Newport Beach <br />Municipal Code is amended to read as follows: <br />1112.56.140 Operating Bicycle on Sidewalk. No person <br />shall operate or ride a bicycle, surrey cycle, pedicab, or other <br />wheeled device or conveyance used for transportation and <br />propelled by human power, upon any sidewalk in the City, except <br />that bicycles may be ridden on those sidewalks designated by the <br />City Council by resolution adopted by the City Council, which <br />permits bicycle riding on certain specified sidewalks. <br />The foregoing prohibition shall not apply to tricycles, <br />operated by children, invalids, the infirm or the elderly, wheel <br />chairs, roller skates or skateboards, except as provided in <br />Chapter 12.57 of the Municipal Code." <br />SECTION 3. All other provisions of Section 12.56.010 <br />• and Section 12.56.140 shall remain in full force and effect. <br />
