AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH AMENDING CHAPTER 9.04 OF THE
NEWPORT BEACH MUNICIPAL CODE TO ADOPT THE
UNIFORM FIRE CODE, 1988 EDITION.
•The City Council of the City of Newport Beach does ordain as
follows:

Section 9.04.010. Adoption of the 1988 Uniform Fire Code.
• Pursuant to the provisions of Sections 50022.1 through
50022.5, of the Government Code of the State of California, there
is hereby adopted and incorporated by reference into this
chapter, that certain Code entitled "Uniform Fire Code," (1988
Edition) referred to in this chapter as the "Fire Code"
specifically including Appendices, Division I through Division
VI, save and except such portions as are hereafter deleted, added
or amended. One (1) certified copy of which is to be on file in
the office of the City Clerk of the City of Newport Beach and
open for public inspection.
Section 9.04.020. Amendment of Section 2.304(b) of the Fire
Code.
Section 2.304(b) of the Fire Code is amended by inserting
therein the following to read:
"NATIONAL FIRE PROTECTION ASSOCIATION
Batterymarch Park
Quincy, Massachusetts 02269
All of the National Fire Protection Association Codes,
Standards, Recommended Practices, Manuals, Guides and Model Laws
contained in the National Fire Codes, published and promulgated
by the National Fire Protection Association, a copy of which is
on file with the Newport Beach Fire Department, 1988 Edition."

Section 9.04.030. Amendment to Section 9.103 of the Fire
Section 9.103 of the Fire Code is amended by adding the
9 definition of "Authorized Representative" as follows:
"Authorized Representative shall mean those persons
described in Sections 2.104, 2.105 and 2.106 of this Code."

Section 9.04.040. Amendment to Section 9.105 of the Fire
Code.
Section 9.105 of the Fire Code is amended by adding the
definition of "Corporation Counsel" as follows:
"Corporation Counsel as used herein shall mean the City
• Attorney of the City of Newport Beach."
Section 9.04.050. Amendment to Section 10.203 of the Fire
Code.
Section 10.203 of the Fire Code is amended to read as
follows:
"No person shall use or operate any hydrant or other valves
installed on any water system intended for use by the Chief for
fire suppression purposes and which is accessible to any public
highway, alley or private way open to or generally used by the
public, unless such person first secures a permit from the
controlling water agency. This section does not apply to the use
of a hydrant or other valves by a person employed, and authorized
to make such
use,
by the water company which
supplies water to
such hydrants
or
other valves."

Section 9.04.060. Amendment to Section 10.209 of the Fire
Section 10.209 of the Fire Code is amended by adding
Subsections (b) and (c) as follows:
"Section 10.209(b) Key Box System. Key box shall contain
two sets of the following:
1. Keys to locked points of ingress whether on the
interior or exterior of the building.
2. Keys to locked mechanical equipment rooms.
3. Keys to locked electrical rooms.
Ip 4. Keys to elevator controls.
5. Keys to other areas as directed by the Chief.
(c) Entrance Gates /Chains. All emergency vehicle access
gates, private gated communities, chains across fire lanes, and
gates that provide access to the beach and /or wildland areas,
shall have a lock approved by the Fire Chief. Where gates are

electrically operated, an approved fire department key switch
shall be installed."
Section 9.04.070. Amendment to Section 10.301 of the Fire
Code.
Section 10.301 of the Fire Code is amended by adding
subsection (g) to read as follows:
"Section 10.301(g) Provide and install electrical outlets
(120 volt, duplex) that are connected to the emergency generator
circuitry /system, when generator is required by Section 1807 or
1907 of the Uniform Building Code, in the following locations:
1. In the main exit corridor of each floor, adjacent to
each exit enclosure.
2. In each elevator lobby.
3. In public assembly areas larger than 1500 square feet.
4.
In
every
fire
control
room.
5.
In
such
other
areas as
may be
designated
by the Chief.
Outlets shall be RED in color."
Section 9.04.080. Amendment to section 11.101(d) of the
Fire Code.
Section 11.101(d) of the Fire Code is amended to read as
follows:
"Notwithstanding the provisions of this Chapter, no person
shall do or allow any such burning without a permit issued in
compliance with the Rules and Regulations of South Coast Air
Quality Management District."
Section 9.04.090. Amendment to Section 11.101 of the Fire
Code.
Section 11.101 of the Fire Code is amended by adding sub-
section (e) to read as follows:
"11.101. (e) CAMP FIRES. No person shall make, set or
maintain any beach or camp fire at any place within the City
except in areas where proper containers are provided for such
fires by the City and where City signs are plainly posted
indicating such fires are permissible."

Section 9.04.100. Amendment to Section 11.209(a) of the
Fire Code.
Section 11.209(a) of the Fire Code is amended to read as
follows:
"ATRIUM AND MALL FURNISHINGS. Section 11.209(a). The
.potential heat of combustible furnishings and decorative
materials within atriums and malls shall not exceed 9000 BTU per
pound when located within an area of the atrium or mall that is
more than 20 feet below ceiling- mounted sprinklers. EXCEPTION:
Furnishings certified as flame- retardant to the satisfaction of
the Chief may be used in atriums and malls."
Section 9.04.110. Amendment to Section 77.106(b) of the
Fire Code.
Section 77.106(b) of the Fire Code is amended to read as
follows:
"(b) The storage of explosives and blasting agents is
prohibited anywhere in the City of Newport Beach unless a permit
authorizing use and /or storage has been issued by the Chief."
Section 9.04.120. Amendment to Section 79.501 of the Fire
Code.
Section 79.501 of the Fire Code is amended to read as
follows:
"Section 79.501. The storage of Class I and Class II
liquids in aboveground tanks outside of buildings is prohibited
within the boundaries of the City of Newport Beach unless a
permit authorizing use and /or storage has been issued by the
Chief."
Section 9.04.130. Amendment to Section 79.601(a) of the
Fire Code.
Section 79.601(a) of the Fire Code is amended to read as
follows:
"Section 79.601. (a) Location. "The underground storage of
flammable liquids shall be prohibited in any residential district
or any residential area of a P -C district, as defined in Chapter
20.5 of this Code, within the City."

Section 9.04.140. Amendment to Section 79.1401. of the Fire
Section 79.1401 of the Fire Code is amended to read as
follows:
"Section 79.1401. This division shall apply to that portion
•of a property where flammable and combustible liquids are
received by tank vessel, pipe lines, tank car or tank vehicle and
are stored or blended in bulk for the purpose of distributing
such liquids by tank vessel, pipeline, tank car, tank vehicle or
container. No new bulk plant for flammable liquids shall be
constructed within the boundaries of the City of Newport Beach
except as permitted by the Chief."
Section 9.04.150. Amendment to Section 79.910(d) of the
Fire Code.

"Section 82.102.(a) Permit. No person shall install or
maintain a liquified petroleum gas container, except portable
containers of less than twenty (20) gallons water capacity,
unless natural gas is unavailable in the area or unless such
installation is needed for special industrial process or use,
unless a permit has been issued by the Chief. An application for
permit shall be accompanied by plans and specifications and the
Chief may impose such conditions as may be necessary to protect
health, safety and welfare."

Section 9.04.170. Amendment to Appendix II -C of the Fire
Appendix II -C 5. (a) of the Fire Code is amended to read as
follows:
"Appendix II -C 5. (a) Any portions of a float more than one
hundred and fifty feet (1501) from fire apparatus access or a
marine service station shall be provided with an approved wet
standpipe system installed in conformity with applicable
standards in Uniform Building Code Standard No. 38 -2 and Article
10 of the Fire Code."
Section 9.04.180. Amendment to Section 10.306 (b) of the
Fire Code.
Section 10.306(b) is amended, and subsections 5 -9 added, to
read as follows:
"Section 10.306. (b) All Occupancies with no exceptions. An
automatic sprinkler system shall be installed:
5. In all occupancies when the total floor area,
regardless of area separation walls or allowable area increases,
exceeds five thousand square feet (50001). The building shall be
sprinklered throughout. Sections 505, 506, 507, 508 and Tables
5 -C and 5 -D of the Uniform Building Code shall apply after the
provisions of this paragraph have been implemented.
6. In existing buildings with a floor area of five
thousand square feet (50001) or more;
A. Any time the existing building square footage is
increased; and
B. Compliance with the time period set forth in
number eight (8) of this section has been agreed upon.
7. In all occupancies when the building has floors, as
measured from the top level of the floor surface, located more
than forty feet (401) above grade level. The building shall be
sprinklered throughout.
S. In all occupancies when fire sprinklers are use to
implement provisions of Uniform Building Code, section 3305(8)5,
new or existing buildings shall be sprinklered throughout. In

existing buildings when fire sprinklers are used, a plan for
completion of the required work shall be approved by the Fire
Chief and the Building Official. The total time for installation
throughout the building shall not extend beyond five (5) years
from the date the plan is approved.
•9. In all occupancies, when buildings are partially
sprinklered, sprinklered areas shall be separated from
non - sprinklered areas of buildings by a minimum one hour rated
separation. Separation shall be from slab to slab or slab to one
(1) hour rated ceiling."

Section 9.04.190. Amendment to Section 10.306 of the Fire
Section 10.306 of the Fire Code is amended by adding
subsection (i) to read as follows:
"Section 10.306. (i) System Design. Automatic sprinkler
system design shall comply with the requirements of the
applicable codes and the following:
1. The total demand for hydraulically designed sprinkler
systems shall not exceed ninety percent (90 %) of the available
pressure and water supply.
2. Sprinkler system design including any required
additional water for hose or standpipes shall not exceed the
rated capacity of a fire pump used to supply the system.
3. In all buildings subject to the application of Section
10.301(c) of the Fire Code, the Chief may require that the
maximum floor area to be protected by sprinklers supplied by each
system riser, on any floor, shall not exceed twice the basic
allowable floor area as set forth in Table 5 -C of the Uniform
Building Code for the type of construction regardless of area
increase allowances permitted by Uniform Building Code Section
506. When more than one sprinkler system is required for
protection of any one floor area, the systems shall be separated
by area separation walls as described in Section 505(e) of the
Uniform Building Code for the type of construction considered."

Section 9.04.200. Amendment to Section 2.105 of the Fire
Section 2.105 of the Fire Code is amended to read as
follows:
"Section 2.105. The Chief, members of the Fire Prevention
•Bureau and sworn members of the Newport Beach Fire Department
shall have the power to issue citations for violations of the
Fire Code."
Section 9.04.210. Amendment to Article 2 of the Fire Code.
Article 2 of the Fire Code is amended by adding Section
2.110 to read as follows:
"Section 2.110. Fees. The Newport Beach City Council shall
establish by resolution, and from time to time amend, fees for
the administration of this Chapter. Fees required by this
Chapter shall be in addition to those required by any other
Chapter of this code."

Section 9.04.220. Amendment to Section 10.208 of the Fire
Section 10.208 of the Fire Code is amended by adding
Subsection (c) as follows:
"Section 10.208(c) Chains. Chains, cables, or ropes that
extend across driveways or other vehicle entrances, shall be made
visible by placing a twelve inch (1211) by twelve inch (12 ")
reflective sign every six feet (6') or portion thereof. The
lowest point or center span shall be at least twenty inches (2011)
above the ground."

Section 9.04.230. Amendment to Appendix I -B of the Fire
Appendix I -B of the Fire Code is deleted.
Section 9.04.240. Amendment to Section 10.305(b1 of the
Fire Code.
Section 10.305(b) of the Fire Code is amended to read as
follows:
"Section 10.305. (b) Approvals. All fire - extinguishing
systems, including automatic sprinkler systems, Class I, II and

III combined standpipes, Halon systems and other special
automatic extinguishing systems, and basement pipe inlets shall
be approved and shall be subject to periodic tests as may be
required. A condition of approval of Halon systems shall be
satisfactory passage of a full discharge test utilizing an
•approved test gas or an accepted room integrity test prior to
final acceptance of the system. Such tests are only required
when the room protected by the Halon system is not equipped with
an automatic sprinkler system. The location of all fire
department hose connections shall be approved by the Fire Chief."
Section 9.04.250. Amendment to Section 10.308. 2 of the
Fire Code.
Section 10.308. 2 of the Fire Code is amended to read as
follows:
"Section 10.308. 2. Sprinklers shall not be installed when
the application of water or flame and water to the contents may
constitute a serious life or fire hazard. Other fire
extinguishing systems compatible with the hazardous materials
being stored or used, and approved by the chief shall be
provided."
Section 9.04.260. Amendment to Section 14.106(a) of the
Fire Code.
Section 14.106(a) of the Fire Code is amended to read as
follows:
"Section 14.106. (a) Maintenance and Testing. Fire alarm
systems shall be maintained and tested in accordance with
nationally recognized standards. The fire alarm system shall be
tested annually and a report shall be sent to the Fire Marshal
within thirty (30) days of the test."
Section 9.04.270. Amendment to Section 30.207(c) of the
Fire Code.
Section 10.207(c) of the Fire Code is amended to read as
follows:
"Section 10.207(c) Width. The unobstructed width of a fire
apparatus access road shall be not less than twenty feet (201).

In the area of fire hydrants, the width shall be increased to
twenty -six feet (261). The minimum width of a gate or opening
that fire apparatus would be expected to use shall be not less
than fourteen feet (141) unobstructed. This minimum width may be
increased depending on the length of the approach."
Section 9.04.280. Amendment to Section 10.208(a) of the
Fire Code.
Section 10.208(a) of the Fire Code is amended to read as
follows:
"Section 10.208. (a) General. Approved numbers or addresses
shall be placed on all new and existing buildings in such a
position as to be plainly visible and legible from the center of
the street or road fronting the property. Said numbers shall
contrast with their background. The minimum size numbers shall
be four inches (411) in height."
Section 9.04.290. Amendment to the 1988 Uniform Fire Code
First Printing.
The first printing of the 1988 Uniform Fire Code contained
several errors. The following is a list of known errors provided
by I.C.B.O.:
Page 18 Sec. 4.108. In Item No. 1.1, between the words
"for" and "aggregate," add the words "portable containers of less
than 125 gallons."
Page 48 Sec. 10.207(b). At the end of the first paragraph,
add the words, " ... as measured by an unobstructed route around the
exterior of the building."
Page 64 Sec. 11.201(b)
word "equipped."
In the first sentence, delete the

paragraph, replace "Group H, Division 2 Occupancy" with "Group H.

Section 9.04.300. Amendment to National Fire Protection
Association Standard 1500.
National Fire Protection Association Standard 1500 is
• deleted.
Section 9.04.310. Amendment to Section 80.103(c) and (d)
of the Fire Code.
Section 80.103(c) and (d) of the Fire Code are amended to
read as follows:
"Section 80.103(c). Hazardous Materials Management Plan.
When required by the chief, each application for a permit
pursuant to this article shall include a Hazardous Materials
Management Plan (HMMP) in accordance with Appendix II -E and shall
contain any additional elements as required in the California
Health and Safety Code, Article 1, Chapter 6.95 for Business
Plan.
Section 80.103(d). Hazardous Materials Inventory Statement.
When required by the chief, each application for a permit
pursuant to this article shall include a Hazardous Materials
Inventory Statement (HMIS) in accordance with Appendix II -E and
shall contain any additional elements as required in the
California Health and Safety Code, Article 1, Chapter 6.95 for
Business Plan."
Section 9.04.320. Amendment to Section 80.312 and Table No.
80.312 -A of the Fire Code.
Section 80.312 of the Fire Code is amended such that "highly
toxic solid" or" highly toxic liquid" whenever used in this
section, shall include toxic solids and toxic liquids as defined
in Article 9.
Section 9.04.330. Amendment to Section 10.309(b) of the
Fire Code.
Section 10.309(b) of the Fire Code is amended to read as
follows:

"Section 10.309(b) Where Required. Standpipe systems shall
be provided as set forth in Table No. 10.309. When fire
protection requires both a standpipe and a sprinkler system, the
two systems shall be tied together with one (1) fire department
connection."
•Section 9.04.340. Amendment to Section 10.306(a) of the
Fire Code.
Section 10.306(a) of the Fire Code is amended by adding a
third paragraph to read as follows:
"Section 10.306(a) Where Required. All new sprinklered
building shall have a separate sprinkler control valve for each
floor."
9.04.350. Amendment to Section 10.301(c) of the Fire Code.
Section 10.301(c) of the Fire Code is amended by adding a
fourth paragraph to read as follows:
"Section 10.301(c) Water Supply. In new construction, a
fire hydrant is required to be located within one hundred feet
(1001) of a fire department connection. In high rise buildings,
thirty feet (301) is the required maximum distance to a fire
hydrant."
Section 9.04.360. Severability.
If any section, subsection, sentence, clause, or phrase of
this Ordinance is for any reason held to be invalid or
unconstitutional by a decision of any court of competent
jurisdiction, such decision shall not affect the validity of the
remaining portions of the Ordinance. The City Council hereby
declares that it would have passed this Ordinance and each and
every section, subsection, sentence, clause or phrase not
declared invalid or unconstitutional without regard to whether
1p any portion of the Ordinance would be subsequently declared
invalid or unconstitutional.
Section 2. The Mayor shall sign and the City Clerk shall
attest to the passage of this Ordinance. The City Clerk shall
cause the same to be published once in the official newspaper

within fifteen (15) days after its adoption. The ordinance shall
become effective thirty (30) from its adoption.
Section 3: This Ordinance was introduced at a regular
meeting of the City Council of the City of Newport Beach held on
the 26th day of March , 1990, and adopted on the 9th day of
0 April , 1990, by the following vote, to -wit:
