(Planning Commission Amendment No. 723)ORDINANCE NO. 91 -13 AN ORDINANCE OF THE CITY OF NEWPORT BEACH AMENDING A PORTION OF DISTRICTING MAP 39 SO AS TO RECLASSIFY LOTS 1 -19 OF TRACT 5425 FROM THE R -3 -B (PRD) DISTRICT TO THE MFR DISTRICT, AND ESTABLISH DWELLING UNIT LIMITS FOR SAID • PROPERTIES. (Planning Commission Amendment No. 723) WHEREAS, the City Council previously adopted General Plan Amendment No. 87 -1 (A) and (E) by Resolution No. 88 -100 and Resolution No. 88 -101, on October 24, 1988, amending both the Land Use Element and the Circulation Element of the City's General Plan; and WHEREAS, land use decisions are legally required to be consistent with the City's General Plan and Zoning; and WHEREAS, this action, in combination with General Plan Amendment 90 -1 (A) will result in the required consistency between the City's General Plan and Zoning; and WHEREAS, at its meeting of February 7, 1991, the Planning Commission of • the City of Newport Beach held a public hearing regarding Planning Commission Amendment No. 723, and at that time voted to recommend that the City Council approve the amendment; and WHEREAS, on March 11, 1991, the City Council of the City of Newport Beach held a duly noticed public hearing regarding this ordinance; NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. The subject property is the following real property in the City of Newport Beach, County of Orange, State of California: LOTS 1 -19 TRACT 5425 isas shown on the attached Exhibit "A" and hereinafter referred to as "Properties." SECTION 2. Title 20 is hereby amended to establish dwelling unit limits for the above described Properties, as follows: TRACT 5425 Lot Number District (D.U. Limit) 1 MFR (34 DU) 2 MFR (18 DU) 3 MFR (18 DU) 4 • MFR (22 DU) 5 MFR (22 DU) 6 MFR (16 DU) 7 MFR (22 DU) 8 MFR (8 DU) 9 MFR (8 DU) 10 MFR (10 DU) 11 MFR (6 DU) 12 MFR (6 DU) 13 MFR (6 DU) 14 MFR (6 DU) 15 MFR (5 DU) 16 MFR (6 DU) 17 & 18 MFR (12 DU) 19 MFR (0 DU) SECTION 3. The Planning Director of the City of Newport Beach is hereby instructed and directed to change Districting Map No. 39, referred to in Section 20.01.050 • of the Newport Beach Municipal Code, and by such reference is made a part of Title 20, to reflect said change as described in Sections 1 and 2 hereof, and shown in the attached Exhibit 'B," and when said Districting Maps have been so amended, the same shall be in full force and effect and be a part of Title 20 of the Newport Beach Municipal Code. SECTION 4. This Ordinance shall be effective thirty days from and after the date of its adoption, provided, however, the City shall not refuse to issue building permits, on the basis of zoning inconsistency, with respect to any project for which plans had been submitted to the Building Department or Planning Department for building permit prior to the effective date of this ordinance, and provided further that the applicant diligently processes the plans and provides the Building and Planning Departments with all necessary information preliminary to the issuance of a building permit. SECTION 5. The Planning Director of the City of Newport Beach is also hereby instructed and directed to apply all of the provisions of said Districts to the Properties as described herein; the same shall be in full force and effect and be a part of Title 20 of the Newport Beach Municipal Code. 2 SECTION 6. The Mayor shall sign and the City Clerk shall attest to the passage of this Ordinance. This Ordinance shall be published once in the official newspaper of the City within fifteen (15) days of its adoption. The Ordinance shall be effective thirty (30) days after the date of its adoption.
