HomeMy WebLinkAbout88-26 - Amending Section 20.87.140 of the Newport Beach Municipal Code by Deleting Provisions Which Require the Removal of Dwelling Units Which Exceed the Allowable Density Permitted by the District in Which they are Located When Said Dwelling Units BecomORDINANCE NO. 88 -26 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH AMENDING SECTION 20.87.140 OF THE NEWPORT BEACH MUNICIPAL CODE BY DELETING PROVISIONS WHICH REQUIRE THE REMOVAL OF DWELLING UNITS WHICH EXCEED THE ALLOWABLE DENSITY PERMITTED BY THE DISTRICT IN WHICH THEY ARE LOCATED WHEN SAID DWELLING UNITS BECOME SIXTY YEARS OLD, AND THE ACCEPTANCE OF AN ENVIRONMENTAL DOCUMENT (Planning Commission Amendment No. 659) The City Council of the City of Newport Beach DOES ORDAIN as follows: Section I. Section 20.87.140 of the Newport Beach Municipal Code is hereby amended to read as follows: 20.87.140 DWELLING UNIT. The term "dwelling unit" shall mean a single unit providing complete independent living facilities for one or more persons, including provisions for living, sleeping, and sanitation, and having at least one entrance opening to the outside or to a common hallway or entryway shared by other dwelling units or facilities. to Dwelling units constructed after August 24, 1972, must contain a minimum of 600 square feet of superficial floor area. Every dwelling unit shall have at least one room which shall have not less than 150 square feet of floor area. Other habitable rooms, except kitchens, shall have an area of not less than 70 square feet. An efficiency type unit shall have a living room of not less than 220 square feet of superficial floor area. An additional 100 square feet of superficial floor area shall be provided for each occupant of each unit in excess of two persons. The kitchen facilities shall be provided with a clear working space of not less than 30 inches in front. The unit shall be provided with a separate bathroom containing a water closet, lavatory and bathtub or shower. All areas must meet the Housing Code regulations for ceiling height, light, and ventilations. Existing units not meeting the above outlined criteria shall not be • occupied by more than two persons. to w Section II. The City Clerk shall cause the same to be published once in the official newspaper within fifteen (15) days after its adoption. Section III.
