HomeMy WebLinkAbout86-24 - Adding Section 17.12.060 of the Newport Beach Municipal Code Pertaining to the Grand Canal ChannelORDINANCE NO. 86 -24 • URGENCY ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH ADDING SECTION 17.12.060 OF THE NEWPORT BEACH MUNICIPAL CODE PERTAINING TO THE GRAND CANAL CHANNEL. Section 1: Declaration of Urgency: The City Council finds that immediate closure of the Grand Canal Channel is necessary to preserve the public peace, health and safety, and to preserve private property in that: (A) Recent dredging of the Grand Canal Channel has increased the depth of the channel, and the extent to which it is used by swimmers and boaters. The narrowness of the channel and the tendency of boaters to speed through the Channel, creates a risk of injury to boater and swimmer alike; (B) Recent dredging of the Channel has stimulated boat traffic. The heavy usage of this narrow Channel creates • substantial wave movement which causes significant erosion of sand along beaches and has contributed to the sinking of three vessels; (C) Prohibiting vessel access during free periods of peak demand will reduce the extent to which beach sand moves back to the center of the Channel and will eliminate the potential for personal injury or property damage. Heavy usage of the Channel can be expected during the remainder of the summer and restrictions will not be in place unless this ordinance is adopted as an emergency measure. Section 2: The City Council of the City of Newport Beach does hereby ordain as follows: Section 17.12.060 of the City of Newport Beach Municipal Code is added to read as follows: • Grand Canal Channel Closure. The Grand Canal Channel is designated as a special use area.
