ORDINANCE NO. 85 -26 <br />AN ORDINANCE OF THE CITY OF NEWPORT BEACH <br />AMENDING CHAPTER 20.02 OF THE NEWPORT BEACH <br />• MUNICIPAL CODE BY ADDING SECTION 20.02.090 TO THE <br />CITY'S HEIGHT LIMITATION ORDINANCE SPECIFYING <br />AIRPORT LAND USE COMMISSION REVIEW OF ALL PROJECTS WHICH <br />WOULD REQUIRE FEDERAL AVIATION ADMINISTRATION NOTIFICATION <br />follows: <br />The City Council of the City of Newport Beach DOES ORDAIN as <br />Section 20.02.090 is hereby added to the Newport Beach <br />Municipal Code to read as follows: <br />20.02.090 Airport Height Limits. Any project which requires <br />a notice of construction or alteration by the Federal <br />Aviation Administration Regulations Part 77 shall require <br />FAA compliance, and the applicant shall submit a copy of the <br />FAA application to the Airport Land Use Commission (ALUC) <br />and provide the City with FAA and ALUC responses. If the <br />ALUC requests review of the project, then the project shall <br />be submitted to the Commission by the City. Commission <br />determination shall be referred to the City within 60 <br />calendar days from the date of referral of the application <br />to the ALUC, and shall be considered before the City takes <br />any action on the project. If the Commission fails to refer <br />• the determination within that period, the proposed project <br />shall be deemed consistent with the Airport Environs Land <br />Use Plan (AELUP). <br />• <br />This Ordinance was introduced at a regular meeting of the <br />City Council of the City of Newport Beach held on the 9th day of <br />September, 1985, and was adopted on the 23rd day of September , <br />1985, by the following vote: <br />ATTEST: <br />1 G <br />City Clerk �� <br />AYES Agee, Cox, Hart, Heather, <br />Maurer, Plummer, Strauss <br />NOES <br />
