HomeMy WebLinkAbout91-21 - Amending Newport Beach Municipal Code Section 14.24.065 by Decreasing the Sewer Use Charge for Customers Purchasing Water from the City, increasing Sewer Use Charge for Customers Not Purchasing Water from the City, Establishing a Wastewater SurchaORDINANCE NO. 91 -21 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH AMENDING NEWPORT BEACH MUNICIPAL CODE SECTION 14.24.065 BY DECREASING THE SEWER USE CHARGE FOR CUSTOMERS PURCHASING WATER FROM THE CITY, INCREASING SEWER USE CHARGE FOR CUSTOMERS NOT PURCHASING WATER FROM THE CITY, ESTABLISHING A WASTEWATER SURCHARGE • ON CERTAIN NON - IRRIGATION WATER METERS AND ESTABLISHING A SEWER CONSUMPTION CHARGE ON WATER DELIVERED BY THE CITY. The City Council of the City of Newport Beach does hereby ordain as follows: SECTION 1: Section 14.24.065 of the Newport Beach Municipal Code shall be amended to read as follows: Section 14.24.065. Sewer Use Charge. (a) A basic sewer use charge of $3.60 per month, shall be assessed for each use connection to the public sewer system for customers who purchase water from the City of Newport Beach except as provided in (c). • (b) A basic sewer use charge of $4.75 per month, shall be assessed for each use connection to the public sewer system for customers who do not purchase water from the City of Newport Beach. (c) A supplemental sewer use charge of $1.95 per month, shall be assessed for each additional living unit served by the same sewer connection. For the purposes of this Subsection, the term "living unit" shall mean each additional dwelling unit and structures designed for permanent residential use and each room with sanitary and sleeping facilities in any hospital, care facility, hotel or motel. (d) In addition to the charges specified above, a sewer consumption charge of $0.04 shall be assessed for each hundred iscubic feet of water delivered to each customer connected to the public sewer system. (e) In lieu of the basic sewer use charge, a wastewater surcharge of $10.00 per month shall be assessed on all non - irrigation water meters connected to a water service with a diameter that equals or exceeds two inches. SECTION 2: Severability. The City Council of the City of Newport Beach hereby declares that should any section, paragraph, sentence or word of this Ordinance be declared, for any reason, to be invalid, it is the intent of the Council that it would have passed all other portions of this Ordinance independent of the • portion declared invalid. SECTION 3: Savings Clause. Neither the adoption of this Ordinance nor the repeal of any other ordinance of the City shall, in any manner, affect the prosecution for violations of ordinances committed prior to the effective date of the adoption or repeal, nor be construed as a waiver of any of the penalty or penal provisions applicable to such violation. The provisions of this ordinance, to the extent they are substantially the same as ordinances previously adopted by the City and relating to the same subject matter, shall be construed as restatements and continuations, and not as new enactments. SECTION 4: The Mayor shall sign and the City Clerk shall .attest to the passage of this Ordinance. The City Clerk shall • cause the same to be published once in the official newspaper within fifteen (15) days after its adoption. SECTION 5: This Ordinance was introduced at a regular meeting of the City Council of the City of Newport Beach held on the 13th • day of May , 1991, and adopted on the 28th day of May , 1991, by the following vote, to -wit: ATTEST: AYES, COUNCILMEMBERS HEDGES, WATT, TURNER, SANSONE.
